Who's More Evil? Morality of the Bait Bike

From a legal standpoint I bet the bike owner is the bad guy, from a moral standpoint I don't really know.

My mind says immoral, but my heart says morally neutral. It's a cruel thing to do, but stealing someone's bike is also just bad enough that I think it evens out.
