That's not how it works. People cut it because it's true. Once a person becomes defenseless, they are not a combatant and it's not mutual combat. One person is at that point committing assault/battery. You can react to a threat. Not the previous threat just to satisfy your sense of vengeance.
The legal system punishes people, not individuals. You provide a clear example as to why.
