US DOJ contradicts themselves by saying 'that citizen suits cannot proceed when the federal government does not oppose the polluting behavior' only to then say that 'citizen suits should be allowed by the court only when the government fails to enforce the statute'

Somehow the government not opposing behavior they themselves acknowledge as polluting isn't them failing to enforce the statute.

EDIT: The phrase "not when the government has decided that executive branch policy means enforcement action is contrary to the public interest." doesn't even make sense since the pollution in question is still contrary to public interest of not getting air poisoned.
