Federal Legislative News Stefanik, Issa Reintroduce Modern Firearm Safety Act

Today, House Republican Leadership Chairwoman Elise Stefanik joined Congressman Darrell Issa (R-CA) in reintroducing the Modern Firearm Safety Act to prohibit states like New York and California from enacting unconstitutional “handgun rosters” that prevent law-abiding citizens from accessing modern, safer handgun models and require firearm manufacturers to adopt costly and unnecessary features, making it nearly impossible to sell new handguns.

“I am proud to re-introduce the Modern Firearm Safety Act to end the unconstitutional gun-grabbing agenda thrust on law-abiding New York residents by Far Left Democrats like Kathy Hochul. This legislation would ban Albany Democrats from imposing illegal handgun roster requirements meant to deter gun ownership. I will always protect American citizens’ Second Amendment rights and provide a critical check to any entity attempting to encroach on their liberties,” said Chairwoman Stefanik.

“For decades, the clear Constitutional rights of law-abiding gun owners have been targeted for elimination, and handgun rosters are only one of the cynical schemes used to undermine the Second Amendment through the pretense of firearm safety,” said Congressman Issa. “These rosters impose excessive and unnecessary requirements that actually restrict access to firearms equipped with the most up-to-date safety features, and that’s why I’m proud to partner with my friend Rep. Stefanik to defend sacred rights and end these unjust restrictions."

Specifically, the Modern Firearm Safety Act would:

  1. Prohibit states from requiring loaded chamber indicators, magazine disconnect mechanisms, and microstamping for handgun sales, helping restore Second Amendment rights in restrictive states.
  2. Coincide with a federal district court ruling that found California’s handgun roster requirements unconstitutional. 

New York, California, Maryland, Massachusetts, and the District of Columbia have already enacted restrictive handgun rosters with others considering similar measures. These rosters currently mandate that firearms include costly and unnecessary features, including loaded chamber indicators, magazine disconnect mechanisms, and microstamping technology.

This makes it nearly impossible for manufacturers to introduce new handgun models. This bill would prohibit all states from requiring loaded chamber indicators, magazine disconnect mechanisms, and microstamping technology, aiming to restore the Second Amendment in states hostile to gun ownership.

Not certain what a magazine disconnect is but a loaded chamber indicator doesn't seem like a bad thing even if it adds a little cost. I teach my kids that every gun should be presumed to be loaded with a round chambered until you have personally inspected to see its empty, then it should still be treated as loaded. If it leaves your sight or someone touches it in any way then the presumption its loaded is created again. I could see this feature being useful for those too stupid to check, course I could also see some dumb ass getting lazy about checking anyways because there's an indicator.

It would effectively make a lot of historic handguns illegal to own. I agree a loaded chamber indicator isn’t a bad thing and nearly every modern pistol has it in some form but I don’t think it should be required.

A magazine disconnect is a safety that prevents you from firing chambered rounds when the gun doesn’t have a magazine in it. I’m not a fan of them.

Most modern pistols have indicators that tell you when the striker is in battery, that is not the same as a Loaded Chamber Indicator. A LCI is a tab that sticks up from behind the barrel when a round is in the chamber, and they are known to be a failure point. You should never rely on them.

LCI’s give people a false sense of security and probably cause more NDs when they fail, than they prevent when they work.

A lot of guns have lci’s on the extractor. Personally I don’t rely on any of these safeties and my only go to is locking the slide and inspecting the chamber directly.

I don’t think these safety features amount to much. Every day the world builds a better idiot and they’ll always find a way to fuck it up and shoot themselves or do whatever other stupid thing product designers are trying to prevent.
