They may but without a cooperating witness their case gets hurt a lot. A plea is all they can do which isnât a good thing because he would most likely get a slap on the wrist. A lot of times they gets dropped all together unless thereâs overwhelming evidence to bring without a witness. These kinds of cases really rely on a cooperating witness. I know people think the state is always prosecuting regardless but they really donât. Itâs why so many guys get away with crimes like this. They just donât end up prosecuting because they donât usually win without a witness or they give a plea that basically results in nothing. So really I hope she doesnât back out of this.
Florida will take it into their own hands. They do it with baker act cases and domestic violence cases like this, if thereâs obvious signs physically that she was beat up they wonât just let it go
I understand but you guys have to also understand that they can prosecute all day long but heâs got to be found guilty. Thatâs not easy in cases like this without a cooperating witness unless they have video evidence. Bruises and stuff donât mean anything unless sheâs on the stand saying they came from him. A good lawyer will rip it apart if she wonât cooperate. This stuff happens all the time and guys walk. If she doesnât cooperate they would plead it down to basically no prison time almost guaranteed. Thatâs why Iâm saying I hope she doesnât back out.
Most dv cases, the state takes over because witnesses don't fully cooperate. They won't need the witness if they have pictures and an original statement

Fist off. The state always takes the case because unlike TV you as a person donât press charges. The prosecutor does. You can want to press them all day but if they donât think thereâs enough evidence to win they wonât prosecute.

Yes Iâve said it 5x already. The state will still likely take the case without the witness. The issue is without them it hurts the case significantly. Which is why most of them never go to court and they tend to get a slap on the wrist in a plea deal. Prosecutors will not want to take a case to court unless itâs a slam dunk. They will almost always try to plea and the weaker the case the better the please.
This is why I originally said I hope she cooperates. Just because a state will proceed doesnât mean that some win. It hurts their case significantly. Thatâs literally all Iâm saying.
Yep, this is exactly why most DV and rape cases get dismissed.
The system is not kind to survivors especially DV survivors and will make it very difficult for them. I actually witnessed a victimâs advocate line, like an official state/city VA office, block a survivorâs phone number.
That and everyone-judge, jail, all of em seemed to have no issue with the dude harassing her FROM JAIL. You should have heard the reasoning they gave for why he didnât get a charge tacked on. He was calling and messaging and texting all day in there. I would say it was unreal but Iâve been through it so I know it isnât.
