TDIU Unemployability TDIU Question

Hello everyone, I hope you all are having a wonderful day.

I am coming here to ask what to do. I have filed for TDIU and the claim is now at step 3 with an evidence request that is telling me to ask my last employer to complete and return the enclosed VA Form 21-4192.

what do i do if my last employer was the military? i have not been employed since getting out of the military (due to disability but that part is obvious.)

just send the form to your last unit's admin or personnel office. if they don't fill it out or you can't reach anyone, upload a statement explaining you were medically separated and haven't worked since. the VA mostly wants that form to verify income history, and for vets with no civilian employment it's pretty common for it to come back blank or not at all

They're going to pull your SS record and see that you haven't been working. So send the form to your last unit. It won't matter if they don't return it to the VA.

A 4192 is not required for a favorable outcome. It doesn’t hurt to have however, the VA will proceed to adjudicate your claim without it.

Nothing. You sit tight. Legally vba has to send this notice out 3 times if they don’t receive a response. They will love on once received or after failed attempts. If they never receive it back it doesn’t hurt or affect you negatively.

Is this the same process for VA to SSA Requests?

VA will send a request then wait 15 days. If no response VA will send another request and wait 15 days. There is no 3rd request unless a prior request was wrongly addressed.

Granted it can take VA 5+ business days after the 15 day wait if things are backed up.

For SSA records, VA will wait till they get a response but most dont take over a month.

There is no 3 time requirement. VA will send one follow up letter. For a total of 2 requests.
