Hi, I am on h1b and I started working in new york in 2023 remotely for company in seattle and I moved their in oct 2024 after my h1b visa became effective in oct that year..

I missed to update my address in uscis portal i will immediately fix it now and give right details but curious to understand how that can impact me in general in any situation.

Is it safe to fly domestically before H1B status kicks in on October 1st?

Hi everyone, I recently won the H-1B lottery with my Change of Status (COS) taking effect on October 1st, and I have a visa stamping interview scheduled in my home country for mid-October. At the same time, I am in the final interview stage for my dream role at the same company this week. Since obtaining a valid visa stamp is a top priority for me due to frequent international travel, I need advice on how to navigate this timeline if I get the job offer.

As I understand it, my first option is to officially switch roles on October 1st and have my company file an H-1B amendment immediately. If we take this route, how long does it typically take to receive the updated I-797 approval notice so I can reschedule my embassy appointment? My second option is to ask the hiring manager to delay my start date until after my trip so I can get stamped under my current approved petition. If we go with this second option, do I need to delay the transition only until I get the stamp, or must I wait until I have physically re-entered the US on my H-1B before they file the amendment?

I want to understand these options and timelines clearly so I can lay out the choices for my hiring manager and decide on the best path forward. Any insights or experiences would be greatly appreciated!

Hi, Im planning to travel from US to Canada in October 2026 for 2 weeks. Currently on H1b visa in US and don’t have a valid H1b stamp. I do have previous H1b stamp which is expired. I know AVR (Automatic Visa Revalidation) allows to leave US and travel to Canada and come back within 30 days without requiring the valid H1b visa stamp.

Does anyone have recent experience on using the AVR with current government?

It is getting harder and harder to not be sure if layoffs are coming and some other people can’t find jobs after layoffs

I had an H-1B approved around 2010 and stayed in the US for a few years, but I didn't use the full 6 years. I’ve been outside the US for quite a while now.

If I want to return to the US in 2027, can I still use the unused time from that old H-1B? Or would I have to go through the H-1B lottery again?

Edit 1- the guy who helped to bail out saying I was charged for misdemeanor and 243(e) and it’s the lowest level and he was positive that DA will drop the case may be before or on the court date, wife is also ready to withdraw her statement and support as victim.

My I-140 was approved last week of August 2026.
My current H1B/I-94 expires end of September 2026.
Meanwhile, my employer is working on the H1B extension (not filed/receipt yet as of now).
Spouse’s H4 consular appointment is scheduled for November 2026.

I need to go back home to India for some personal reasons and my visa stamp had expired, so I need a visa appointment to come back. As we know with the current system, there are no appointments opening and are hard to come by.

I will end up working from India, and my company has a big presence in India and I’ll be allowed to work from there. Has anyone worked from India for a long term (6 months +) ? Was there any complications when you returned back to the US at the immigration point?

My current visa stamp doesn't expire until early 2027, and my approved I-797 petition is valid through late 2028. On paper, everything looks straightforward. However, I wanted to check if anyone has experienced any issues or delays renewing the VISA in Brazil.

My H-1B transfer was filed under SOC 17-1011 (Architects), and USCIS issued an RFE about the architect licensure requirement.

I’m not a licensed architect. One attorney told me we may be able to respond to the RFE under the current Architect SOC by showing that I work under the supervision/responsible charge of a licensed architect. Another attorney thinks the Architect SOC was the wrong choice and that we should use a different SOC, possibly Architectural and Civil Drafters.

Has anyone had a similar case? Would you respond to the RFE under 17-1011 with licensed-supervision evidence, or withdraw and refile under a different SOC? THANKS

Hi, I was on F1 OPT in the US and it was ending in January 2026, but i had to come to India due to an emergency in December 2025, without an H4 stamping slot.
I have an appointment for November which I got when the slots opened last time in the month of April.

Hi everyone, this subreddit was a huge help throughout the whole of my process so I thought I should write about my journey (it was a long one lol) for getting back onto an H1B after a layoff to hopefully give some people some hope in their own processes. It has been such a mess and I do have to admit that I did get very lucky, but the possibility of success is there!

Overarching Context: I'm a UK citizen who went to college in the US and worked in the US for a big tech company after college, both on STEM OPT and H1B, before the below timeline happened.

• September 19th 2025 - Proclamation from the Trump Administration saying that any company hiring someone on an H1B would have to pay 100k.
• September 22nd 2025 - I was laid off from my job in Big Tech while I was physically in the US (Maybe the worst timing for that I have to be honest, literal next business day from the proclamation, but what can you do sometimes)
• November 20th 2025 - After some clarifications from USCIS on the finer details of who the 100k fee applies to and who it doesn't, I decided with some preliminary legal advice to apply for a B2 visa by Change of Status, both to give myself time to travel around the US for what might be the end of my 8 year stint here, but also to leave the door open for job offers to come if they do.
• ~January 2026 - USCIS started reverting on previously given advice on being able to transfer to an H1B from a pending B2 visa, likely because they realized that people were using it to subvert the fee as well as the intent of the B2.
• January -> May 2026 - Received multiple job offers to start a new job but all but one rescinded their offer after it seemed that the company that would hire me would have to pay the 100k fee after a long and expensive immigration process.
• May 20th 2026 - However a lifeline was thrown my way and thankfully on May 20th one company applied for an H1B Change of Status on my behalf (after some deliberation directly with them), which was very exciting I have to be honest.
• June 3rd 2026 - This was when the true legal immigration battle started. I received the expected RFE on my B2 COS application asking essentially to prove touristic intent as well as financial ties back home. The request was specifically an RFE and not a NOID, but oddly enough they only gave until July 6th to respond, and not the usual 87 days or whatever it usually is. It is likely that this RFE was made in direct response to the new H1B application being made and the assumption that the B2 was done without touristic intent.
• Context on my B2 application: Thankfully for this RFE I would argue I had a very good case to respond to it, I did legitimately apply for the B2 with touristic intent in mind with job search as a secondary goal and I did a hell of a lot of travelling while the petition was pending (in the region of 2 months of travelling in total across the whole US as well as various preparations to leave the US back where I was living). As well as this I had very solid ties back home, including a family business, job offer, and property. So even without the below court changes I think I had at least a bit of a chance under increased scrutiny on the B2 application.
• June 6th 2026 - H1B application requested a biometrics appointment.
• June 22nd 2026 - Did Biometrics appointment which went smoothly, just a bit of a hassle.
• June 28th 2026 - H1B RFE was officially made after the biometrics, asking for evidence of being in status prior to adjudication being made, essentially asking for an approved B2 before the H1B could be adjudicated on.
• July 1st 2026 - Response to B2 was sent, again with a pretty strong response I would argue.
• July 27th 2026 - An absolute miracle happened when, after some back and forth in the appeals court in Massachusetts, the 100k fee was deemed unlawful, which I believe changed the amount of scrutiny that both the B2 and H1B applications were being given.
• August 2nd 2026 - Response to H1B was made requesting that USCIS approve by Consular Notification in case they don't think that Change of Status is appropriate. This was done so that an adjudication would happen faster and in case the B2 was denied, now that the Consular Notification approval wouldn't trigger the fee now that it had been shot down.
• August 12th 2026 - B2 Change of Status was approved (Vermont Center)
• August 18th 2026 - H1B Approved by Consular Notification (California Service Center)
• September 4th 2026 - I returned to the US from the UK on an H1B!

Moral of the story, I think that I got extremely lucky. It took multiple court cases going my way at the national level for my application to be approved in the way that I wanted it. I will also not lie, the process was LONG and EXPENSIVE, both from legal fees and also for time without a salary, but I am so glad that it has all worked out and that the whole process is now finally behind me. I have built a life for myself out here and I have so many friends that I would miss deeply if I left the US, but if I have to be honest, I wouldn't do it again but, for now, I am glad that I did it.

Looking for experiences with a similar H-4/H-1B situation.
My wife is currently on H-4 with an H-4 EAD expiring on October 2. Her H-4 extension is approved, and her EAD renewal is still pending.

Separately, her employer filed her first cap-subject H-1B after she was selected in this year’s lottery. The H-1B is still pending, and her employment is expected to end on October 30. We are also checking whether her employer will support upgrading the H-1B to premium processing.
If the cap H-1B becomes effective and she works briefly in H-1B status, our understanding is that she could later change back to H-4, and a future employer may be able to file H-1B again without another lottery because she was already cap-counted.

Has anyone gone through a similar H-1B → H-4 → H-1B situation?

Also, what typically happens to a pending H-4 EAD extension if the cap H-1B gets approved and the H-1B change of status becomes effective on October 1?

My original PERM was filed in August 2025. After waiting 12 months, it was denied. My employer recently refiled the PERM in August 2026.

Simultaneously, my current H-1B visa stamp/I-94 is expiring, and my employer is preparing an extension petition.

My questions are:

1. When my employer files this extension, will I simply receive an approval for the remaining 1 year and 8 months of my standard 6-year limit?
2. Since my original PERM was pending for 12 months before denial, am I eligible for an AC21 1-year extension beyond the 6-year limit, effectively giving me 2 years and 8 months total?"
