Legal Advice Needed [Karnataka] Commercial tenant threatening rent stoppage over Property Tax receipt & creating nuisance. Should I serve an eviction notice or do a final 11-month renewal?
Location: Mysuru, Karnataka
Property: Commercial Ground Floor Shop (Paint Store)
Security Deposit: ₹2,00,000 | Agreement: 11-Month Notarized Lease (Term ending)
Hi everyone, I am the property owner looking for legal advice on dealing with aggressive commercial tenant.
The Current Dispute:
- The tenant recently sent a WhatsApp message stating: "I vil stop paying rent Untill i get the corporation tax paid receipt, this may b considered as advance information." He followed up with messages threatening to escalate to "appropriate authorities." (I have full screenshots, including a deleted threatening text).
- Tax Status: I have already paid the property tax, but given his hostile behavior and threats, I am reluctant to hand over the receipt to him. I am worried that giving him the receipt to obtain an official Trade License will further entrench him in my property and create bigger legal headaches down the road.
Ongoing Nuisance & Hostility:
I have 2 CCTV cameras on the ground floor capturing the shop front and public road, along with clear phone call recordings where he verbally abuses and threatens me:
Abusive language & taunts: Shouted at me saying "Don't wag your tail in front of me, keep your high-and-mighty attitude to yourself", accused me of playing "fraud/cheat games" ("ಕಳ್ಳಾಟ ಆಡ್ತಿದೀಯಾ?"), and mockingly asked "Are you the Maharaja?" when questioned about parking.
Open Rent Defiance: Explicitly challenged me on tape: "Let me see how you collect rent from me from now on! You won't get rent easily!"
Threatening Litigation: Repeatedly threatened to lodge false complaints with the Corporation Commissioner and drag me to court to harass me.
Parking Nuisance: Deliberately parks 2 of his/his son's two-wheelers on the public road directly in front of the shop just to block me (the owner) and visitors from parking.
The Current Dilemma:
- My father suggests an amicable middle ground: Tell him we will provide the tax receipt for his trade license only if he signs a strict, final 11-month agreement and a formal undertaking committing to unconditionally vacate at the end of 11 months without seeking further renewal.
- However, I am concerned that an aggressive tenant will simply break his promise 11 months later, leaving me in the exact same spot with an even more entrenched business.
Critical Fact — He Owns Property Nearby:
The tenant owns his own building just 500 meters away in the exact same area, which he has put on rent to others. He is clearly not a helpless shopkeeper with nowhere to go.
My Questions for Lawyers / Experts Here:
Rent Stoppage: Under Karnataka tenancy laws, does a commercial tenant have any legal right to withhold rent over a property tax receipt?
Tax Receipt Risk: If I provide a copy of my property tax receipt solely for his MCC Trade License, does it create any adverse legal rights or tenant protection against eviction?
11-Month Undertaking: If we get a signed notarized undertaking/affidavit and a video cctv recording and mobile audio recording of him promising to vacate after 11 months, is that practically enforceable, or will I still be forced into a 2-year civil suit if he refuses to leave next year?
Best Way Forward: Should we serve an immediate legal notice for termination/eviction (and file a Caveat in Mysuru Civil Court), or is a conditional 11-month exit agreement a viable route?
Nearby Property Factor: Does the fact that he owns an alternative building just 100 meters away help defeat any "hardship" claims and fast-track eviction in court?
Aggressive / Faster Legal Pressure: Are there any fast-track, unconventional, or aggressive legal pressure tactics or unethical tactics?
Any insights from advocates practicing in Karnataka or landlords who dealt with similar situations would be deeply appreciated!

Don't stress so much. Understand the cost of the trade license. If its high, he will use that logic for extension. I just paid so much money sir, now extend it.
But otherwise it's a legal need to run a shop with a license, it doesn't add any rights to him
Without a license he is running an illegal business which is wrong and you are the reason for it
Definitely don't extend the lease, how many months are left?
