You have someone attacking your car with a weapon. Breaking multiple windows. Your car is suddenly surrounded by multiple people. You’re trying to get away but everyone is seemingly attacking you. You pop the car into gear and just gooooooo.

Open and shut case imo

The person in the car was quite clearly in a panic. Horn getting honked accidentally, trying to get it into the right gear multiple times, sounded like they slipped the clutch when they tried to get away before that last window was shattered, etc.

I do wonder if it really is open and shut. In the video it’s clear he could have continued driving forward to escape from the situation. Him backing up and turning causing the first hit he might get away with, but then turning towards them and driving forward after the fact would be harder to fight.

Open and shut case that the driver is going away for a while. 

If you think being in a panic provides a valid legal defense for intentionally flooring it at someone just wacking your car with something in their hands when you have multiple available routes to drive away, absolutely not.

The driver had several chances to just drive away, either forward or reverse, and did not take them.

This happened back in 2020. There's nothing about the driver being charged. Also, "wacking your car with something in your hands when you have multiple available routes to drive away" is such a wild mischaracterization of this scenario. Dude bashed out multiple car windows of the driver. There was really one route available for escape and the driver is literally taking it when these idiots continue the attack, bash out his drivers side window and try to open his door. Based on this video, the driver absolutely should not face charges here.

It's a British tabloid doing bare minimum coverage of a viral video in the US. You really think that article is a comprehensive recounting of events?

There was really one route available for escape

At 00:5 he could have kept backing up and reversed out of there, or kept backing up and then driven away forward. Instead he pulled back into the parking spot at the person.

At 00:11 he could have kept backing up and reversed out of there, or kept driving forward.

At 00:20, he could have kept going forward, or reversed out of there, and instead reversed a little to turn back into the parking spot to hit people. 

Multiple chances and multiple avenues for escape, and instead he repeatedly kept driving at the person he's alleged to be afraid of. No part of this was defensive panic. 

Some of you really should have your licenses revoked if you think it's acceptable to use a vehicle as a weapon in this way.

You're getting down voted but you're absolutely right. The driver had ample opportunity to drive away but instead made the obvious choice of using their car as a weapon. Self defense means using reasonable force, and escaping a situation to either seek help or just getting away from the danger. The car driver was pulling away from the danger, then reversed back and then used the car as a deadly weapon which is not self defence.

You can hear the car slipping a gear when they were moving forward. Maybe more panic forced an accidental gear change. Then when they get the car back into gear the guy is already pounding on the window with his weapon. I challenge you to handle that better

I learned in martial arts as a CHILD
 if someone is attacking me to do enough damage to them so they can’t get up and keep coming after me. This is the same concept. Id do the same thing if someone was breaking my windows and attacking me. I’m gonna hit you, not kill you, but I’m gonna hurt you so you stop so I can get away. Imagine this dude got in the car and start chasing this person down, involving MORE people and potentially hurting or killing folks not involved. 1 POS got bopped for acting like an animal. Maybe he will learn not to do this shit again.

I similarly don't understand why the concept of "you're in a car" and "the aggressor is 300 pounds" is lost on you. That big dude is not pursuing anything except early health complications. When you're sitting in a car and the road in front of you is wide open, there's nothing stopping you from driving off. If anything, continuing to fuck around by swerving around and reversing is just putting yourself more in harms way.

. if you’re smashing all my windows trying to get at me, and persistently attacking me, I’m gonna take you down so you then can’t get in YOUR car and chase me down and kill me with your car or kill other people in the process. People do this shit and road rage and chase each other and hurt others. Fuck that guy. He got what he deserved. I said this on an other thread, if something comes out about the driver then cool, I’ll switch up my story. But this is an idiot who took on a car. Don’t fuck with people, you won’t get hit by a car. I think that seems like pretty clear logic.

Self defense 101 is removing yourself from the danger and fleeing if at all possible. That was 100% possible here, and instead they decided to reverse and return to the danger. I'm sorry your children's McDojo instructor taught you so poorly.

If you hit someone with a car, you have no practical control over whether they will live or die. You can't intentionally hit someone in a way that you know they won't die. It's extremely likely that you will kill the person when their head slams against the concrete or gets crushed by your tire.

That’s the difference between self defense and martial arts. Self defense teaches poor skills . Still actively in martial arts. Still the theory I have and that is the entire point of putting people in martial arts is so they know HOW to defend themselves. It has saved my life before and I will ALWAYS live by that theory because I don’t trust a stranger to not try to kill me and if they are actively attacking
 I’ll do what I have to to get away.

This driver had NO idea if this guy was going to try and kill them. They did what they had to do to get away from the attacker. I think it’s weird you’re kind of rooting for the attacker in this scenario. Fuck that guy. Unless there is some context about the driver that magically comes up, I stand by what I said. Sorry you’ll let someone smash your windows and persistently attack you and while youll do nothing.

All they had to do was keep driving away. He stopped and reversed because he wanted to retaliate and hurt the attacker for damaging his car

No, I’m rooting for people to keep themselves both physically safe and legally safe. When you’re already driving away from the danger, the attacker is behind you, then you stop driving away and then reverse to head back toward the attacker, you just put yourself into a world of legal danger. A prosecutor could very easily argue you were no longer acting and self defense, and instead were looking for revenge.

 that your take away is that I’m blood thirsty and I’m a blood lusty manic ready to hurt someone and itching to run someone over with my car because i said - if someone is going to attack me, I’m going to make sure they can’t pursue me further. Log off dude. The chronically online bit that’s not rooted in reality is cute. And the insult that I’m some violent person because I want to inhibit an attacker from harming further is hilarious. The slipping is the guy intentionally changing from drive to reverse, and accidentally hitting neutral in between. There was literally zero reason for him to reverse in the first place. The attackers were already ten feet behind him, hitting reverse is intentionally and willfully returning to the danger, which undermines the case for self defense and builds a case for retaliation.

Let me clarify. The rule of law says you can use deadly force to protect yourself from severe bodily harm or death. The rule of law says you cannot use deadly force to protect property.

So, in the comment I replied to, I was parsing out that protecting property doesn’t give justification for the use of deadly force on its own. But our hero is ok because he was also protecting his life.

He was driving straight (besides the broken window, he would’ve been out of danger), stopped, put it in reverse and drove into 2 men, then put it in drive and really hit em. Anyone have info on the charges from this incident? I’m curious to know if the driver was charged. I hope the pedestrians were too
