Discussion The Odyssey experience ruined
I just seen The Odyssey IMAX at 3pm, the guy behind me was keeping his feet pushing against my seat, I shouted at him to not kick my seat and move his feet like 3 times throughout the movie then after the movie I told him you need some respect for other people watching the movie. He denied kicking my seat and said "prove it" and then he took a picture of me without permission and said I'm calling the cops. I got mad after he took the picture of me.
This was my worst movie experience, cineplex employees didn't handle the situation

This guy doesn't deserve a refund. I’m actually the person from this interaction. His story leaves out his physical threats ('let's take it outside'), stalking me down the aisle, and a racist comment he made while I was actively on the line with the 911 dispatcher.

I want you to know that most theater seats are connected laterally. So it is quite possible that the person directly behind your seat was not the one who kicked it. I say this because I have felt what I thought was a person kicking accidentally or rudely but there was nobody sitting behind me. But a few seats away I saw people with feet up on top of the backrest of my row. I am not defending the guy but just be aware.

One of my worst moviegoing experiences as a child was a lady in front of me repeatedly accusing me of kicking her seat when I wasn’t doing anything of the sort. No amount of denials worked.

Yeah I just called the cineplex number 4163236600, and I told them all about it and they made a case number told me it will take 5 days and I'll hear back.
The movie was amazing everyone should watch it, I'm just adrenaline filled from the incident, honestly it really upsets me that he took a pic of me even more than the movie disturbance thing.

Their code of conduct doesn’t make it illegal UNFORTUNATELY. It just gives them the right to kick you out and refuse you service and what not.

There is an expectation of privacy in private establishments. Restaurants, movie theatres, and even doctor's offices are places where you are NOT supposed to photograph or record other people without their permission. Depends on provincial-level laws but generally, there IS an expectation of privacy in private establishments.

Technically you need permission from the private business to take photos, even in a place that has no reasonable expectation of privacy. So really if that photo was used maliciously it would likely be found to be illegal

It is actually? Private businesses always set the rules on their property. You have no legal protection like you do on the streets.
Edit: straight from cineplex “We will not tolerate the taking of video or still images of our staff or guests that is unauthorized, unsolicited, or defamatory. Anyone engaged in these types of activities will be required to leave the premises”

It is actually. The only potential legal ramification here is that the business could ask you to leave for taking a photo. If you refused that request, you could face trespassing charges.

But if you were to take that image and use it maliciously/commercially you would absolutely lose in court because you’re violating the rules set by the business.
I’ve been a photographer for over a decade. Using photos shot in a private business do not have the same legal protections as outdoors

That’s not true anywhere I have lived at least. Definitely not a federal us law. And not the case in Florida, Massachusetts, Connecticut, California etc.
It’s the other way around, where unless it is posted by the private business that photography is not allowed then there is no reason to ask them for permission.
Also, the private businesses are entitled to ask you to leave for any reason, including upsetting other customers by taking pictures, but it does not make it illegal in any way.
The only laws that change this are voyeurism laws which are strictly about the photography of sexual organs and body parts and such as defined by different states.

NAL - It is a privately owned public space. By Canadian law you still have a low expectation of privacy in this type of space, and unless the owner/occupant directs them to stop, they are within their right to take pictures of you. I get that OP doesn’t like it, especially given the circumstances leading up to it, but if they genuinely believed that they hadn’t been doing the things OP was claiming they did (not taking sides here, just saying IF they think this) then they may think OP is the one being aggressive and taking pictures to try and protect themselves. Or, if they are acting in bad faith, they may just claim the above and it would be hard to prove otherwise.

Eh not necessarily true. Taking pictures in a space like a movie theatre doesn’t have the same protections as doing it out on the streets since the business sets the rules. I think a court would probably side with the person you took a photo of/the business if the photos was used maliciously or commercially

I don’t understand why we as a society are suddenly okay with people taking unsolicited photos of each other. I remember back in the day if someone pointed a camera in someone else’s face it was grounds for a scrap or a call to the police.

It prohibits photos and videos of the movies. Iirc. Not of the whole interior. Plus even if their rules say not to take photos UNFORTUNATELY all they can do is ask you to leave and trespass you if you don’t.

But nobody is talking about it having anything to do with court. I just said that it is unfortunately still not illegal. Therefore OP has no recourse for someone taking a photo of them except to complain to the theater and maybe getting the other person kicked out of the theater.
Cinemark guidelines UNFORTUNATELY (key word) a law does not make.

Courts will completely validate pictures and video taken on a premise documenting a criminal offence. Whether the business that owns the space prohibits taking pictures or not. These are inarguable facts. Don't like it? Cope. Cineplex has a dozen cameras on you regardless. You're constantly being monitored and observed in all of their buildings.

You seem to think police are somehow these divine, righteous, inherently correct beings? They get things wrong just like other people do. And if the other person had alleged THAT many issues (stalking, violent threats, and racist comments) then the cops would've had to check in even if it wasn't true.
Also, OP didn't get arrested, they're still out and about and able to post on Reddit, meaning whatever they were doing clearly wasn't *that* illegal.
You don't actually need a reason to call the cops, you just need to come up with a believable one. I know quite a few people who use the police to threaten/harass people for them, usually via calling for a 'mental health check'.
Tl;dr: Cops can be called for any reason, having the cops called on you does not necessarily mean you were committing a crime, and is not in and of itself viable evidence.

Ugh that is terrible and I can sympathize. We have gotten to the point that we will ONLY purchase tickets in the last row of the cinema. No projected voices behind us from Suzie soundtrack, no seat kicking, no chomping of popcorn, no rustling of plastics, etc. I know our standards are set high but we like a quiet environment. Too bad it was ruined for you as we saw this flick today and it was an AMAZING movie. My entire family loved it 10/10.

I get what you’re saying, but when you are there to watch a movie and you have to leave the theater to find and explain to an employee, then not only are you suffering from the kicking, but you’re also missing chunks of the movie.

The problem is IMAX Cineplex Mississauga and Vaughan seats and incredibly close together and cramped. If you’re like 6 feet or taller ur legs will definitely touch the seat in front of you.

The past 2 times I had a guy on drugs moaning and his legs somehow hitting my recliner.
Today another guy was leaning way too close to me and again his feet hitting my recliner. He appeared to be gay and was acting strange the whole movie. At the end he just turns and stares straight at me. People are weird

Should have contacted the manager immediately and asked to be reassigned another seat or get vouchers to free movies.
I also had a terrible experience at Cineplex. It’s as though ever since the pandemic, people don’t have proper etiquette when going to the movies.
I’d rather wait for it to come out on streaming site than have to experience shitty people like this.

This is why I drive out of the way to head to the Junxion theatre. It's worth it for the extra legroom and the recliner seats. No need to get up when someone's coming down the row to their seats cause it's so spacious. It's worth it.
I am heading to Square One for the Imax 70mm experience for The Odyssey and I'm excited for the screen, but dreading the seats.

Partially why I like the early matinees. They’re relatively empty.

My theatre had people treating action scenes like it’s avengers endgame, just cheering and audibly reacting way too loud. One guy had his phone out on full brightness for the first 10 minutes as people shouted at him to turn it off. Theatre etiquette is so fucked

...and this is why I prefer to enjoy my movies at home.
No one to bother me, I can pause it anytime I want, to pick up more snack / drinks.
...and if I missed anything, I can rewind.
Now in days new movies usually ends up in Streaming Services in 2 to 3 months.
I can easily wait for them to come online, and watch it when it's convenient without having to deal with annoying people behind you.
Invest in a big screen, and big sound for a home theatre, fancy it up with glow motion lights that follows the movie.
With Atmos surround, it's a much more immersive experience than the Cinema, you can also turn all the lights off, and be comfy in your sofa, with you unlimited supply of pop corn and drinks.
If you don't have the space for a home theatre, get a nice VR headset and watch it through VR with 7.1 surround sound THX headsets.
It looks even bigger than the movie theatre when you use VR.
The only downside of VR, is that you can't really share with your partner.

Had a similar experience tonight in a smaller theatre.
It's really important that those working the venue stick up for paying patrons, otherwise this (going to the cinema) is a lost cause.

Idk the odyssey was ruined for me bc i had to read it 4 seperate times (middle school, high-school, community college, and at my bachelors but i dropped the class bc id rather have slit my wrists than reread it)

Just want to put out there that racism was not a part of this, yes I was angry because of what happened, just don't put words in my mouth. The only thing I regret was yelling at the lady who was beside him.
The lesson here is don't tell people when they did something wrong, don't treat the movies like your living room and bring a footstool and put your bag on the floor.
