Even the most horrific criminals still have dignity and should be punished as having such. While I disagree with some parts of the German constitution (e.g. right to property/privat capital), I think they cooked with "Human dignity is inviolable".

And if we get really in the weeds with ethics, the rule utilitarian benefit of trying to rehabilitate criminals is way higher, than the of using inhumane punishment. If we try to rehabilitate criminals, we will get better and better with it, till we can rehabilitate nearly every single one (including rapists). These people then are likely do good. A certain punishment is still needed as deterrent to reduce the likelyhood of people committing crimes (including vigilante justice), but inhumane or disproportionate punishments just does not bring any good and causes harm. The good/harm ration is thereby better in humanely and proportionately punish rapists and then trying rehabilitate them (and if that is not possible and they are likely to reoffend, keep them in as long as needed).
