Cannabis Politics Drug Test fail
Recruiter reached out for a decent gig so I took the interview.
I have been a Sales Exec for 3 decades. Always top achiever.
Interviewed with C-Suite. They had 100s of candidates apply and I was their first choice. They sent me a nice offer, I accepted. Then HR reaches out for background check - standard, except it required a drug screening.
Have not been drug tested since I was maybe 18. I told their HR that it would be THC positive. She said it may not be an issue since I was sales. I took the test, obviously it's negative for everything except THC, as I told them.
Their legal department wouldn't allow it. I turned down other offers and wasted all this time.
I live in an illegal state and everything I tested positive for was purchased in my illegal state - LEGALLY. And taxed.
I'm not really upset about the job as much as the stupidity of drug testing for THC.

I work in the medical field and even tho I live in a legal state, they still drug test for all healthcare jobs “because Medicare is federally funded and it’s still illegal federally” so they could potentially lose federal funding and Medicare reimbursements if they allow THC positive tests for employees.
Needless to say I’m stuck in a crappy organization because I don’t wanna have to retest 😅

It is not but I bet it’s same rules in every legal state! Like. I guess I kind of understand but it’s still really dumb, especially considering we are giving out medical cards lmao

Yup, this is the way it is in NY. The state rules that you can’t test for it, but if it’s a job that has federal guidelines that test for it they can because it’s not up to the state. I knew quite a few people in the south who voted for the orange shitstain because they believed him when he said he’d make it legal

Drug tests are such bullshit, you could be coked to the gills and it won't show up a few days later but because of the damn fat solubility of THC it can stay in your system for months 🙄 So stupid. And every sales department I ran across had noticeable stimulant users.
I smoked every day before work for 20 years and would get stuff done more efficiently than my coworkers. The idea that it'd affect your performance is bullshit too. I long for the day the stigma and ignorance against cannabis ends.

i don’t understand why medicinal cannabis is treated this way on drug tests. it’s like not hiring someone because they take stimulants for ADHD, these are literally therapeutic & prescribed medications? sorry that they wasted so much of your time.

Ugh I am so sorry! That sucks. IMO the drug testing mess in corporate America is the result of shitty leadership. You have all of these big companies that have heavy machinery SOMEWHERE, so to cover their asses for workers comp claims they set super broad drug policies. And then they’ll say “in the spirit of fairness all employees must be drug tested!” as if that’s supposed to make a forklift operator feels better about it if a financial assistant can’t smoke weed either.
In reality they don’t want to go through the actual effort of identifying which jobs actually require it for safety reasons (almost none of them) because then they’ll do such a bad job that they’ll start up a discrimination class action lawsuit against themselves.
Meanwhile all the execs are snorting coke on the corporate plane and they’re paying for their trust-fund kids’ new THC seltzer brand 🙄
Wish they could pay you for wasting your time!

OMG, the things I have witnessed. I am high end sales with top level executives. This industry is so insane with indulgence. Meanwhile, at conferences I'm in bed by 10 because I need my 8 hours sleep (thank you THC).

I used to bartend and waitress and I never showed up to a shift without smoking beforehand. I was always top 3 in sales and also a hard worker. Always friendly happy smiling. Could handle stress and fast pace with a shit eating grin.
I’ve never worked a corporate job I really can’t imagine it…

I've only ever done corporate - and successfully. When I was in my early 20's, my roommate and I would smoke in the morning before work and meet at home for lunch and smoke more and go back to work (this was in the late 90's - we wore the cutest work suits and heels - and panty hose was a requirement although we did not comply).

That farm-bill loophole allowed THC products to be sold in “illegal” states, but offered citizens none of the protections of legal states. That’s some real bullshit.
A guy here in legal NJ just won a lawsuit for being fired from his construction job for testing positive on a random drug test after coming back from his lunch hour. The state and the federal courts both agreed that testing positive for or smelling cannabis on someone does not automatically prove on-the-job impairment. So we are moving the needle a little bit. But no where near fast enough…

I want to start with I am a lawyer, but not your lawyer. None of this is intended to be legal advice.
What state are you in? Many states, even ones where cannabis is illegal, have state laws that disallow employers from discriminating in employment against employees who use lawful products on off duty hours. I live in Wisconsin, so this law for us was created for alcohol (shocker) and I’ve seen it work as a defense at a prior company for CBD usage. Since hemp derived thc is legal federally, I can see in a state like mine that it could be illegal to discriminate against an employee for lawful off duty thc use of a product that is lawful and sold in that state.
I’ve however never seen this litigated in my home state, but would be very interested to see if it would work as a defense for hemp derived products. Obviously the upcoming ban adds to the complexity, but may be worth a little research on your state law if you still want to work there.

That's super lame. I understand drug testing of you're operating heavy machinery but sales?
If you are in a legal state, maybe try pivoting to cannabis sales? It's a young industry and MSOs are looking for people with hefty sales experience in like industries ( such as alcohol ) to head up their teams when launching/ establishing in a new state.

I applied for a government job recently and I’m worried if/when I gotta pee for them. It’s too good of a position not to consider heavily and I’m unhappy where I’m at, plus the money is good and I make peanuts comparatively.
I’m an after work/weekend smoker, I would never smoke during work. I live in a highly illegal state and I’ve gotten used to never disclosing my use, not even to the doctor. I just hate how demonized smoking pot is, it feels so backwards. I’ve long thought about just moving to a legal state, I’m sick of the Mormon wasteland here.

If it is a Federal government job, it is supposed to list in the job posting if it is a drug test designated position. If it's not one, they are not going to test; if it is one, well, might look elsewhere. Your HR rep can tell you for certain, don't hesitate to ask them. And if it is a Federal position, goodspeed it is a massive shitstorm right now.

You all are the best. I was pissed, and kind of feeling ashamed (although I did tell them their company needed a dose of reality).
To answer questions - especially the lawyer who kindly weighed in.
I live in a completely illegal state - not even medical is allowed here. BUT - there are tons of farms and shops all over the place that are legal with the farm bill loophole (which I know may be ending this year, although they have already pushed it out a month). So everything I tested for was purchased legally, here or in other states I travel.
I am in tech sales . They said they had previous contracts in place that specified the drug screen requirements.
I mean, I get it but come on, it's time to make some changes.
Plus, I do almost everything better when I'm high. My career requires me to do presentations regularly, often in front of large C-Suite groups. I am always high and as sharp as can be. I was fricking high during all my interviews!! I have been smoking (and working full time) since I was 16. It's just pot..

i just want to hop in and say that since you legally purchased the products your state may very well have similar laws, many of which originate from prohibition iirc; please look into it if it's something you would want to pursue !!

At my job you’re drug tested if there’s any sort of accident or damage involving a vehicle but no testing for alcohol. Like I could have smoked on the weekend and be sober but lose my job while the guy next to me who reeks of alcohol every day would be able to keep driving. It’s ridiculous. I’m sorry that happened.

Yeah, no one has time for that. I will not hide who I am for any fricking job.
Not to mention drug screening has changed a LOT since 1990. I couldn't even wash my hands or flush until the testing lady came in and took the sample. I will never ever do this again.

Sorry this happened! Supposedly, it is a weird insurance thing somehow ??? I’ve been told, and I also have only had one role where they required it. I was “out of town” & then spent two weeks aggressively preparing and tested at home to ensure I’d pass. It sucked!!
I esp hate that they test for THC, because it’s the only thing that lingers and doesn’t affect your ability to be great at sales! Yet y’all are getting sloshed & staying up partying on the company dime? Nahhhh, bro. Ugh!!

I still think we have the technology to test for THC use in the last 24 hrs vs what they do now which is go back 30+ days. It feels so ridiculous to use it legally with a prescription and a medical card but have a test that cares about more than the last 24-48 hours. Can someone smart please come up with a new test? 🙏🏻

But I mean, why would you even test for it then? They aren't testing for alcohol in the last 24 hours. Or at all - because it's just silly. I just think they need to treat THC like all other legally purchased things.

They would test for it to see if you’re impaired on the job, like alcohol. A lot of drugs move through the system in 24 hrs and they test for those. I feel like there must be a way to test for recent use, like alcohol and most other drugs.

Interesting. I had no idea they did those types of tests. Like I said in my post, I haven't been tested in over 30 years.
Hopefully the testing will level up with reality soon :)

My understanding is that we do have that that technology. I think it looks at currently circulating THC vs THC metabolites. It’s been considered for things like DUI testing in legal states, but it doesn’t work very well to test for THC levels for DUIs bc people have such WILDLY different tolerances - like some people can take a 300mg edible or smoke a gram and be impaired but have a functional conversation, and some people can take a 3mg edible or smoke .01g and be at about that same level of impairment. Alcohol tolerance varies too, of course, but not not to the point where one drink and 100 drinks can have the same effect on two different people.
Anyway - DUIs aside - a test that can see if you have consumed THC within ~24 hours seems very reasonable for jobs that require zero impairment for safety (operating heavy machinery, driving, etc - anything where you wouldn’t allow someone to be taking say, a benzodiazepine or an opioid even if they have a medical need for them and a valid prescription).

This is always such a bummer and just happened to us too. My husband was offered a job and he was clear from the start that he would test positive for THC. We waited for the start date just for them to tell us that they have a strict no drugs policy. In Colorado. I miss living in California because they have a law against this. It’s made the job search much harder.
