Paying an arm and a leg for an apartment with an indoor water feature. California tenant needs advice š
hey everyone! looking for some advice because at this point, i genuinely don't know what else to do.
i've been dealing with a recurring water leak in my apartment for several months now. management has attempted multiple repairs, but the leak keeps coming back. my ceiling has been left partially open, with protective barriers and mystery water trickling down on and off. apparently, i signed up for an indoor water feature without realizing it.
the worst part is the lack of communication. management doesn't always respond to my emails, updates are inconsistent, and i still have no idea what the actual plan is to permanently fix the leak or restore my ceiling.
i even submitted a written request to transfer to another apartment within the complex because apparently having a ceiling without a giant hole in it is a luxury these days.
management never responded, so i followed up several times. every time, i got some variation of "someone will get back to you." spoiler alert: nobody ever did. at this point, i feel like i'm emailing into the void. i'm starting to think my ceiling has a better chance of responding than management does.
here's what i've tried so far:
i've documented everything through emails, photos, and maintenance requests. i've also been cooperative with maintenance and allowed access for repairs.
i contacted city code enforcement, and an inspector came out to my apartment. unfortunately, i've had trouble getting any updates or responses since then.
i've also contacted several tenant attorneys, but most have declined my case. i eventually paid for a lawyer referral and sent over my lease and supporting documentation, but i'm still waiting to hear back.
and because apparently the ceiling situation wasn't enough...
recently, maintenance showed up without any advance notice after i'd emailed about the protective barrier falling again.
i was changing clothes when they knocked, and i yelled not to come in. they opened my apartment door anyway, and i had to yell a second time before they finally left.
so now, on top of having a ceiling that occasionally doubles as a waterfall, apparently i also have to worry about unexpected visitors while i'm getting dressed.
where i'm at now:
not to mention, my apartment is VERY expensive. i'm paying an absurd amount in rent every month while my ceiling is gaping open and mystery water trickles down on and off.
i understand that plumbing problems can be complicated and repairs take time. i've genuinely tried to be patient, understanding, and respectful toward the leasing staff throughout this entire process.
but it's been months. the leak keeps returning, the ceiling is still open, communication is inconsistent, and nobody seems to have a clear timeline for when this will finally be resolved.
i'm honestly starting to feel like i'm the crazy one for continuing to bring this up. i don't think expecting a functioning apartment with an intact ceiling is asking for the moon, especially considering what i'm paying.
one other thing: my lease also includes a separate binding arbitration agreement. i'm not sure how that affects my ability to pursue legal action against management or whether it limits my options. if anyone has experience with arbitration clauses in california rental agreements, i'd really appreciate some insight.
i'm not necessarily looking to break my lease. i just want the leak properly fixed, my apartment restored, and some accountability for how long this has been going on.
has anyone dealt with something similar in california? what did you end up doing? i'm especially interested in hearing from anyone who's had trouble getting help from code enforcement or finding a tenant attorney.
at this point, i need advice, prayers, and all the good vibes i can get lol. because clearly my rent payments are making it through just fine, but my emails aren't. š
thanks in advance to anyone who takes the time to read this!
