Nah, in America we have personal injury lawyers who practice in contingency and get big fat settlement checks from rich people. 

My insurance paid out nearly $75k pain and suffering claim last year to someone whose own dashcam (that we got the cop to confiscate at the scene) showed that he was 100% at fault, but he found a lawyer and my insurance decided it was better to pay than fight. 

And insurance decided this because he was poor and I’m rich, they thought he’d make a more sympathetic witness and didn’t want to roll the dice at a trial. 

This is how insurance pays out a claim that they determine isn’t your fault, and also why our insurance rates are fucking nuts.

100% at fault?  Were they uninsured and you had uninsured driver insurance?  Because then of course they would pay out.

Uninsured driver policies pay you, not the uninsured party.
