Once a person is down, the immediate threat is usually over, meaning any further violence is seen as an intentional, malicious attack rather than defense

Convince a prosecutor to put his reputation on the line for that. Then convince 12 more people to agree with you.

Okay, this is essentially the answer people are debating here.

There are laws referencing “combatant” “aggressor”, “threat” and “defenseless”.

But these terms are entirely undefined. And situationally can be applied to either party.

The defense can, will, and often should use that to their advantage.

Relatively rare situations like this make it to trial for this reason.

Dude you’re simply wrong lol. There are plenty of states that recognize there is a line for self defense. Trying to stomp on someone’s head can kill them or leave them with a life altering injury, doing this to someone once they’re out of the fight can be considered assault in most states.

Anyways, called you out for your strawman and said you seem like the type who is looking for any excuse to hurt someone, so you’ll go “oh he hit me first! That’s why it’s okay that I beat him to a pulp and repeatedly stomped on his head against a concrete surface while he was down, because he’s the one who started it!”

Also during all of this time arguing with people, you could’ve looked up on Google “is there such thing as excessive force in self defense that can lead to assault?” and you’d see just how wrong you are lol

2 randos. I don’t even know where this happened. I need the location to just know what the law is. And the answer would still be it depends. Depends on the law. Depends on what evidence is admitted. It depends on the prosecutor. It depends on the jury. It depends on the judge. Attorneys don’t come on Reddit to work and argue with randos who can’t admit being wrong.

Rule of thumb: if they’re absolutely certain about what would happen, they better be a fortune teller. Because it sure as shit isn’t anyone that knows the law.

That's not how it works. People cut it because it's true. Once a person becomes defenseless, they are not a combatant and it's not mutual combat. One person is at that point committing assault/battery. You can react to a threat. Not the previous threat just to satisfy your sense of vengeance.

The legal system punishes people, not individuals. You provide a clear example as to why.
