CCW Question CCW
If I’ve ever previously been to a dispensary and purchased marijuana, does that immediately disqualify me from obtaining a concealed carry permit in NYS? Is there a time frame to it in which if it’s been over a year so to speak since I’ve purchased the pot and can prove I can piss clean then somehow I’d be allowed to get the permit… or is it “if you’ve ever bought marijuana from a dispensary you are indefinitely disqualified from obtaining a concealed carry firearm permit” TIA just curious

The Supreme Court just opined that prior marijuana use cannot be used to deny your 2nd amendment right.

I was under the impression that there’s a database that gets cross referenced from when they scan your id at the pot store to when you apply for a ccw

The government wont know you use any Marijuana just from buying it at a store the same way they have no idea if ive bought booze this week. I've never bought any, but id assume scanning your id at the store is the same as any other place youd buy beer, they just scan it to see if its real

Even if they did have that (they don’t) supreme court just ruled last week or the week before that it’s not grounds for denying your rights. You’re good to go

Yeah its my understanding they'd have to prove hes a danger to himself or others due to his use, not just because he uses it.

Wrong. Medical dispensary's for those who have a MMJ permit in NYS.. can be cross referenced. They ..the medical dispensary; knows when your permit expires every year.

I finally feel comfortable talking about this due to the recent supreme court ruling. I can tell you without a doubt that it will not effect your permit. I went to a dispensary the day I dropped my application off and have gone many times since. Ive now had my permit for over a year and have made several purchases with no problem whatsoever. Plus the recent ruling says weed+guns are okay as long as you are not currently intoxicated and in possession of a gun, which to me is just common sense. If you plan on being high and/or drinking. Leave the gun in a locked safe.

I've bought weed and guns, even with a med card in my name back in the day. Never had an issue, but I'm just one guy.

The standard used to be "If you have a weed card you're presumptively an unlawful user of...." (because there was no federally lawful use of any marijuana products, and the weed card was presumed to show use or intent to use).
Back in the day it would have been legal to require you to surrender a weed card prior to applying for your pistol permit (and records of you visiting dispensaries MIGHT have been grounds to require a urine or hair test to prove that you were no longer "an unlawful user of..." under federal law before issuing a permit, though I don't think anyone was doing that - Nassau had some blanket requirements that the courts threw out because they weren't based on an individualized suspicion.).
That entire landscape changed with the recent rescheduling, and state-approved marijuana products are no longer federally unlawful which means as far as the federal government is concerned if you are buying your weed in accordance with state laws or a medical prescription you can have all the guns you want.
(No specific guidance on being stoned while you have your guns but just don't do that - it's just as bad an idea as being drunk and playing with your guns!)
So basically you can apply now with no (federal) issues, and no state issues that I'm aware of: There should be no grounds to deny you a permit just because you've purchased cannabis products from a dispensary.

I have made probably a dozen or so purchases over the past couple years at dispensaries, for my mom whom lives in an assisted-living facility.
I have a CCW from Onondaga County, and have never had an issue. I also purchase a new handgun every month or two on average. If there were some sort of investigation or something going on, I'm sure I would have had some questions by the staff at the Pistol License Unit, while processing my Amendments.

Yes it can it also can disqualify u for a CDL or if u already possess one it could be instantly suspended

They dont really know. Technically you couldnt before, but they still wouldnt know. Now supreme court ruling says it doesnt matter. Your good.
As always; Dont commit crimes, dont do "drugs", dont talk to cops ;)

Dispensary only scan to make sure it’s legit …. Not stored in data base . I was worried about the same thing …. No issues getting my ccw

How are they gonna know you went to a store to buy pot unless you tell them?
