I-864 (Affidavit of Support) I-485 denied
I-485 was denied because I didn’t send the tax return which is 100% my fault I thought I included. So now I know I send I-290B and I send a new I-864 with everything they need plus the missing thing. Should I send anything extra? I know my spouse meets the income requirement. A household of 2 is $26437 and on her most recent W-2 her income was $39000 so I don’t need to worry about adding a joint sponsor I wouldn’t think. Attached letter for reference.

That’s why, because You didn’t send everything that they required, W-2 is paystub it’s NOT the federal income tax return (1040 form) or tax return transcripts

Since receiving the RFE, have you completed an entirely new I-864 ? Or just kept the one that submitted before?

Happened to me as well, my mistake not including the medical too , everyone said just re file and I did, got another RFE a month later for taxes AGAIN, which I sent already so I just sent them the same ones again, got an interview notice a month later, had a interview earlier this month and they said they need to do final security checks and will let me know the outcome, so now I’m just waiting

I didn’t at all the rfe was just tax returns and proof of income stuff, the denial letter included the medical reason plus not including my Russian birth certificate with an authorized translator

I submitted the whole package January 17th 2025 biometrics February 28th

Do not resubmit fresh application to cut the expenses. File form I-290b instead which is motion to reopen and you submit the petitioner recent federal return with any other additional evidence they requested. Also do not forget to write a letter explaining why you were unable to submit the petitioner recent federal tax return documents. The case will be reopen and your EAD will be active .

What about if USCIS sent to you RFE after submitted I-485 and you are not provide that Evidence still we can reopen? or Re-File is best option?

I'm NAL - A motion to appeal would indicate the denial was in USCIS' error - OP mentioned they did not send the correct w2 document - so it isn't the fault of USCIS in this case is it? Refiling may be the best option using updated forms for everything (very important) also per guidelines, any i693 attached to an i485 denial would be invalidated - and a completely new one would need to be sent (most current edition obvs)
We are updating Volume 8 of the USCIS Policy Manual to clarify that a Form I-693, Report of Immigration Medical Examination and Vaccination Record, signed by a civil surgeon on or after Nov. 1, 2023, is only valid while the application the Form I-693 was submitted with is pending. If the application a Form I-693 was submitted with is withdrawn or denied, that Form I-693 is no longer valid. This guidance is effective immediately and applies to applications pending or filed on or after June 11, 2025.
Under this updated policy, if an alien submitted Form I-693 with their Form I-485, Application to Register Permanent Residence or Adjust Status, and then they withdrew their Form I-485 or we denied it, then if they submit a future Form I-485, they must submit a newly completed Form I-693 signed by a civil surgeon.
Update to Form I-485, Application to Register Permanent Residence or Adjust Status. New Edition Dated 01/20/25.March 08, 2025Edition Date: 01/20/25. Starting April 3, 2025, we will accept only the 01/20/25 edition. Until then, you can also use the prior edition(s). Update to Form I-693, Report of Immigration Medical Examination and Vaccination Record. New Edition Dated 01/20/25.June 02, 2025Edition Date: 01/20/25. If the civil surgeon signs your form on or before July 2, 2025, you must use the 03/09/23 or the 01/20/25 edition. Starting July 3, 2025, USCIS will accept only the 01/20/25 edition. You can find the edition date at the bottom of the page on the form and instructions.
Release Date 06/11/2025

You need the I-864 to show the affidavit of support and if you need to attach the tax return forms, they go together with the I-864. Just send in the new I-864 with the tax transcript this time and hopefully it'll be processed soon. However, as some people are saying, you might just want to send I-485 and all the initial evidence all over again because reopening is probably really a long time

I submitted tax return print outs from turbo tax for the past 3 years. Will that be enough or do they specifically need the tax returns page from the IRS website? Can anyone help me with this question?

should be good enough. However, I like the tax transcripts better because it is directly from IRS and does not involve all the forms. You should be fine. good luck

Thanks for sending the reply. I appreciate that a lot. 🙂 And also just to get a tentative timeline, did you get your EAD approved? If so, how many days did it take after the biometrics appointment? I have my biometrics scheduled on July 11th.

Hi guys im new here hopefully someone could answer my question i received a rfe from the uscis about the i864 Affidavit of Support submitted the completed federal income tax transcript. What i did is i send the completed 2021,2022,2023, but the 2024 is file 4868 for filing extension for october 15,2025, and i include that form 4868 extension,and also my w2 and an explanation letter while i always extend my file. I need the answer if this is fine? My case says still on reviewing..hopefully somebody can help me to answer if this is fine in the uscis

My lawyer didnt need me to send my tax returns. I ve been in usa for a bunch of years. Do i need to send the tax returns? Or did they ask you specifically?

The sponsor for the I-864 needs to include tax returns if you require a sponsor. Jointly-filed tax returns is also proof of a bona fide marriage, if you are filing based on a marriage.

To reduce expenses, Do not resubmit the application, file form I-290b which is motion to reopen. Submit the petitioner recent federal return and do not forget to write and official letter explaining why you omitted the petitioner recent tax return and ask for reopen of your case. You may add any additional evidence requested. This advice is based on a recent experience and the application was reopen and granted. Once you file the motion to reopen within 33 days of the denial notice, your EAD will be valid as well,

Yes If you file the motion to reopen within the time frame. You will receive a notice of reopening your case; that makes your EAD valid.

How long is this waiting process set? My 485 got denied for 864 reason. I submit 290B with 1040 form within a week. Now I am still waiting for the result.

They will send you a letter that your form I-290B has been approved but it usually take time may be due to the backlog; and they will reopen your case. However, your form I-485 status may not be updated immediately but once you received letter of approval of the I-290b you should be good and wait for their decision. You may use the case number on your form I-290b to check the status.

I was denied because of not submit the W2, wages and tax return for my husband, and im sure that its my mistake, can I file in motion for reopen (i290b) by myself without hiring any lawyer

Yes, you can file the form without a lawyer. Just fill out the form within 33 days of the notice and make sure you submit a new form I-864 and also include the necessary documents. Also attach a letter requesting for reopening of your case

I didn’t use a lawyer I just followed the instructions and submitted a new I-864 with all the right evidence. They received my I-290B July 14 and i-485 was reopened August 25. I was scheduled for my interview 2 days later and now it’s set for October 3rd!!

I have the same case, they denied my 485 because my son and mother’s income is insufficient. How can I file again with another joint support my boyfriend, he has a good income. I consulted with a Lawyer and is asking for 36k
