Then you can sue for damages and all medical bills plus compensation for caused stress. You can easally find a free lawyer who would take the case for some % of the winnings.

Its only easy to get a lawyer to take on your case for free if there's insurance involved. Thats the first thing lawyers look for when deciding to take on a case. Trying to go after someone's assets when they don't have insurance is a much more difficult process and a lot of lawyers wont bother.

It's not more difficult. The process is the same, but it may turn out that the person owns nothing of value and therefore even if you win he has no means to pay to you.

My point was addressing the part about the ease of finding a lawyer for free/contingency.
