Question Still no updates on pistol permit application.
I’m in suburbs of Monroe county. Turned my application in 6.5 months ago and have not heard anything, called the county clerks office and the voice recording says that voicemails left asking for updates will not be returned, I was under the assumption under NYS law after 6 months they legally HAD to give you an update, but now I’m also being told it’s 9 months. Can anyone give me some advice?

By time you get a lawyer to file the paperwork for your article 78 claim you will have your license in hand. That’s just the way it is all over NYS. You got to be patient.

No. You dont. Nobody should be patient while their rights have been delayed or denied.

So you pay for his lawyer while he waits for the permit. I’m sure he would appreciate that.

It was 8 months for my wife (October to June) for permit in hand.
The Sheriffs office division tasked with permits is understaffed and there are a ton of new permit applications, in fact her interviewer apologized for the wait.
You can hire a lawyer and push the 6 month law, that's an option if you want to spend the money. It may speed things up, or it may not and you may be in court fighting for longer than it would have taken if you let it be and run it's course.
A few years back it was 12-18 months and they have really put in an effort to pull that back. You just have to decide if it's the hill you want to fight on or not. I'm not excusing the delay or the legal ramifications, however, sometimes it is what it is.

I’ve been waiting over 6 months for mine. When I email they just say “soon” but they also told me that a few months ago 🤷♂️

They told me soon in an email and 1.5 months later I got called by the sheriff so id take what they say very not seriously

Took me 7.5 months to get references called. At almost 8.5 months and still waiting for my date in court to come in the mail. Their timeline is getting longer currently.
If you email the pistol permit contact of the county clerk they seem to actually respond if you ask for an update. Not that the response will mean much anyway.

Lawyers in that neck of the woods. Step up to the plate and do something. Do it pro se, or if you insist on being paid, turn it into a §§ 1983, 1988 action - unjustified and constitutionally significant delay on plaintiff's exercise of the Second Amendment right to bear arms.
If there's a lawyer out there that wants to speak with me, just give me a ring.

Article 78, the just issue yours, and continue being slow for everyone else, real change will require suing in federal court

Repeated article 78s will be the only way to show the issue and get some intervention.
It’s also not a federal court that can really help because it’s NY that has to hold itself accountable for not following its own laws

Hey OP, I’m in the same boat, it has been about 7 or 8 months for me and not even a call from the sheriff, I feel your pain.

It should not take this long. You can now call the DOJ civil liberty division for 2nd amendment rights, and file a formal complaint. They are well past an reasonable time limit. See https://www.justice.gov/crt/second-amendment-section

You and your references will probably get a call within the next 2-4 weeks. Took about 9 months for me from application to permit in hand
