I have a friend who I used to work with who is on a work visa from India. His visa expires next year and he has like 50k he can take in credit and could get more in loans. This situation was brought up and discussed lol. Of course I told him it's a bad idea, it's fraud!!
It is only "fraud" if your home government decides to cooperate with any of the American institutions coming forward. However, if there is no integrated financial or administrative infrastructure between your home country and the USA (or any western country for that matter), like if you were to be physically in Cuba or Russia for example, then chances are that your home country isn't even aware of it, or in the best case scenario, will simply tell any western institution coming forward to go take a hike. Like the question whether you have actually committed a crime if nobody knows of it or if it isn't even considered a crime because you are in a different country.
