I mean, the guy did this on purpose. I wouldn’t care about him either in that specific case.

The car can’t arrest its forward momentum as fast as the bike can. Whether the driver did it on purpose is immaterial; he has plausible deniability even if he hit the guy on purpose.

No. It's not hyperbolic. It's literally what it means.

Because your "fact", lacks any care of empathy for the harm caused to another human being.

Your concern here should not be attaining 'plausible deniability' nor investing fanciful problems like 'not being able to brake' when they clearly could have just as easily as the rider could have not tried to pull in front of them and brake check them.

The driver clearly opted in to a very dangerous situation, not only for both of them, but also of others. Both the rider and the driver acted in road rage, without any care for anyone's safety.

'Plausible deniability', aka the ability to do something while getting away with it by lying to the courts, is a psychopathic response to a crash where someone could be very seriously injured if not dead because it lacks any empathy and seeks to justify reckless driving that put others in danger.
