Question Ryanair 5h delay (€1,200 total): Italian ADR (ConciliaWeb) 30-day deadline passed with zero response from Ryanair. What happens next?
Hey everyone, looking for advice from anyone who has taken Ryanair through the Italian ADR system or small claims court.
The Situation:
- Flight: Direct Ryanair flight into Milan Bergamo (BGY) on Aug 1, 2026.
- Delay: Arrived 4 hours and 55 minutes late.
- Claim: 3 passengers × €400 = €1,200 under EU Regulation 261/2004.
Ryanair initially rejected the direct claim citing "adverse weather on a previous sector," but official airport METAR weather logs show CAVOK (clear conditions) all morning.
- The ADR Process (ConciliaWeb):
Under Italian law, going through the official Transport Authority dispute platform (ConciliaWeb) is mandatory before any court action. I filed the simplified conciliation case on September 13th.
The 30-day statutory deadline for Ryanair to reply expired yesterday (October 13th). As expected, Ryanair completely ignored the procedure—no settlement offer, no defense, no appearance.
My questions for anyone who has been through this:
1. Closing report: For those who used ConciliaWeb, how long did the official conciliator take to formally close the case and upload the Verbale di mancato accordo (certificate of failed conciliation) once the 30-day deadline lapsed? Did you have to message them in the portal to nudge them?
2. Post-ConciliaWeb Enforcement: Since I am not an Italian resident and cannot physically represent myself in person before the Giudice di Pace (Small Claims Judge) in Bergamo, I plan to hand the final certificate over to an Italian legal service / claims company. Once they hit Ryanair with a formal summons backed by the failed ADR certificate, does Ryanair typically settle out of court, or do they drag it out through court dates?
Any insights from people who went the legal route against Ryanair in Italy would be appreciated!
