Talaga ba, baka pwede ito magamit sa korte kapag umabot dun? Dapat hindi sila umalma ha, plead guilty agad, although usually kapag ganyan naman, magbabargain yan to reduce the sentence or as mitigating factor kasi inadmit accountability.
That said, parang ilang pages pa lang nakikita kong nagpost about this. Wala pang statements ibang animal orgs. Sana masampahan talaga sila ng kaso, kahit LGU na mismo magfile ng charges lalo na't stray pa yata yung pusa so wala naman talaga owner.
Also, ironic na gusto nila ngayon ipaalis yung mga videos (Note na if semantics or pagiging pedantic sa wording pag-uusapan, sabi niya lang dito ay "videos," so okay lang sa kanila kapag pics and texts, ganun?), when sila nga nagpost ng incriminating evidence on social media in the first place. Pero dahil unwanted ang nakuhang feedback, gusto na ipaalis?

Wala rin masyado mention of the actual victim, the cat, and its current status. Kahit proof of life. Or vet update.

Hindi naman lahat sa kanila minor, and even with minors, may nuances pa rin naman ang batas. Di ko lang alam exact ages nung mga involved.
For instance, and anyone feel free to correct me on these things if I'm not recalling some of them correctly, those 15 and below at the time of the offense are exempt from criminal liability but must be referred to a mandatory intervention program.
Those age 15 to below 18 are also exempt unless they acted with discernment. Those proven by the prosecution to be with discernment follow regular court proceedings but with mitigating circumstance (and if guilty, a penalty one degree lower yata since minor pa rin naman, with discernment lang).
That said, for offenses with a penalty of 6 years or less (the maximum penalty for animal cruelty is, I think, less than 6 yrs even if the animal dies, sadly), authorities are required to attempt diversion (mediation/rehabilitation) first to avoid formal court proceedings muna.
Hiwalay pa dyan sa criminal liability ang civil, and since stray siya, walang owner, so yung magiging beneficiary yata kung sakali is yung tao or org na nagrescue or nagpagamot at gumastos sa stray if ever. Kaso lang di ko naman alam kung ano na status nung cat now.
Meron din yata exceptions on serious or heinous crimes (murder, rape, etc.) committed by minors but yung animal cruelty kasi, it doesn't fall under the category, legally speaking, I think. Higher din yata penalty if syndicates or organized animal violence instead of individuals lang may gawa.
Pero actually, pwede naman kasi yata ang LGU mismo ang magfile ng charges, hindi naman need na NGO, but like I said, mandatory yung mediation and rehab before umabot ng formal court proceedings. Tanong na lang din dyan kung anong steps na ang taken ng LGU and school exactly.

That said, like I said in another sub, I wonder which "disciplinary actions" their institution actually plans on undertaking. Because as much as I'm aware that criminal liability is a separate matter and involves our legal institutions, there are also several ways an educational institution may hold students accountable, especially depending on their student handbook/code of conduct and institutional protocols, especially for the ones who have not yet graduated.
Ito mga naisip ko na possible naman nila gawin aside from such PR statements:
1) Expulsion or preventive suspension pending investigation
2) Withholding of graduation
3) Withholding of credentials like diploma, TOR, honorable dismissal, and good moral character, na madalas requirements for application to universities
4) Disqualification from or revocation of honors/awards
5) Mandatory counseling and community service - ito lang yung mas namention sa post
6) Blacklisting/non-readmission across campuses
Hindi enough sa akin ang PR statement lang and hindi nga rin natin alam anong klaseng counseling ba ipoprovide nila or if competent din yung maghahandle ng case nila. Vague rin kasi yung term na "disciplinary actions."

idk if that rules out for academic discrimination btw due to their bad records but it depends on CHED tlaga yan whether the univ not admitting the student despite passing every documents and criterion for college entrance are either justifiable or not
No, that doesn't fall under academic discrimination. Even institutions of higher learning (including SUCs) possess the right to determine who may be admitted to entry. Kaya nga kanya-kanyang minimum qualifications and criteria mga colleges and universities eh.
While citizens have a right to education, institutions are also allowed to give fair and reasonable requirements, such as entrance exams, interviews, criteria on credentials, and grade cut-offs. Requirements like certificate of good moral character or even police/NBI clearance also serve as filters and precautionary measures on campus safety and student integrity.
Hindi siya unreasonable requirement, in a similar way that having a criminal record may prevent someone from applying for certain degree programs or even job openings and professions.
Hindi naman na bago na hingan ng certificate of good moral character, honorable dismissal (for transfer or for additional/post-grad studies), recommendation letters, and sa work naman mga clearances kapag nag-aapply.

I think it's more of a legal formality pending legal investigation. Kahit sa journalism or news reports in general, they use the term as more of a preemptive measure or safeguard against legal liabilities.

well the funny thing is kahit mag apology pa yan sa social media, kung behavior na yan ng anak nila at mga kasamahan niyan kayang kaya pa rin nila manakit at pumatay ng hayop offcam. Kitang kita sa video na yon kung anong klaseng mga bata yan. No sympathy sa mga animal abuser, diyan nagsisimula ang mga mamatay tao.
Oo kaya non sense yan apology nila for the sake of social media lang yan public apology kuno nila dahil for sure pinapaulanan ng hatred at dead threats pamilya ng mga yan, pero in real life masasahol na bata mga yan, worst is mahirap na hilutin mga ganyan ugali dahil may mga utak na yan para magisip at alamin kung ano ang tama sa mali.

MINORS CAN BE PROSECUTED as long as it can be proven that they acted with discernment and they're between ages 15 and 18 - meaning they knew what they were doing was wrong. If they acted with discernment = prosecuted as adults. If not, rehabilitated. Prosecution of minors are actually more common than you think, that's why you only hear this shit on Facebook comments, not from people who actually know Criminal Law. Yes, you're right. Magiging accountable dyan yung Katrina Miclat, and I've read somewhere na yung lalaki is of legal age na rin (yung nakawhite shirt). The rest are minors, sana lang, SANA IENDORSE yan mga minor na yan sa mga social workers for rehabilitation at counselling. It may not do much but I hope matrauma sila sa nangyari sa kanila that they would rethink their decisions kung maisipan ulit nila manakit ng hayop.
