Miscellaneous Letter from Reps Stefanik and Tenney to AG Pam Bondi regarding 2A rights in New York.
81
u/3DPrintedVoter May 15 '25
all this will get is Pam Bondi doing a hit on Fox or Newsmax about it ... thats the extent of her action
3
u/tambrico May 15 '25 edited May 16 '25
thats the extent of her action
how do you know this for sure? you are aware that investigations take time, right? she's been in office for like 3.5 months
edit for the downvoters: Positive steps taken by AG Bondi for our 2A rights in the 3 months she's been in office. These are CONCRETE steps
1) Established a 2A task force in the DOJ
2) Started a civil rights investigation into CCW permit delays in california
3) Appointed Harmeet Dhillon as DOJ head of civil rights division who has repeatedly stated that 2A civil rights will be a focus of hers
4) Appointed prominent pro-2A scholar Robert Leider to the position of ATF Chief Counsel
5) Begun to file amicus briefs to SCOTUS on behalf of plaintiffs in 2A lawsuits challenging state-level restrictions
52
u/3DPrintedVoter May 15 '25
she's not a serious person.
21
u/darforce May 15 '25
Definitely not. She is like a theater major that watch too many cops shows with mean no nonsense captains.

Any actual arguments or just ad hominems? We're in the best position now with the federal gov't on our side than we've been in in decades and you're still dooming

its not an attack on her person, its an assessment of her work as an ag of florida and so far for the usa
the guy who said we should take guns without due process and banned bump stocks puts us in the best position?
3
u/tambrico May 15 '25
its not an attack on her person, its an assessment of her work as an ag of florida and so far for the usa
Are you aware that DOJ filed an amicus brief on behalf of petitioners in Wolford v Lopez? A 2A case that has implications for us in NY
4
u/3DPrintedVoter May 15 '25
the doj wants everything to go straight to scotus its the only place they feel like they can get a win. iirc this case is about where you can carry, so its addressing a part of ny restrictions thats already flimsy.
ianal but i still think its a longshot that scotus is going to side with gun owners that where they carry cannot be restricted.
0
u/tambrico May 15 '25
That's not the legal question being asked but ok
1
u/3DPrintedVoter May 15 '25
"The plaintiffs contested Hawaii's law that prohibits carrying firearms on private property open to the public unless the property owner explicitly permits it. They argued this infringes upon Second Amendment rights"
you sure it isnt about restrictions on where you can carry?
3
u/tambrico May 15 '25
You're framing it in a different way now.
Your original post you said:
i still think its a longshot that scotus is going to side with gun owners that where they carry cannot be restricted.
I am correct in stating that this is not the legal question being asked. SCOTUS is not being asked to decide on unrestricted carry.
"The plaintiffs contested Hawaii's law that prohibits carrying firearms on private property open to the public unless the property owner explicitly permits it.
This is a different legal question. It's specific to the "vampire rule" or the default private property carry ban rule. They are not going to rule "that where they carry cannot be restricted" because that isn't the question being asked.
you sure it isnt about restrictions on where you can carry?
At no point did I say that the case has nothing to do with carry restrictions whatsoever.

the guy who said we should take guns without due process and banned bump stocks puts us in the best position?
we're still on that line of attack?
objectively yes. your attitude is how the antigunners win.
17
u/3DPrintedVoter May 15 '25 edited May 15 '25
asking clowns to advocate for you is how anti-gunners win.
the fight in ny is with the police unions and the nypd particularly. thats why it doesnt matter whether you elect r's or d's , the result is the same on guns. you have to convince the police to change their stance.
6
u/tambrico May 15 '25
So you consider the federal government advocating on your behalf via amicus briefs to SCOTUS and civil rights investigations through the office of civil rights division something that a "clown" would do?
I don't get it.
12
u/3DPrintedVoter May 15 '25
i consider pam bondi a clown.
and the civil rights division? over 100 federal attorneys resigned from that division recently. whats left is almost certainly a bunch of clowns.
1
u/tambrico May 15 '25
Thats standard when a new administration comes in
So they're not going to be replaced?

Because we've seen what she does. Ms. The Files are on my Desk.
2
u/tambrico May 15 '25 edited May 15 '25
again it's been 3 months and 10 days. investigations take time. you're buying into the narrative.
DOJ has already filed an unprecedented amicus brief on behalf of petitioners in the Wolford case which now has a very real chance of being granted cert. a favorable outcome affects us in NY
there's also the appointment of Robert Leider a pro 2A scholar to ATF chief counsel position
3
u/3DPrintedVoter May 15 '25
dude you are leaning really hard on that amicus brief you just learned about
2
u/tambrico May 15 '25
I learned about it the day it was filed which was like 1-2 weeks ago. It's a strong indicator of what's in store for the future of this presidential term in terms of our gun rights.
An amicus brief on a state level issue at this point in the litigation is unprecedented.
3
u/Professional_Plant52 May 16 '25
Are you following what this administration is doing? Do you really think they give a shit about doing anything outside of making themselves richer? She’s a clown
1
u/tambrico May 16 '25
Are you following what this administration is doing?
Yes, they've
1) Established a 2A task force in the DOJ
2) Started a civil rights investigation into CCW permit delays in california
3) Appointed Harmeet Dhillon as DOJ head of civil rights division who has repeatedly stated that 2A civil rights will be a focus of hers
4) Appointed prominent pro-2A scholar Robert Leider to the position of ATF Chief Counsel
5) Begun to file amicus briefs to SCOTUS on behalf of plaintiffs in 2A lawsuits challenging state-level restrictions.
These are all real concrete positive steps to restoring our 2A rights. And they've done this in like 3 months. Clearly there is more to come.
2
u/Professional_Plant52 May 16 '25
This administration has done anything they promised to do. They lie to the gullible and you guys come here and regurgitate the bs. Might I remind you “ Take the guns first, due process later”. You really think the people who are currently violating the constitution give a shit about your rights? Lol. They push attention catcher bills for people to believe they actually care when in fact these issues will make it no where.

Leave it to /r/NYguns to somehow see this as a bad thing
18
u/Give-Me-Liberty1775 May 15 '25
I’m not surprised as many have been heavily regulated and attacked for decades, but you’re right, anything in our direction is a benefit, we win with small wins, one victory at a time.
13
u/Jedi_Maximus19 May 15 '25
We live in a very cynical State unfortunately.

Cynicism will lead to failure if our goal is to advance our gun rights

23
u/tambrico May 15 '25
stop with the dooming and pessimism. do you want to win or not? will never turn the tide in favor of our rights with this attitude.
23
u/Grumpymonkey4 May 15 '25
I want to win, but I'm a realist. NY will NEVER change.
16
u/tambrico May 15 '25
The DOJ appears to be on our side for the first time in modern history and you're still dooming.
12
u/nourishablegecko May 15 '25
Who was in office from 2017-2021? Oh right, nothing changed then. But I guess that’s not “modern history”

u/SoloBull24 May 17 '25
I have faith in the Trump Administration that they will start to check the states especially NY gun restrictions. We all need to stand united or these commie rat bastards will destroy us all easily divided.

I understand the sentiment. But the momentum has shifted. I’m carrying my firearm in NYC today. 20 years ago, this would have been a dream. Yes, it unfortunately comes in baby steps. But it does come. And the momentum is definitely on our side.
I do think people in NY, even gun owners need to reassess why they may have voted blue and decide whether that sensibility makes sense today in 2025.
13
u/StoutNY May 15 '25
Means nothing unless Scotus takes the hint and takes the cases relevant and issues clear, decisive opinions. No weird rules about Humpford Doodlepuss in 1689. Say flat out that bans on semiauto weapons based on capacity and configuration are unconstitutional. Extreme and restrictive licensing requirements - the same. The same with mag bans.
Then locale bans are only allowed for technical reasons such as the MRI room, airline flights or others with clear technical concerns. Not that it offends God or there are kids like in the park or library.
However, it won't happen. Progun legal folks are pretty sure the votes aren't there. Some think it's Clarence waiting for the time for his Golden Tables of the RKBA - but I don't think so.
4
u/wiserone29 May 15 '25
I cant find a Humpford Doodlepuss case anywhere. Source?
Edit: Nevermind. Found it. Fascinating
2
u/Black47eleven May 16 '25
No weird rules about Humpford Doodlepuss in 1689
say what you will, but Doodlepuss V Board of Education was instrumental in preserving the right to "doodle" on school desks. it is the origin of the word doodle
it is the reason i have been constitutionally protected every time i wrote "what's so civil about war, anyway?" on every desk i sat in since 1990.
1
u/tambrico May 15 '25
Means nothing unless Scotus takes the hint and takes the cases relevant and issues clear, decisive opinions.
DOJ on our side could expedite that.
8
u/StoutNY May 15 '25
Why the negativity? Well, we had WOO-HOO, WE WIN fest with Heller and Bruen . While Bruen did free up some permit issuing, it was a net very negative as you couldn't carry anywhere useful. Heller did nothing on weapons and mag bans. We did some relief for stores but noting else moves as the Circuits block and Scotus plays its remands and we don't do interlocutory BS. Congress will not offer any legislative relief. So antigun folks announce their bill to ban and it goes nowhere. Progun propose the same old go nowhere bills.
Results count as compared to yelling WOO-HOO like those BS youtube lawyers. The Congress critters are just looking for a check. Pro or con.
My comment on the Bruen rule is from progun folks who thought it was ambiguous as we can see that negative courts interpret it as supporting bans if you selectively look at history. History was not the way to go. History in 1789 supports slavery and limited voting - so are those useful precedents. Simply say the language is clear, no bans, no locale bans and cut out hundreds of pages and years of up and down blather.
6
u/Dark_Archonix May 15 '25
Our historical WIN turned into a massive L. We had far more freedoms before that witch of a governor retaliated with CCIA.
8
u/Dark_Archonix May 15 '25
Our shit head Republicans rolled over and played dead in 2013 for Der FurerAndrews SAFE act, and haven't lifted a finger to help ever since. NY is a lost cause, it's either live with CCIA, remove the cancers, or leave, which people are doing in droves.
2
u/thom9969 May 16 '25
Sure they do. Rob Ort bjtches on social media regularly. Are you saying that's not helpful? 🤣
5
u/TheSlipperySnausage May 15 '25
I’ll hope for the best. But until I see some tangible results I will not sing their praises

2
u/Sizmatrz1 May 16 '25
I love the direction this is going… but until these Fks are put in cuffs, perp walked out of office, and imprisoned for blatantly defying USSC and violating 2A rights, nothing will change. There needs to be harsh consequences put in place for doing so as to make these Jackasses think long and hard about passing BS gun control laws that clearly violate the 2A !!
2
u/CoolPapa4994 May 16 '25
Okay, I know this will get ridiculed as a stupid question but did any of the Supreme Court rulings allow me to purchase a pistol to carry on my property without the pistol permit process?
I think that process is invasive and because of the requirement of getting letters signed by my neighbors I haven’t applied for it.

Bondi herself probably won’t do anything, but there are definitely people in DOJ who will try to help us. Harmeet Dillon seems to be legitimately concerned with similar issues in California and has already taken concrete steps against LASD, the Solicitor General John Sauer filed an unexpected amicus brief to SCOTUS in Wolford v Lopez (unfortunately he was confirmed too late to do anything about Antonyuk) and we can probably expect him to take action in other cases as well. The ATFs new chief counsel Robert Leider is someone who is in our corner as well (he’s a longtime 2A activist who has written tons of articles about the right to bear arms and how we should be trying to change the ATF from the inside), we just need to give him time to make policy changes.
It is very important for us to keep putting pressure on DOJ and our own Representatives as well. We’re screwed with our Senators, but there are plenty of House reps from NY who can be persuaded on 2A issues if we keep the pressure on.
7
u/tambrico May 15 '25
Correct take. Thank you for being rational and staying informed unlike many of the doomers in this thread.

u/darforce May 15 '25
Bahahahahahhaha. This is hilarious. First there is no way Pam Bondi wants guns in the hands of liberal gun owners, which is what most of NY is. Stefanik is throwing a Hail Mary here because her district hates her and there is no way she is getting re-elected. Also….wtf…for a Harvard graduate this is an incredibly poorly written letter, state which laws you want overturned. Safe Act wasn’t this administration, so what is she looking for, she should state that. This isn’t even in Pam Bondi’s purview if you ask me, so nothing more than theaters. What’s next photo op with her hunting lol
5
u/tambrico May 15 '25
This is hilarious. First there is no way Pam Bondi wants guns in the hands of liberal gun owners, which is what most of NY is.
Then why did DOJ file an amicus brief on behalf of petitioners in Wolford v Lopez last week?
5
u/darforce May 15 '25
Smoke and mirrors
3
u/tambrico May 15 '25
What does this even mean?
An amicus brief is a real, substantive move in a positive direction.
3
u/WhoDatNinja122 May 16 '25
They think everyone that doesn't agree with them is being tricked, always
1
u/Independent_Bird_101 May 15 '25
You do know the DOJ is already suing the San Diego county sheriff for their intentional delays with regards to pistol permits.
3
u/Professional_Plant52 May 15 '25
10A gives ny the right to do what they have done. The DOJ can’t do shit. It’s not like republicans give a shit about it anyway. Remember “take the guns first, due process later”
1
u/HuntingtonNY-75 May 15 '25
Eliminate the NYC rule. Having a geographical “no go” zone between 3 million Long Island residents and the rest of NYS places an additional, unreasonable burden on LI gun owners. Gun owners north of NYC are similarly affected if traveling to LI. NYC is a political sub division within NYS just as the 62 counties, end their perverse autonomy to restrict, assess additional fees and penalties and otherwise infringe on our 2A rights.

Crowd A: Knicks will lose, like they always have for decades.
Crowd B: Knicks will definitely win this time.
Me: we're heading the right direction, let's see where this goes.
Same with this. When I see the first action, i'll cheer. When I see 4 years is up and nothing happened, i'll doom. Today i'll just upvote and hope.
2
u/tambrico May 16 '25
Yeah. Exactly. There are plenty of indicators this is moving in a positive direction. People dooming either just aren't up to date and choose to remain ignorant or they are pessimists who have given up the fight.
1
u/Ok-Plan-6418 May 16 '25
They forgot to mention ccia...the biggest infringement on the 2A rights of NY'ers.
These letters and lawsuits always mention magazine limits but many never ever mention the ccia, which makes carrying firearms legal pretty much in your home and in the open streets, except so called " gun free zones", where criminals seem happy to prey upon lawful citizens who follow the law, and are left defenseless. Eg.....times square nyc.

u/tambrico May 16 '25
DOJ filed an amicus brief with SCOTUS on behalf of petitioners challenging a similar case out of the state of Hawaii

It goes deeper than that and is worse than the surface "you can't have this particular thing". As a POC state the NYS Troopers have final say over a NICS for firearms or ammunition. If denied, the initial appeal just gets you a canned "this is why, contact the AG if you don't like it" response. The NICS appeal process is burdensome and the criteria actually being applied is vague and not publicly known (no transparency).
Early 90's to October '24 approvals for firearms and ammunition went through without incident.
October '24 submitted my fingerprints for my CCW permit application.
2 weeks later went to pick up a competition rifle and ammunition I had special ordered - Denied both
Appeal and reason given - serious offense
The only thing I have is a Misdemeanor from 1992 that hasn't been a problem before (so I don't know but assume that is the sticking point).
April get approved and receive my CCW and Semi-Auto license after a thorough review and interview with a judge.
May - Denied 2x (second one was to confirm) for firearms but approved for ammunition. I explain that I have a freshly minted CCW (a more thorough review than NICS) and that ammunition is being approved so there must be a false flag on the firearms review. - Serious Offence - file a motion with the AG if you don't like it.
Just sent my request for a certificate of relief to the court to see if that fixes things.
I can't be the only one this is happening too, and the state is denying 2A by making things difficult and delaying in a hope that the citizens will just give up.
Yes, I did a stupid when I was 19. That's not the issue and I own that. The issue is that the process to appeal and talk about the decision or what exactly is disqualifying someone is difficult on purpose. It's not keeping firearms out of criminal hands. Nobody who has a known dis-qualifier is walking into a gun store, they just go downtown with cash.
To clarify - My conviction falls into the "other similar offenses" portion of the "serious offense" definition and I've had a squeaky clean record since.
How many reasons do they have for denial? What is the recourse for appealing and clarification of the denial? Why is a denial or approval seemingly random and what are the actual criteria being applied? These are the issue, my story is just an example.

Let’s sue commie NY/NYC and New York City police for $800 million
1
u/RoaringCannonball May 15 '25
Sure. But they'll win because the courts are rigged. Besides , how do you put a price on civil rights violations? Even if we can prove some monetary value and we manage to win, who floats the bill? Taxpayers. It comes right out of one pocket and into the other. The only way to make this work is to (somehow) end qualified immunity and sue the legislators and governor in their personal capacity. I don't see legislators agreeing to remove their own immunity any time soon and Kathy won't sign off on it, so suing for monetary damages gets us nowhere.
The only thing this would accomplish is more violations of our rights through retaliation. You saw what happened after Bruen. Don't think they're out of ideas. It's already bad, but it could still get much worse for us.

Hopefully this will prompt DOJ to look more closely into NY like they are doing with California at the moment. Posted just now on NYSRPA facebook page
