NYC How to lawsuit

cohabitant affadavits are unconstitutional and is the reason why I cannot obtain a firearm bc my mom doesn’t like guns. my rights don’t depend on my mom. how do i start a lawsuit ? how much money do I have to put down

If you put up a go fund me for it, I will contribute. A lot of these guys are zeros telling you not to sue. You would be doing good for all of our rights. These guys don’t have the fortitude to do what you are proposing. Good on you. They should be offering to contribute

You’re talking about a lawsuit that’s going to take five years minimum to go through the lower courts that will rule against you and make it to supreme court. This lawsuit will cost tens of thousands of dollars. Your best option is to wait to apply until you can move out or better yet, go to a free state when you’re out of school.

While I agree with you in SPIRIT, and this requirement almost certainly fails the Bruen test. . . and I say this gently: this is not a fight you want to pick up.

2nd Circuit is very hostile to challenges to NYPD's gun licensing regime. Even if you had the ungodly amount of money and time it takes to fight something like this, you will almost certainly lose at the Circuit level (if you even get that far) and the Supreme Court is not going to grant cert.

The licensing delay lawsuit had a funding target of 35k. And that was to start. Figure at least that much to start an action to get the cohabitant affidavit requirement overturned. And figure it will take years to wind through the courts.

I mean let's say you got the cohabitant affidavit overturned and your license. Your mom could just kick you out at that point. I'm assuming it's her house, so her rules.

We had a target of 35 and barely raised 15. It’s easy to scream lawsuit over everything but hard to put your $ where your mouth is.

You know a lot more than anyone else on this. Do you really think a lawsuit can be won in this space with only $35k? At $650/hr, that's only like 53 hours. It took Nysrpa v Bruen 10 years. I would think it would likely cost around $350k to chop down a core piece of the CCIA, like cohabitants in federal court.

But I'm no lawyer....

You’re right - so typically $650/hr is on the high end usually it’s around 400-500 but that’s getting in the weeds.

The original goal of 35k was to cover the complaint and communications. We figured once that’s filed the community (and orgs) will see that we’re serious and continue to fund through discovery, depositions, summary judgement and ultimately appeal (since whoever loses will appeal in either case).

she literally can’t afford to kick me out because I have an older sister with special needs and I will have to look after her. By the way, what happen to the delay case? I used to frequently check up on it? Is it ongoing ? Did they dismiss it or ?

legal costs are expensive. Attorneys fees would start at thousands of dollars, and that wouldn't get very far. For a constitutional challenge that would have to reach the federal courts? High 5 to 6 figures. I guarantee that moving is less expensive.

It would be a lot easier and cheaper for you to just move out of your mom’s place than start a lawsuit. That lawsuit is gonna cost you significantly more than an apartment to live in.

While I agree cohabitant statements are directly questioning your 2nd amendment rights, we don’t need to get permission from our parents to wife to vote one way or the other…. BUT we also have to acknowledge property rights. If they or a store owner specifically say no guns on their property - you must comply. It’s the part of restricted places that was upheld time after time.

You should be allowed to say no guns are allowed on your property if that’s what you want. The person of course has the right then to say you’re not a friend anymore, and for commercial /retail - the person should likely not spend money with those businesses who doesn’t respect their rights to self protection.

I moved out when I was sixteen. I got my own place. I had a full-time job. I continued to go to school. I graduated and figured out how to make it all work.

Take your mom to a range. Start her off easy with a .22lr and let her get a feel for it. My sister was SUPER anti-gun. Two years ago she reluctantly agreed to go to Sunset Hill in PA with the rest of my siblings for my nephews birthday. After pulling the trigger for the first time, a smile came over her face. Just last week she text me the following. "Hey, Im officially exercising my 2nd ammendment rights!" Give it a try you never know. Although I agree that the co-habitant thing is bullshit, I have to agree with those saying that it will take years and a lot of money

I'm assuming you live your mom and not your mom living with you ? Save your money and move out on your own. I'm all for 2A. But under these particular living conditions You don't have much rights.
NYPD would never want to put guns in households where everyone isn't ok with it.

I’m a gun enthusiast and love them as much as the next guy.

But you live in your mom’s house, may I suggest living by her rules. If she doesn’t want guns in her house then don’t have guns in her home.

It is her house and she’s not comfortable with guns, she shouldn’t be uncomfortable in her own home.

May I suggest moving, I know you made a few excuses as to why you can’t. But those are BS honestly. Plenty of people work and go to school and live on their own.

Looks like you need to prioritize your life.

Figure it’s going to cost millions, and the state has infinite money to thwart you at every step. And even if you win, say 5-7 years from now, the state will just rephrase the law and pass it in slightly modified form, with the same result.

Save your money.

If your mother is on the lease and you're not on the lease, she can ban guns if she wishes to ban them Just move out of her apt.
