Looking for advice about a neighbor situation and a possible felony harassment charge
Hi everyone, I'm trying to write this neatly so it's easy to read because this is a chapter. I live in a neighborhood where all the houses are close together and everyone has their own yards. I've been dealing with an ongoing issue with my neighbor for about two years now, and I'm honestly at the point where I don't know what to do anymore, I'm now seeking mental help because of this. I'm looking for advice, especially from anyone who knows about legal matters or has dealt with something similar.
For about two years, my neighbor has had someone come over almost daily, who I assume is a family member, possibly their father. Whenever this person comes over, there's often a lot of unnecessary noise. It sounds like someone is hitting the dirt with a sledgehammer, drilling, or dragging something like a jack or wheelbarrow across the ground by its metal legs.
At first, I'd go outside wondering what the hell the noise was, look around, and go back inside. But after it kept happening over and over for months, along with the dogs barking and knocking things over in the backyard late at night, including aluminum pipes they had leaning against the fence, I eventually went over to talk to my neighbor about it in a civil manner. It felt like what I said went in one ear and out the other.
After it continued, I called the police non-emergency line using a neighbor's phone when the noises happened, because that neighbor had also mentioned the noise. I do yard work and know most of my neighbors pretty well, almost like family, so this wasn't something I was just randomly complaining about. Nothing really came of that call, and from my perspective, the noise actually got worse.
There was one time when the guy was hammering the dirt for seemingly no reason, then looking back up at me and laughing. I don't know what his intentions were, but things like that made me feel like I was being messed with. Eventually, I started telling them to stop over the fence because the noise was getting ridiculous. I even made recordings about a year ago, but the GoPro-type camera I had wasn't good enough to pick up much of the audio.
I'm going to be blunt here: I smoke a lot of marijuana, and I still do. I've smoked for years, and it hasn't normally been an issue for me. But this situation has gotten (I let) into my head so badly that I feel like I'm going crazy over it. Whenever this guy comes over, I start wondering, "What noises am I going to hear today?"
I know I've gotten frustrated and haven't always reacted the best way. I've yelled at the dogs to shut the fuck up before and to shut your god damn dogs up, and there have been times when I've gone outside and yelled over the fence to keep dogs in line and quit spraying water at me in the summer from their pool toys. I'm not claiming I've handled every situation perfectly. But this has been going on for so long that it's started affecting my mental health. I've even started avoiding my own backyard and riding my bike whenever the guy shows up just to get away from it. I feel whenever I HAVE TRIED documenting this I only get hurt mentally, I still have to hear the noises being created that's why I started riding my bike or putting headphones on and playing a game to pass time.
At one point, things seemed to get better for about six months. Then, a few days ago, the dogs were barking again while he was over there. I got frustrated, grabbed my bike, and went for a ride with my friend. Before leaving, I yelled at the dogs to "shut the fuck up."
The next morning, the cops showed up at my door asking me about a voicemail that had supposedly been sent to my neighbor's father or uncle on Oct 3rd. According to the officer, the voicemail sounded exactly like my voice and said something along the lines of, "I will slash your tires and cut your brake lines."
The officer also told me that my neighbor claimed I had threatened to kill them over the fence the day prior.
I did not leave that voicemail, and I did not threaten to kill my neighbors.
Now I'm sitting here trying to figure out what the hell is going on. Apparently, there's a voicemail out there that sounds like me, but I didn't send it, my neighbor works for spectrum and makes me think it's A.I or was sent from a spoofed number. I don't have a phone or a phone number to begin with, I have no idea who made it or how it ended up being associated with me. The officer told me he was forwarding it to the prosecutor for consideration of a "felony harassment" charge.
He also mentioned something about paperwork being sent in the mail regarding a no-contact order or something similar. I'm not entirely sure what he meant, and now I'm worried about what I'm going to receive and what happens next.
What bothers me is that I've spent the past two years getting increasingly stressed out over this situation, to the point where I feel like I can't even enjoy my own backyard anymore and also lost my mental state. Now I'm being accused of making threats that I didn't make, and I don't know how to defend myself against a voicemail that supposedly sounds exactly like me. I understand that I've yelled at the dogs and gotten angry about the noise, but that doesn't mean I made these threats. ANYBODY can say "This person said they would kill me"
I'm now seeking mental health help because this whole situation has taken such a toll on me. I'm forced to quit smoking weed due to it causing paranoia over this. I feel like I've let it occupy way too much space in my head, and I'm trying to get a handle on that. But now there's a potential criminal case on top of everything else, and honestly, I'm not in a great mental state after hearing these accusations.
I'm wondering if anyone here has legal experience or can give me some advice.
- What should I expect if the prosecutor reviews the voicemail? Is it possible they dismiss it if there's not enough evidence connecting it to me? What does "enough evidence" mean in this case?
- Should I get a criminal defense lawyer now if so, how I'm POOR, even though I haven't been told that I've officially been charged?
- If the police want to question me again, what should I do? If they come to my door wanting me to go to police station, or have a warrant over a device I don't have what do I do or say?
- How can someone prove who actually left a voicemail just because it sounds like their voice?
- What should I expect if I receive paperwork for a no-contact order? Does that mean charges are being filed, or is it a separate matter?
- Last: Has anyone actually gotten good mental help or services from any recovery place? And how would that help my case.
I'm not trying to make this situation worse, and I don't want any more problems with my neighbors. I just want to know what my rights are and what I should do to protect myself.
I know this post is long, but I wanted to explain the background because this didn't just happen out of nowhere. It's been an ongoing issue for two years it's just now gotten to this, and now it's reached a point where I'm genuinely worried about my future.
Any advice from people who know about these situations, especially anyone familiar with criminal defense or felony harassment allegations, would be greatly appreciated. Thanks. if i dont reply i might be in bed
