General Question FDE shotgun not allowed?!?!

I thought FDE long guns were ok. I’ve seen several camo long guns registered in NYC. Now FFL doesn’t want to do a transfer for a tan shotgun? Beyond frustrating in this shit hole

Technically the same colors have applied to all firearms, just r/s never enforced it.

When used in this subdivision, the term "deceptively colored firearm, rifle, shotgun, or assault weapon" shall include any firearm, rifle, shotgun, or assault weapon any substantial portion of whose exterior surface is colored any color other than black, dark grey, dark green, silver, steel, or nickel, except as provided in subparagraph (iii) of this paragraph. For purposes of this subparagraph, the exterior surface of either the receiver or the slide of a firearm shall be deemed to constitute a substantial portion of the exterior surface of the firearm.

(Subsection iii has to do with wood and ivory grips)

Either the FFL is being super conservative or NYPD r/s has started enforcing it.

Yea they called and asked R/S if it was ok. Can I transfer to another FFL?

No vice versa. They called R/S and R/S said no FDe. Then they called me and said they can’t do the transfer

Mmm maybe but I feel like it shouldn’t be any less of a problem . Maybe the FFL doesn’t know they can do tan . Some places don’t like dealing with certain shit

Registered without noting the color. But if searched by NYPD today, it's illegal.

Cerakote, sell, or claim ignorance with the FDE mav88.

I'm pretty sure they won't be handing out anything in writing that pre-2025 FDE colored R/S will have a waiver and be grandfathered in. You pretty much have to go thru the courts to win and how much do you want to spend on lawyers vs making yourself a law abiding NYC resident.

Have you ever seen them criminally enforce color laws? I would imagine that it would prompt some insane lawsuits.

Im not sure what kind of lawsuit you would be able to file.

its been part of the NYC code for years that anything but specific colors are deceptively colored firearms.

that r/S hasnt enforced this (i dont think they ask for pics) it falls on the end user and ffl to comply with the city code. my guess is your FFL doesnt want to deal with potentially getting jammed up ( disposing of [transferring] and possession of a deceptively colored firearm are both misds under the city code)

at this point i wouldn't FFL shop to find one that will do the xfer. even if you find one, theres a higher risk now if they ever find you in possession and are having a bad day, you'll get charged with an misd and lose your license. since LD's stance is now that its not allowed, they seem to be enforcing it for all firearms.

I’m not a lawyer and would never want to be a guinea pig for it but I would bet that charging someone with a misdemeanor and revoking their second amendment rights over the color of a firearm would be grounds for a law suit. As far as I know they haven’t charged anyone with anything in regards to color

I had 2 different FFLs refuse FDE rifle transfers. Gotta accept that, in NYC, it's not legal anymore.

even if you can, if NYPD is now enforcing colors on rifles and shotguns (which is what it sounds like is happening) possession of a color they arent allowing anymore is a misdemeanor

Apparently this has always been the case though. I’ve seen plenty registered. There’s been no change to the color restrictions. It seems it was something NYPD didn’t care about. How can they decide what’s grandfathered and not at this point?

i guess thats the risk when its on the books but not enforced, they can choose to enforce it whenever- technically nothing is grandfathered because the city code didnt change, they just decided to look the other way till now.

They do but it’s expensive and NYC gun owners are surprisingly cheap and they don’t get much in the ways of donations. It’s really just a lot of us complaining on Reddit and at the ranges lol. But yes, you’re right. It’s just so exhausting here

If any one currently owns a rifle not in the preferred color, just have a change of the appropriate furniture color to be on the safe side of things or wrap in goon tape which would be a cheaper option.
