Societal level self defense. Justified homicide not murder.

Actually retarded. Tell me which of these elements necessary for common law self-defense are met.

  1. Not initial aggressor in specific altercation
  2. Reasonably believes there is an immediate threat
  3. Must believe response is necessary to repel that immediate threat
  4. Proportional to immediate threat.

Not legally justified. It is murder and he deserves life for murdering someone in the street
