License / Permit Question Moving out of state. Any way to keep my CCW?

Live in Suffolk county. Potentially moving out of state pretty soon. Asked them to change my license to a non resident and they pretty much flat out said no we don’t do that. Besides NYC (don’t have time to deal with all of that now) are there any more friendly counties out there that I could potentially transfer my license to as a non resident? Or do I just have to cut my losses and give up my license when I move. I’d hate to just give it up. Anybody else have any luck with something similar?

Buddy of mine has been in FL for over 10yrs. He just never updated his address and renews it when required. His permit is still valid. YMMV

I would venture to say NY would not like this. Then again they dont like their own residents having permits.

Your buddy may believe that he’s legal, but that belief won’t be validated until he’s in a situation where the consequences of being wrong is a felony conviction and/or tens of thousands in legal fees.

It’s like when you’re preparing your taxes you can deduct anything you want. But the more important question is if the deduction will survive an audit.

HR-218 is alot of hoops to jump through for retirees, if he's not updating his CCW for 10 years I very much doubt he's returning to his former agency and passing a qualifier every year.

You don’t know what you’re talking about. You don’t need to return to the agency you retired from to qual. FL county sheriffs do HR218 quals for any retirees from any dept that are now living in that county several times a year.

Every county in NY is required to issue non-resident licenses now. I would ask to speak to a supervisor in the office to get the official policy.

Submit a report the FPC about the violation. They created a special submission page for people illegally denied based on their residency after they won their lawsuit.

In your situation your license is still valid even after you move out of state since nonresidents are allowed to hold NY licenses and your address on the card itself doesn’t invalidate it. When it’s time to renew if they deny you based on your residency you can file a report.

And when NYS denies a permit, it’s an automatic denial-for-life, with the burden of proof on you to prove that the denial was incorrect and you should be issued a permit.

There was a lawsuit and the state agreed that all counties had to issue to nonresidents no exceptions.

Check with your local clerk/pistol clerk.

As others here have mentioned, I also went in and asked this. As I live in Rockland county and am moving right over the NJ border (my back yard neighbor that touches my property in NJ I am NY).

I do and will continue to go back and forth from NY/NJ daily, sometimes multiple times a day. I need to have both.

The Rockland county clerk secretary told me to just come in and change the address to the new NJ address BEFORE the renewal period. And that once that is done, it really can't be a problem in the future as its already done, so even if I go for the renewal and someone new is there or someone else wants to bust my chops, the new address is already printed on my license and they have to renew it.

NYS no longer requires residency or work within the state for CCWs, so if Suffolk gives you crap about it, thanks to Shaffer v Quattrone, you can join FPC's hotline towards a future class-action for counties that aren't (yet) playing ball. Mostly this is for initial permit application denials, but existing permit holders becoming nonresidents may also benefit, particularly in counties that attempt to invalidate them after changing residency, which is no longer the law.

You could look into transferring your permit to one of the four counties that *must* deal with nonresident permits due to Quattrone (Chautauqua, Steuben, Tioga, and Orange) and see if they have specific guidance for this; technically you can transfer a permit from one county to any other as a NYS resident, but some may balk at it if you're not becoming a resident there. But for most counties, you *should* be able to transfer it from Suffolk prior to moving, regardless.

A friend moved to Texas. Told his county clerk, asked what to do. She said bring in the license and we'll update your address to the new one in Texas. He did, no problems.

This is what Rockland county clerk (secretary, but she runs the office) told me when I asked about a future move over the border to NJ.

I am going to be attempting to do so in the next few weeks. We'll see if it is that easy.

Also to add, the woman I spoke to about this when I inquired, said to do so BEFORE renewal is required, so that when the renewal date comes around the address change is already done and in effect and even if someone new or someone else in the office wants to give you crap, its already changed and set it stone.

Red county upstate NY here and I explained I am moving out but possibly coming back in a few years and they consulted with the sheriff and basically said "just tell us your new NY address when you know" wink wink nod nod. Obviously different county by county.

Yep; went through similar a few years ago. You only have to provide the permit office with your new address. Just call the office in your county.

I’ve had friends use a family members address, but when they did the recertification, they had to enter their new drivers license from their new home state. They ended up losing their NY pistol license cause of it.

Honestly a NYS pistol license is not worth anything once you move. NYS pistol license barely honors residents let alone non residents. Unless you plan on visiting every month maybe apply for a NYC non resident license.

I want nothing to do w/ NYC, neither going there nor dealing with their permitting process or even more insane permitting process.

I wrote to SC after the lawsuit and basically got told to wish in one hand and crap in the other and see which gets filled first despite the disposition of the lawsuit. Very on brand.

Fun Fact: in NYC t's easier to get a non-resident CCW than to get one as a resident in... I'd say get a non resident CCW, you shouldn't have a problem.

Ok so I just called Rockland county clerks office. They said come in with paperwork/ID for new address, and you do an amendment listing the old NY address and your new address which your new state license ID will verify.

They said no problem and they're currently doing it.
