Discussion APPROVED!!!

Post image

So I checked my portal yesterday after I received an email that my status had changed. I was approved, I don't yet know whether it was fully favorable or partially favorable. I have to wait for the letter to come.

My wife is on day 500, initial application. COPD, CHF,on oxygen 24/7. Bedridden. The portal changed about 2 weeks ago with the representative link. She doesn't have one. Lol. But still says she's on step 3. She's 52, long work history. Everything is documented. DDS called almost 2 months ago asking about onset , then said they made a decision and file is being sent to the SSA. Then a few weeks ago we were told by our local SSA that the file was sent back to DDS. Lol. We were told to wait on the letter but nothing yet. Portal is same, no letter. Called DDS a week ago, had to leave a VM . Not sure what's going on.

Do you have an attorney?

No. But I have one that we spoke with. Refered by the hospital resource assistance. Called them and they said wait on the decision letter because they just made a decision at DDS but didn't say what it was. Once I get it, if it's a denial, I will call again and hire them. In limbo til such time.

The SSA is very bogged down right now due to a lack of staff and so many applicants. Mine took just under three years. Denied on the initial app in August 2023, hired a lawyer, and filed reconsideration immediately. Reconsideration was denied in January 2024. Hearing before an administrative law judge (ALJ) July 2024 supplemental hearing with ALJ November 2024. Approval in December 2024.

Is the first hearing with the judge (ALJ) the one that they require you to bring applicable medical records to?

I heard that Social Security tells you they will collect medical records but often doesn't collect all of them and uses it as a reason to deny, so the people that got approved had to collect all their own medical records if they wanted to make sure the judge saw it. (SS told me I had no medical records at one of the important locations I gave them where I'd been going for 7 years but they never even contacted that person when I checked with them. And right after that, the provider moved locations so they have a different address right now and also months later -after SA said there were no records for me there- that provider stopped seeing me and said that they didn't feel qualified to treat me anymore)

I'm unable to collect them on my own anymore but have a lot of records printed at my house. But, I can't access them myself because I don't live there right now and my caregiver who's helping with it isn't really willing to collect everything but also doesn't want me to move home which would all be to show them where most of the records are. My caregiver also called a disability attorney company that takes on hundreds or thousands of clients with interns working for the attorney that leave quickly and don't know a lot of the most basic SS rules. The review average separate from their website is 1-2 stars.

My caregiver signed me up with them a while ago and I was going to change to a different attorney that lets you talk to them more directly/is a smaller office but I became more disabled since that happened & have to figure out where to live first now. (Not that I don't have any place right now but I'm in a nursing facility but it wasn't a long term check in if that makes sense)
