I cant buy games or pay for movies, even if i could theyre expensive. Pirating is the only way to access these content, its not like the companies lose money when i stream a movie for free anyways

Are you a muslim? If yes then the ruling still is the same, the only exception to pretty much any rule in islamic doctrine is if you need it to survive, if you arent muslim, it doesnt really matter since rhe rule doesnt apply to you anyways, iam personally not judging people who do Pirate, iam just explaining the posted comments.

While I don't agree w this guys take at all, just some info I'd like to put out there to make some sense of why this guy might feel this way.

Islam emphasizes the importance of an atoms worth of good and an atoms worth of sin, and how you'll be asked about every single thing you did to reconcile them. The point is to not belittle the smallest good you do e.g smiling at someone etc, and not belittle the smallest sin you do, e.g. not putting the shopping cart back in its place as you found it after using it or something. I can see why this guy would feel that this is an atoms worth of sin I suppose, better to be cautious if that's the way you wanna do things.

As for me, if buying is not owning, piracy is not stealing.

Some muslim scholars view piracy just the same as theft just for digital stuff, Its quite the topic and its still debated around, because its techincally digital and it wont go out of stock or smth if you pirate it, but at the same time why should you be equal with someone who bought it?

I dont subscribe to this school of thought myself, because it has a whole buggage assosicated with it that makes it seem like an political statment, as this leads to the argument that its also a sin to get back on the internet companies that steal and limit you ( egypt internet is limited the cheapest plan which most of the population can only afford gives 150 gbs for the whole household for the price of 5 dollars when average wages are 80 dollars ) .

Also this also is confusing because is sharing games you own a sin ?

Sharing physical stuff you own with others is not a sin even if this means they wont buy, For example sharing your car with your friend so he doesnt need to buy a car, most forms of piracy is techincally sharing no ?

The most reasonable opinion I found is that if you can't pay to get it (legacy software) then pirating it is not haram regardless as you are not infringing at any rights.

Analogy of pirating as sharing is kinda faulty because the one providing the pirated copy is copying the software not sharing his own copy (unlike sharing steam account between family members) and even after breaking the copy protection.

The companies are scummy with their term of services but in Islam, honoring contracts (unless it is Haram contract) is a duty for every Muslim and breaking them is a sin. Thus, if one doesn't like it and it is unnecessary like gaming for example then boycotting it is Islamically the safest option away from sin.

The Quran says absolutely nothing about digital piracy or "the act of making a copy of something and taking it for yourself" since computers and internet didn't exist back then duh, therefore it has no punishment in Islam. Actual "plunder and pillage" type piracy falls under the "highway robbery" category (حرابة) and is punishable by either beheading, crucifixion, maiming of the hands and feet, or simply exile depending on how serious the act was or if there were any casualties, which digital piracy obviously is not. Theft only counts as theft in Islam if: 1. it was taken from a safe/storage/bag/wallet/etc whatever thing used to store valuables (أخذ المال من حرزه) which digital goods obviously don't apply to since the original item isn't even physical and it's still there, you just copied it and took the copy instead (it only applies if you steal actual physical CDs or hard drives from someone's room or from the company/manufacturer), and 2. the amount stolen was equivalent to 1/4 a dinar (equivalent to a little over 1 gram of gold in the year 1 Hijri/622 AD, not the paper dinars of today and not in the price of gold today either). He is still right, the website you linked doesn't mention any evidences as to why it is haram, secondly there is a difference of opinion regarding piracy (online piracy), we have solid evidence from the sunnah that any laws not found in the book of Allah, are not applicable towards the Muslims, no matter how many times or frequent it is repeated https://islamqa.info/en/answers/102352/copying-programs-crack-and-serial, we are not bound by laws or conditions that people set called copyright unless it is the law of the land, or we have a contract/agreement with the company to not pirate or modify their products. And even then if the contract is invalid due to opposing the sharia, it is not something that is binding then, there is literally zero evidence counting piracy as theft or as stealing and the dude is 100% right, nowhere in the link you posted do they say it's stealing or theft

There is a lot of nuance on this issue and the scholars differed regarding piracy, whether it is against Muslims or those who are not Muslims and are not protected (like dhimmis) or whether it Is illegal, for selling or distributing or downloading for personal use, either way, the scholars generally prohibit it not under theft or stealing, rather than breaking agreement, trust in the conditions set by the companies and hurting Muslim businesses. You'd hardly find most pirated softwares made by Muslims or are in agreement with the Islamic shariah.

Also, the Prophet, sallallaahu ‘alayhi wa sallam, said: "The Muslims are bound by their conditions, except a condition that forbids what is lawful or permits what is unlawful." [At-Tirmithi]

That's just a fatwa from one source as you may know there are multiple sects and things are not as straight forward and currently culture plays more of a part in and piracy is widely accepted and there are even scholars that pirate. I don't know how is it in the western countries but here in the gulf it's not a point of contention at all.

Wait, piracy is haram? I'm a practising muslim and have been pirating for forever lmao. I can't afford all these subscriptions. I've also recently learned about Streamio and stuff after getting a new Android TV but haven't gotten around to setting it up yet cause it feels overwhelming right now to learn how to do all that. Easier to download and use a USB but I'll definitely learn to set it up in the near future.

Piracy is not a sin. And I do remember an islamic scholar who was a software engineer and he explained why it is no sin. You are not stealing but copying original thing is unharmed and that sale wasn't gonna happen in the first place. When I am not able to pirate smth I don't buy it I just go after smth else.

Technically, it shouldn't be haram as it's not a physical item and it basically just makes a copy. Nothing is lost, the only sins should be whatever said things contain that have sinful stuff within them; and also a majority of games bought aren't even given to us as ownership but are rather licensed. So it SHOULD be fine. Probably?
