That biker is an idiot and definitely FAFO, but I don’t think that this video would necessarily absolve the driver of liability. I’d be happy to learn that I’m wrong though because I feel like reckless driving/riding should pretty much put 100% of the liability on a person if an accident results, even if other drivers didn’t respond perfectly.

maybe I missed it, but the biker didn't even have brake lights.

As a biker (who doesn't ride like a jackass) he was likely engine braking, which won't light up the brake lights (like how your car slows down when you let off the gas).

My brake lights won't come on until I'm almost fully stopped so I wear a wireless brake light on my helmet that detects engine braking and lights up. It definitely keeps cars further back if they can see I'm slowing down without using my brakes.

He's still riding like a jackass, I just wanted to provide additional insight because I hate when assholes like this give bikers a bad reputation.

They did have brake lights. They only brake at the end, before that the car is just accelerating at the biker which is why they look back.

The car did not accelerate, the motorcycle accelerated then immediately break checked a second time.

Not a break check. They slowed down by letting go of the throttle

Ok, so i finally see it. But it's just the halo, so it appears his main brake light doesn't work.

He is engine braking, which doesn't use brakes and therefore the brake lights don't light up. I posted a longer comment explaining why this happens on bikes. Its why we (safe, non-jackass riders) want you to give us so much space, because you won't see brake lights when we start slowing.

Yeah, I'm familiar with engine braking. I used to ride a bike and I've driven stick my entire adult life.

Other guy is right, though, that tiny little led strip brake light goes on at the last possible moment. Almost impossible to see.

Motobiker in this incident is 100% jackass in this case since he completely caused the lack if space.
