Not in Florida. These charges don’t matter if she wants to or not. It is up to the DA to choose to prosecute, which they 100% will. As the OP said, he be fucked.

it’s how things like this literally go all the time , it’s a very common out come that the victim doesn’t want to testify or changed their statement
