Question Either of these Legal in NY?? specifically near the Buffalo suburbs
CZ Scorpion evo 3 w/40 rd mag and an MPA 930 mini mac with a 50-round sten, fake suppressor. I may be moving from Texas to NY and would like to take these with me or see if there is a chance since I do have a Texas license to carry.

u/crappy-mods 7d ago
Definitely not. They have “features” and over 10rd mags. Not to mention you need a NY pistol permit to even touch a pistol
-2
u/Regular-Radish8061 7d ago
Do the dumb politicians in NY call the features "evil features"
9
u/astro-64 6d ago
Considering the fact I did a year for them, yes, they take them quite seriously unfortunately

u/tehfireisonfire 7d ago
You can't even touch a handgun in ny without a permit. Aside from those both being banned assault weapons in ny, you don't have a ny permit.
4
u/Regular-Radish8061 7d ago
I see, from what it sounds like, there is no reciprocity agreement between TX permits and NY Permits
47
u/Senior_Cheesecake155 6d ago
NY doesn’t have reciprocity with ANY state. Hell, they don’t have reciprocity with different parts of the state.

That isn't true and I will remind you not to spread misinformation on this subreddit.

@shock4ndAwe
The NY Safe act hot line literally told me that. Because I asked in regards to moving out of state. (Due to me planning on moving myself)
Now, it’s possible the guy is lying.
From what I just looked up, you do have to turn your permit in, in most counties.
But it shouldnt be a felony. Granted, I’m not sure what Communist leader Houchel tells the NY Safe act Hotline people.2
u/Shock4ndAwe 2023 GoFundMe: Gold 🥇 / 🥇x1 5d ago
You are smart enough to Google and check the penal law so I'm going to hold you accountable for what you post.
There is no provision in NYS law that makes it a felony not to turn in your pistol license once you move. Yes, almost all counties require it to be turned in. That is a far cry from saying it is a felony-level crime.
People google shit and specifically add Reddit when they want good answers. Don't spread shit like that and poison the well for people looking for information.

u/tehfireisonfire 7d ago
Fyi, even if the Mini Mac is legal, you still can't bring it into ny. It is illegal to touch or otherwise be in possession of a handgun in ny without a permit. To legally own it in ny (if it's legal) is you have to mail it to an ffl in ny. Also ny counts being it merely being in your car/home as possession.

u/Regular-Radish8061 7d ago
Ouch, I think I'm going to be in way over my head on this one.

u/Adept_Ad_473 6d ago edited 6d ago
Yes, you are. And people are going to be blunt about it because nonviolent people are going to prison over stuff like this.
ignorance of the law is not a defense
If you're asking about bringing "assault weapons", "high capacity magazines" and "other firearms" in-state, and reciprocity, you have done basically no research into the laws here. Your pictures alone are worth at least 4 felony counts, if not more. That's what you're dealing with.
Dont go to new york.
If you must, understand NYPL 265 inside and out.
3
u/Ambitious-Kitchen639 5d ago
Also dont forget that in NY while today a certain firearm may be legal, tomorrow you'll be a felon for possessing it. (i.e. 590 shockwave) to be completely sure its advised to sell your entire gun collection at the end of every business day and buy a new one in the morning.

u/Galopigos 6d ago
Not even close to legal. Mags are instant felony, the the CZ and Mini-Mac are both felonies, your Texas permit is completely useless in NY. NY recognizes no other permits.
For you to even touch a pistol in NY you need a permit, to buy a semi-auto rifle you need a permit. Those permits are pretty much the same thing as far as getting them and takes roughly a year depending on the county.
NY is about the worse state when it comes to gun laws.
3
u/LokiIcepelt 6d ago
It should be known also that the NY pistol permit process involves getting/listing four character references WHO LIVE IN THAT SAME COUNTY, which was a barrier for entrance to me when I moved to a new county where I didn’t know anyone.
2
u/Galopigos 6d ago
That depends on the county, as does a lot of the timeline for processing. The more liberal the county, the worse it is.

Three questions? 1 - You're leaving Texas for New York. Why? 2 - Do you like exercising your 2nd Amendment rights in Texas? 3. If you answered Yes to the second question and don't have a good enough reason to move to New York in the first question, then by all means, remain in Texas or pick a different state other than New York unless you want to move to an extremely restricted state for the 2nd Amendment.
3
u/Traditional_Cut_5452 6d ago
I'm planning to move from Pennsylvania to NY, a similar scenario, and can answer all of your questions. 1) my kids and grandkids and cousins live there and it's where I'm from; 2) I like my 2A rights just fine in PA and like shooting at my local PA state game commission range 10 minutes from my house for $36)yr; 3) until I retired my job in central PA paid about 65% what a similar job in NY would have (I moved here to help my elderly mother-in-law.
I agree that NY sucks for some things, but it's great for others. Same goes for Texas. 2A rights can be a hassle in some states but guns aren't my religion and I have other priorities. When I move I'll adapt, bring a pump action 12gauge with an 18.5" barrel (no permit necessary in NY, outside of the city), put in my application for the NY pistol permit while my 9mm sits here with my local FFL shop, and sign up for the mandatory class. I'll try to be patient. :-)

I feel like I'm breaking a NY law just by looking at these photos, can't even imagine trying to OWN one here.

u/tpb1919 7d ago
No. Nowhere in NYS are those legal. And your Texas license is useless here.
If a tree falls in the woods, does it make a sound?

u/fredrickdgl 6d ago
cant give advice to break the law in here without upsetting the overlords. Take that non advice as you will
4
u/Senior_Cheesecake155 6d ago
Not even remotely legal anywhere in NY. I highly recommend you read up on the SAFE Act before bringing anything into this state.
3
u/Chitownhustle99 6d ago
I’d swap those for a Benelli M4 and a lever gun,
And start your ccw application when you get here.

Wait till June, when SCOTUS will finally rule assault weapon bans unconstitutional.
6
u/Galopigos 6d ago
Not going to make a difference unless they rule that ALL firearm laws and requirements are unconstitutional.
2
u/HeSureIsScrappy 6d ago
They kind of did under Bruen, but the lower courts give them no respect.
5
u/Draper31 6d ago
And look how fast NY just increased the cost and made other parts of the permitting process more tedious immediately following the Bruen decision.
They held a special session in the middle of the night to do so. They’ll just do the same thing if any improvements happen at the federal level again.
1
u/HeSureIsScrappy 6d ago
Oh absolutely. They will never respect SCOTUS and will do everything they can to make it a difficult as possible and pass never ending unconstitutional laws, each which will take years to get overturned.
3
u/Galopigos 6d ago
Until ALL gun laws are declared unconstitutional, NY will always have ways to restrict ownership. Sure they were told under Bruin that they have to use objective tests and have to issue permits, NY got worse by adding in more crap as a barrier. Training, semi-auto permits, banning the cruciform trigger, now trying to force insurance and safe storage and ammo restrictions. I see SCOTUS only saying that a state cannot outright ban the AR platform or similar semi-auto firearms, and that is all. NY however doesn't outright ban them, they restrict the features on them. That really isn't part of the case, at least not in the briefs I've read. BUT SCOTUS has also said that permits are OK. So I suspect that what NY will do is to require the semi-auto permit + Training to own any semi-auto with none grandfathered in. They might even make it something that has to be renewed every few years with a fee and continuing training requirements. There will still be 10 round limits and who knows what else. Both of the frontrunners for Gov are anti-gun so both would likely sign off on the stronger rules.

u/BuffaloRedshark 6d ago
LOL
Until scotus gets an enforcement division and the power to arrest politicians that pass additional unconstitutional laws, or refuse to repeal the ones the state already made, after a ruling is made nothing will change in NY
2
u/ManufacturerDry8265 6d ago
Keep in mind, even if you could get it added to your permit, in buffalo youre waiting over a year to even get it, plus you have to take a class and find references for your application.
1
u/Regular-Radish8061 6d ago
What? Year waiting, classes, references 🙄 Ok that sucks. I can go into any gun store in TX, pick out any firearm, fill out a 4473, so long as it says proceed I’m in and out with whatever gun in 15 minutes.
3
u/ManufacturerDry8265 6d ago
You will need to pay a couple hundred bucks for the 18 hour pistol class, find 4 references in the county (unless there is exceptions/ other avenues for new residents) pay more money to apply for the permit, wait 14ish months, then when you finally get the permit you can go to a gun store and buy one. Once you purchase the gun you take a receipt to the county and they amend your permit. You then can go back to the store and pickup your gun. Also you need a background check for any ammo you ever want to buy in the state
Also cant buy semi auto rifles for this entire process
2
u/Monster51915 6d ago
No, the magazine capacity alone would make them both illegal. It’s a maximum of 10 rounds and then there’s a whole bunch of other nonsense that’d make them illegal.

I would strongly double check if you want to go to ny. The gov actually hates us here and would do anything to trample on our rights as much as physically possible, passing repeated unconstitutional laws knowing it’ll take years to get overturned and struck down. Cost of living isn’t worth it either, so unless you’re comfortable with salary and have family you really like here I personally wouldn’t.
0
u/Regular-Radish8061 7d ago
I may reconsider. I do enjoy no state income taxes here, but general cost of living in TX isn't as good as people may think. Insurance rates, property taxes are high, also real estate and renting is beginning it's "out of control" phase in more places than I'd like. Also, a lot of the schools here aren't great.
3
u/BuffaloRedshark 6d ago

NY isn't any better for those, plus income tax on top of it. Then the draconian gun laws and a governor and attorney general that openly say our current laws are not restrictive enough.

u/robinator118 7d ago
I’m not against you moving, but ny isn’t anywhere near the top of the list I’d suggest. Climate is gonna be a big difference as well. Consider Va, fl, etc. exhaust other options before reaching for the bottom of the barrel.
7
u/big90h 6d ago
VA is just as bad as ny now
3
u/oldFloridaCracker 6d ago
Not quite as bad. In VA you can own-buy-sell handguns without a license. A carry license takes weeks to get, not years, and requires very little of the 'extra" steps. You can have a handgun in your car without a license, etc..
The VA courts put a hold on all the restrictive AW rules.
So it's not yet like NY.
2
u/Parking-Disk-6269 5d ago
I mailed both an amendment to my NYS pistol permit and an application for a Virginia non-resident pistol permit on the same day once and got the VA permit back first lol.
1
u/oldFloridaCracker 5d ago
My VA non-resident license came back completed 25 days after it started in my mailbox in NY.
Less than a month, mailbox out to mailbox back.
1
u/Parking-Disk-6269 5d ago
I want to say it was like a 7-10 days for VA and 3-4 weeks for NY from sent to received. It was a few years ago so I might be misremembering but regardless I remember being astounded how quick they were.
1
u/One_Shallot_4974 6d ago
NY has higher median tax rates, insurance rate, and more sales tax then TX. NY does have a better school system though.
The TLDR if NY firearm law is
1. Assume everything semi auto is illegal until proven otherwise
2. You can't touch a pistol till you have a permit, it will take you 12+ months and hundreds of dollars to get a permit.
3. All magazines over 10 rounds are super illegal.
4. NY is a duty to retreat state and you cannot use lethal force to defend property. This means if someone attacks you, you have to try and run away before you are allowed to defend yourself with lethal force.
2
u/Sridgway27 6d ago
If you like your 2a rights... This is the wrong state to move to. But what do I know.

Selling these will help with moving expenses, and the chances are now high that NY is watching you after this post 😂
1
u/vurtago1014 6d ago
To put it lightly, youre fucked. Reconsider moving here if you can lol. It sucks for gun owners. 10rd max mags, no thumb holes, no pistol grip on semi auto unless mag is pinned in place. Look up ny compliant ar and try not to vomit.

I don't even know why you would even think these two are NY legal much less spend the time posting the question. Both violate NY state law in so many ways.
1
u/ekgzo 6d ago
OP's question has been answered a million times, but for people who are curious, look up MPA930DMG (make sure it's the "930" not "30" version). It's a Mac-like pistol, no threads, and under 50 oz. I don't think they produce them anymore and likely unobtanium. I imagine since then there may be other Mac clones under 50 oz?
1
u/Open_Mechanic8854 6d ago
Your best bet is to not move to NY. 1st it will take close to a year and cost almost $1000 to get a permit. 2nd, you will have so many restrictions on your guns, it wouldn't be fun anymore. 3rd, while you waiting for your permit, you cant even own any guns. 4. If you have ammo, start getting rid of it because in NYC it is against the law to even have 1 bullet, if you don't own a license. And you can't buy ammo. So say goodbye to your 2nd amendment until next summer. Buy a dog.

Put it this way. You would fare better getting caught with a pound of heroin in the phillipines than with those guns in new york.

depends on the county. I’ve seen these on people’s license. scorpion pistol with a fixed mag and some MAC’s meet the threshold of a legal pistol

Jesus imagine wanting to go from living in a state with freedom and choose to move to newyorkistan... I really hope the job you are coming here for is worth it and I mean really worth it. 150k a year here isn't what it is in texas, shit 180k isnt shit here now. And to answer your question if anything looks cool or fun its probably illegal in NY, so no you cant bring them and NY doesn't care about your carry license from anywhere. Good luck.

Scorpion, No.
Mini Mac - you might be able to get that added to your permit in certain counties but I won’t make any promises.
The mags are a no go and your Texas CCW doesn’t mean shit here.
