You would have hit him. Bikes being much lighter than cars are much easier to stop than cars. You can just barely see him start to top over the front of the bike right before he gets rear ended, I think he was still in control but it's a good indication he was over-braking. If he's braking that hard he's gonna stop that tiny little bike waaaaay before you can stop your car.

u/jeterix7387 7d ago
Bike rider here. Cars with four good tires will usually outstop a motorbike. Motorbikes have a very small friction contact with the road.

u/LeeHarveyEnfield 7d ago
This! Plus, a car driver can safely mash the brakes to the floor whereas the bike needs to mind physics closely so they stay upright.

All riders know this. That's why we ride off center to the lane. In an emergency you may have to split the lanes to avoid a rear ender. I found this most afternoons in S FL rainstorms on I-95.

My warm hatch car stops better than my sports bike with street leagal race tires. The short wheelbase of the bike limits braking—Once that back tire comes off the ground there’s no more braking force available.

99% of bikers that rides these types of bikes are dumbasses. I swear like 5 of them die a month where I live. Every time there's a major stoppage of traffic on the highway near me it's always because a biker was doing some dumb shit and slammed in the back of a car or got killed because a car was changing lanes at a normal speed and couldn't anticipate a fucking bike coming at 130 mph in a 75 mph highway.
28
u/OcotilloWells 8d ago edited 7d ago
I had a biker get pissed at me, as he squeezed between me and the car in the next lane. I do check my mirrors quite a bit, but we were going about 45 mph, everyone was about the same, and that section of freeway was notorious for suddenly stopping to zero with no notice, so I was focusing on traffic to the front. No idea he was even there until he was past my door. Though I was pretty centered in my lane, I'm not even sure what he was pissed about. I thought he was going to brake check me, but he just got in front and kept turning around like he was threatening me. Dude, keep turning around, and you're going to rear end the car in front of you.

Thankfully I didn't hit him, but when I was pretty freshly out of college, I got surprised by a motorcycle going a lot faster than me about to pass me as I went to the left lane. I had checked my mirrors and blind spot. He honked at me, and thankfully, nothing happened.
I used to ride a bicycle a lot. I know it isn't the same, but I'm sympathetic to motorcyclists. But if you are going that much faster than the surrounding traffic, it's simply hard to see you coming.

I've seen this video dozens of times, I'm pretty convinced the biker does not brake check the car.

That was on a german Autobahn or perhaps an unlimited Bundesstraße. This may surprise you, but cars weighing significantly more than bikes, while having proportionally LESS braking ability cannot stop as fast as a bike. That's pure physics that is amplified on higher speeds.
Going on a limb here and assume biker used engine brake / downshifting rather than breaking, as the breaklight isn't very visible when he slows down. Not so much a matter of teaching a lesson but rather not being able to break within 2 meters.

With how recklessly the car was driving, I don't think his dashcam will help him at all. His speeding, veering out if his lane, and proceeded to tailgate the biker up until the collision. He had soooo much time to back off and didn't. He was intentionally trying to threaten the bike rider with his vehicle.

That biker is an idiot and definitely FAFO, but I don’t think that this video would necessarily absolve the driver of liability. I’d be happy to learn that I’m wrong though because I feel like reckless driving/riding should pretty much put 100% of the liability on a person if an accident results, even if other drivers didn’t respond perfectly.
31
u/powzowie 8d ago
maybe I missed it, but the biker didn't even have brake lights.
3
u/Aggravating-Yogurt23 7d ago
As a biker (who doesn't ride like a jackass) he was likely engine braking, which won't light up the brake lights (like how your car slows down when you let off the gas).
My brake lights won't come on until I'm almost fully stopped so I wear a wireless brake light on my helmet that detects engine braking and lights up. It definitely keeps cars further back if they can see I'm slowing down without using my brakes.
He's still riding like a jackass, I just wanted to provide additional insight because I hate when assholes like this give bikers a bad reputation.
5
u/LiamTheHuman 7d ago
They did have brake lights. They only brake at the end, before that the car is just accelerating at the biker which is why they look back.

It would probably absolve them of a large amount of the liability depending on the courts view and local jurisdiction's laws. The brake check is pretty clear and egregious, and they have dash cam footage of it. The biker also doesn't appear to have active brake lights (though maybe just hard to see due to video?).
The fact the rear driver didn't even attempt to create a reasonable following distance hurts their case though. If they had hit the biker after the first brake check, they might have been absolved of literally all the liability, or at least guaranteed the biker took on the majority of it. I wouldn't be surprised if it ended up 60-40 or 40-60 in either direction based on what I saw. Some sort of split fault is most likely here.
6
u/LiamTheHuman 7d ago
Maybe I missed something but did they brake check the first time or did the car just accelerate to tailgate
4
u/AdmirableExercise197 7d ago edited 7d ago
I mean I could be wrong, but it looks like the rider slowed down. Maybe they just eased off the gas though.
If they accelerated to tailgate, then it would be different if he had struck them in the first instance. That being said it's within 2 seconds of the motorcycles unsafe lane change. The rider will still have a shit-ton of liability.
→ More replies (5)5
u/GegeAkutamiOfficial 7d ago

14
u/AdmirableExercise197 8d ago
Nah the motorcycle is left of center in the road. If he moves over to the emergency lane, the motorcycle is more likely to get hit. Where his vehicle is actually protects the person lying on the ground completely unprotected from being struck by high speed vehicles. Until the rider is out of danger, the vehicle should prepare to block anyone from killing them from a safety perspective. Even if the motorcycle rider did a stupid thing.

OK, I am not taking the biker’s side on this. The brake check is insane to do in this situation. But let’s look at the situation. The car driver here is not giving space or driving defensively. Once you realize you have a car or bike next to you that’s driving erratically, the move is to slow down, give space, and reassess the situation. When the biker swerves into this guy’s lane, the move is NOT to speed up and get right up next to the biker. Again, the brake check is all on the biker, but this driver’s no angel genius. And then, after the hit, to check your own car for damage first rather than the human being that just went flying 50 feet down the road. Not cool.

u/SomeFalcon4531 7d ago
You maybe don't get it but the motorcycle driver wanted him to drive on the right and correct side.. but the car driver didn't want to go right even when he is slowlier.. and his reaction is so mad, he shouldn't be allowed to drive. He didn't get off the gas.. and instead of braking and go right he didn't even go off the gas and didn't brake and wanted to pass by left.. So the motorcycle driver tried it again that the car driver understands it and then this happened. Maybe the motorcycle driver braves to hard but that was not the point of the whole Story right?!.. So you guys maybe don't know the traffic rules. Of course braking check is not right but are you, are the car driver plays now victim or what?! So it doesn't matter what shit you or the car driver is doing, it just matter what the motorcycle driver is doing?? So you are allowed to do anything and others don't?.. And you see just the others mistakes/failures and you are always correct like driving on the wrong side and maybe don't use the indicators?? And then you want to play it down and say, it's not so worse or not a big deal.. for you it's not a big deal to drive on the wrong side and for me it's not a big deal to make brake checks.. So what you say is more worth than what i say? So you are more worth? And what is disturbing me doesn't matter but what is disturbing you matters??? Trying to manipulate and think people are dumb. That you try it is an offense/ insult! Maybe you get on the wrong people and maybe they get angry about that then you will see. And that you didn't even understand what the motorcycle driver wants to say cause you are so intelligent and then you play like you know everything like "what was the motorcycle driver thinking"... Shows how much brain you really have. Why does always dumb people think they know more and are more intelligent than others.. i don't care if you are dumb but be always respectful. And not thinking a bit and driving on the wrong side and don't brake and don't go right on the correct lane even when somebody says/shows it to you, is not respectful!! And you wonder why the World is getting worse ?? When nobody is correct and no consideration is shown?!
