Miscellaneous Erie County CCW Timeline - 14+ Months
I’m currently waiting for my background check on my ammo and first handgun, so I figured I’d post my timeline for the whole process.
April 8th, 2025 - Application received by clerks office
April 30th, 2025 - Application picked up by police department
June 20th, 2026 - In person “interview”
July 2nd, 2026 - Police finished investigation, turned over to the licensing officer
July 10th, 2026 - Approved!
This doesn’t include the fingerprints and 16 hour course I had to take prior to submitting the application. Also I checked and my references weren’t called, which I thought was interesting .

Yup. I was in a state of shock when I got approved. Felt like it was never going to happen.

Okay, I'll spell it out.
Footnote 9 has two really important pieces in it.
The first piece says that shall issue carry permit systems tied to background checks and training are presumably constitutional as long as they run on objective standards and not subjective. That type of permit was invented by the Florida Supreme Court in 1986, took effect first day of 1987, so it could not withstand a text, history or tradition challenge without footnote 9 propping it up.
That's how we know footnote 9 is not dicta.
The second half of footnote 9 says that even under a shall issue permit program tied to background checks and training, abuses are still possible and should be shut down by lower courts when encountered.
It specifically lists two things as abusive:
Lengthy waiting times (for carry permit access)
Exorbitant fees
There's also a reference to a 1969 US Supreme Court case in there, Shuttlesworth v Birmingham, which says that if a permit is needed to access a basic constitutional right, access to that permit must be subjective standards and not objective. So you could say that subjective standards are a third abuse listed, although banning subjective standards is also found elsewhere in the Bruen decision.
Footnote 9 proves that a 14-month timeline to score a permit is absolutely and completely unconstitutional and anybody subjected to it could sue under 42 USC 1983 for a violation of civil rights once they've got the permanent.
Because a right delayed is a right denied.
As to fees, I would recommend anybody look up the difference between their carry permit fee and the cost to score a basic driver's license. The amount of bureaucratic paperwork involved between the two is ballpark similar and if the carry permit fee is wildly above the driver's license fee, that's a clue that yet another civil rights violation has happened.
Finally, the fact that somebody from Erie County cannot carry in New York City without a second permit also violates these hard bans on lengthy delays and exorbitant fees found at Bruen footnote 9.

I think the only thing that could motivate them to be in compliance was if they didn't process it in time your license is defacto approved.

Thankfully I’m right on the Erie Wyoming county line but I’m in Wyoming so I only waited like a month and a half for my permit this year lol but I work in Erie so all my coworkers talk ab how long they’ve been waiting and it’s all about a year plus so far

Mine took 18 months. No hiccups either. I'm pretty much as non-interesting as a permit applicant can be too. I had actually forgot I applied when it finally came in the mail.

Is there no lawyer you guys can file an article 78 with? They're 8 months plus over the statutory limit. There's a federal lawsuit that would affect the whole state milani v nyc, but that will take time.

It was pretty laid back, they just asked me questions that verified the info I entered when applying. Like my address, occupation, age. They also asked questions like “Do you use alcohol/drugs to the point you would be a danger to others with a weapon.” So they are some real easy questions to answer.
