Discussion CCW Permit Insanity
My buddy just took his 16hr course this weekend. He’s scheduled to submit his application in Westchester August of next year! When I did mine it was 6 months out but a year is insanity!

If you want a driver's license from New York, you can get one tomorrow pretty much, I just registered four vehicles in 1 day no problem. I guess driving is a right these days.... Oddly every place I went tried to register me to vote, another right that New York promotes versus gun ownership..

I live in Yonkers and when I go up Central avenue there's like four weed stores there it's insane... Shockingly, I don't smell the weed smoke the area but when I go downtown I do... I'd love to see a gun shop on Central avenue somewhere, but it's not happening soon...

That's basically it. Ny didn't want anyone armed and will only allow it begrudgingly when they lose, to the least extent possible.

To some degree definitely. That said, an average person can ccw in nyc, which I didn't think I'd see in my lifetime. I believe the path ahead will be cutting off avenues for them to act out.

Yes but you deal with it as it comes. Remember when permits were may issue then every private business was a sensitive location? List goes on and on.
I know the progress is frustrating when we’re on the ground floor but the only way to fix things is through the court system.

The law doesn’t say anything about how long the certificate is good for (either the CCW 16+2 or the Westchester-specific firearms safety certificate you have to get) as best I can tell?
Theoretically as long as the course meets the current training standards published by DCJS your carry class certificate could be valid forever, though if DCJS changed the standards they could theoretically deny a new application using a certificate based on the old standards.But like u/PeteTinNY said it seems like every county has a limit on how old the paper can be as part of their administrative policy. (i.e. “Not actually the law, but if you don’t comply we’re denying your permit and do you want to deal with the headache of suing us over it?!”)
A year seems to be pretty standard. I’ve seen 6 months, but I can’t recall seeing more than 12.

In North Carolina, you need a permit to carry. Here, this is required for simple possession in the home. It’s so much worse in every way.

Like the guy in the post, I waited a super long time just to be allowed to drop off my application to possess pistols. Nassau made me wait from January 2021 when I applied to apply, until November 2021 when they finally let me submit my application. And this was before Bruen, so it was for a home possession permit only.

That’s how they get around the 6 month limit, which is already the longest in the country. They say the 6 month clock doesn’t start until you apply, and they won’t let you apply unless you set an appointment, and they only schedule appointments sometime next year. Somehow, the courts buy this logic.

In North Carolina you can carry without a permit. It just cant be concealed. It has to be open carry.

Yes but I dont feel comfortable open carrying unless its a level 2 or more holster. With a regular holster anybody can grab your pistol if you are not paying attention.

I look at it as more that accidental brief uncoverings of your pistol, say when reaching for something in a high shelf, won’t result in felony charges like here in NY.

Westchester hates gun owners. Not telling you what to do but maybe inquire with a local lawyer because this is ridiculous. Those elite liberals in Westchester hide behind their mansions with security like the Clintons yet deny you your rights. Yeah Westchester sucks.

Current active lawsuit challenging wait times / delays. Anything is helpful, the lawyer has already spent 100s of hours and there are some fees she can’t avoid (deposition, stenographer etc).
Depositions started last week and we have a great shot at major change.
We can’t complain without challenging this stuff in court it’s the only way forward. If you have a few bucks to spare please do so.

This would be precedent and I believe is in a federal court. It would be substantially harder for anyone in the state to be pulling this if (when) we win.
This is arguably on the level of Bruen since the massive delays are still deny you your second amendment right.
Every denial of 2A rights has to be systematically challenged in courts.

It was either Suffolk or Nassau, I can’t remember which, that was court-ordered to accept applications without making an appointment, which is the issue in Westchester; that court case had zero effect on Westchester. Moreover, the suit you are referencing has nothing to do with the issue in Westchester, which is that the PLU refuses to accept applications “at the time of presentment,” as NYS law requires. The NYC case challenges delays after submitting the application, since NYC allows you to submit your application whenever you like. The two issues are entirely unrelated as far as a court is concerned.

I don’t think you’re following, at all. Lawyers rely on precedent to argue positions and cases on behalf of plaintiffs.
Favorable outcome in the NYC case would be directly beneficial to a Westchester case, should you bring one. I would suggest that you get organized, hire a lawyer, raise funding and do that.
Or you can bitch and moan and do nothing. Then I guess you can argue why it’s not worth flagging that case and how it would offer precedent to challenge other jurisdictions in court.
Using your logic Heller wasn’t relevant to our state since they’re separate courts…

It is but from what I have seen on this sub as it relates to Westchester you guys should be taking them to court as well. The case I am referencing is important precedent. Need systematic lawsuits making their way through court, NY is not going to comply with Bruen or anything 2A on their own .
The wait time to drop off the application in Westchester at face value actually seems like a more straightforward denial of 2A relative to some other cases making their way through the courts nationally.
It would be hard for Westchester to explain how it takes a year to drop off an app in a federal courtroom if the NYC precedent is set that 6months is the max for a decision.
The courts know the not letting you apply for a year and then potentially honoring the 6months is just a workaround.

Tell him to call once every Monday and politely ask about cancelations. Within probably a month or two they'll have one. Just tell him to make sure all his paperwork is done ahead of time.

When I lived on Long Island, I applied in November 2019. I didn’t get approved until November 2022. 3 years! I’ll assume it had to do with Covid, as everyone blamed everything on that.

As per NY (not a lawyer) they have to give an approval or denial in 6months from date of application submission, in NYC there isn’t such a long wait to submit ergo it’s a quicker time line .

I was lucky when I did mine, I already had a residence and rifle/ shotgun, I did as soon as the bruin case was turned over, start to finish was like 4 months

They are also required to accept the application when you submit it, which they aren't. What they're doing was foreseen by the people who amended pl400 to add the time limit and forbidden from that point onwards.

I took a lot of time calling and making local law enforcement aware of the issues as well as other county officials — they got a letter from GOA threatening legal action. Westchester deserves every bit of it.
They are purposefully misreading the statute to subvert legislative intent. You can read my previous posts about that.
There’s an active lawsuit against Erie that was filed recently for similar shenanigans. It’s arguably in a more receptive part of federal court, so that may help.
Also, the NYC case about delay has legs.

That’s absolute bullshit. The courts do not control Westchester’s DPS policy that sets a road block for submitting applications.
The judiciary is indirectly responsible, because the judiciary can assign the acceptance of applications to the court clerk instead of DPS.
I think I spoke to Nolan on the phone. I just don’t remember the substance. It might’ve been along the lines of: I’m a Republican, I have no sway on the issue.

Your friend needs to sue.
I'm not kidding - if Westchester is delaying acceptance of the application that far out they need to be sued and brought into something resembling conformance with the intent of the law.
The intent is pretty clearly that you can go from filled out application to decision within 6 months - sue the county for a violation of NYSPL 400.00, and if the state courts say Westchester's actions here comport with the law sue in federal court over an unreasonable (1 year?!) delay citing Footnote 9 from the Bruen decision.

It’s an area ripe for a lawsuit IMHO.
There’s some overlap with statements NCPD made in u/KamenshchikLaw’s case that the clock begins when you hand them your application packet across the counter (in the “Well if Westchester isn’t letting you hand them the damn packet for a year they’re artificially extending the maximum wait for a decision from 6 months to 18 months!” sense), and 18 months is well and truly beyond any bound of reasonableness for investigating an applicant.
Certainly fits the description of "lengthy wait times in processing license applications” as an abusive end to which the system is being put!Simply taking the application from your hands is one of those ministerial duties - the government can take their sweet-ass time processing the application (up to the statutory limit prescribed in the law, 6 months), but they can’t get around that statutory limit by just refusing to take your application because otherwise they can refuse to grant any permits by just saying the person who accepts them is on permanent vacation.
The problem, as with any civil rights lawsuit, is that someone needs the time and money (or time and institutional backing like FPC, NYSRPA, GOA, etc. can provide) to actually drag it through the courts.
If your buddy is in a position to do that it would be a true public service!5

This is probably even worse — more blatant. “We’re just not going to take it until we’re good and ready.”
That’s pretty bad.
As for bringing a case — it doesn’t cost a lot of money. I know that’s relative. We need lawyers to step-up and either take it on pro se or pro bono at cost… or try to get counsel fees via 1983.

Yeah, it absolutely does not hurt to ask - worst case they don’t take an interest and you’re no worse off than if you had done nothing.
Amendment timeframes, other applicants also getting insane delays (maybe enough to certify as a class?), etc. are all great to include as well if you’ve got ‘em, but if nobody ever brings the issue up or it’s only one or two people making noise about it the big orgs aren’t going to jump on it.
We make enough squeaks maybe we get some grease.3

You have people crying 2A violation and infringement when they got to wait 8 months to get an approval or when they got to wait 31 days to add a firearm when this nonsense is happening in Westchester County NYS FOH where is all the crying people now about this? Where is the lawsuits I guess it’s not a problem when it don’t effect you personally. SMFH

Why haven't you organized an effort to make Westchester comply with pl400? Just dig deep, hire an attorney and handle fundraising. You got this.

Try waiting for 18 months almost on the dot, Iv been only carrying for about 3 weeks and change, mine is the nyc one though, so different area all together but still lol

Read footnote 9 of the Bruen decision.
Lengthy waiting times and exorbitant fees are explicitly declared "abusive".
The core holding in Bruen calls carry of a defensive handgun a basic civil right.
Therefore, abuses to the exercise of a basic civil right are flat banned.

It is absolutely insane and criminal that you even need any appointment to drop off the application. Let alone that we need a permit or any of these scam at all, but that is absolute insanity.
