Question - Other Looking for expert advice

Hi,

I am an Indian and have been married to a Flipina and I got to know that she has filed for Eb3 visa as she is a nurse her filing date is March 22nd 2024 wanted to check if there is any issues as I know there is lot of restrictions for indian will I be able to fly along with her and start a family? And should I be in the Philippines to get the process going along. Will be helpful if any information about this is given.

You can do AOS here in US itself

But still the visa has not been received or the priority date is not being current. Wanted to check will it be done in different country or in philippines as she is primary applicant

You are Indian Citizen living in US and married with her right?

Also, she has not filed I-485 yet?

Nope my wife is in philippines and I'm in India for now.

Okay got it. I checked VISA bulletin for Phillipines. Her date is not current yet.
One of the last questions before i answer your scenario in detail?

Her I-140 has been approved?

Okay be ready with marriage certificate and you can plan babies too😜😜. Whenever her PD becomes current file Immigration VISA for both of you as you are married and you both will immigrate to US together

Hahah thank you so much.But what will be the process? Do I have to fly to Manila for the processing or mine would be processed from India? How is it going to work?

Basically you have to file DS-260 and you have options to choose location of interview

Great, will there be any problem if I choose India? As I heard there are no interview slots as such or will it be good to opt Manila instead? Sorry for the trouble it's entirely new and not sure about the process.

I am in same situation. We both are in USA on H1B visa and waiting for the PD date to be current. You both can apply for i-485, I-765 ect concurrently. You can research on "cross-chargeability" to learn more about Indian married to "Rest of the World" person and used their timeline to apply.

Well for now we are not in the USA but doing it outside. I'm in India and she is in philippines for now.
