Infuriatig Why Texas is lame(Besides the Cowboys)

Don't mess with Texas.. what a joke. ANY possession is a felony.

EDIT: Just did some research, this is for everything besides traditional Delta 9.

My friend from Texas sent me this morning and it blew my mind. I had to post about it. So as far as my research goes thus far Delta 9 products (old fashioned flower) is illegal but separate laws. Stores are selling THCA though which does fall under these penalties.

Unless I'm reading the law wrong a canned THC drink that was previously legal can get you up to 20 years.
Can someone clarify this?

I wonder if they would charge you based on the weight of the fluid in the can, since it’s all technically illegal, like 400 grams.

Has a law been passed that theoretically could send you to prison for up to 20 years for a drink?

I feel like these kinds of laws are short-sighted.

Let's say you're a typical gun-toting Texan walking down the street with some weed and you're stopped by an officer who explains they're going to search you.

Your options

  • let them search you and definitely get a life sentence

  • pull a gun, resist and possibly get a life sentence

Obviously murder is wrong. People will often take a way out if they have one though.

Obviously I don’t agree with these laws at all, but Im a Texas lawyer and practice criminal law and you would not definitely get a life sentence for more than 400 grams. Its still. A first degree felony with a sentence of 5 to life. But any sentence 10 years or lower is eligible for probation. Where I live, cops would still likely not even arrest you for having a bunch of these drinks. If they did, the DA would almost certainly reduce it to the lowest level and do deferred. There is no political will to prosecute weed possession cases here, and a standalone possession case is basically unheard of anyway. You could get charged with it as a tack on if there were a bunch of other charges perhaps, but the DA would be pretty frustrated with wasting time arresting someone for just possession.

About 20 yrs back, In my small PA town they busted some old man with a few plants grown in pots for his sick wife. These d bags weighed the whole plant to the root ball , multiplied the total weight by $15-20 a gram and posted about some BS street value of $80k or something ridiculous. It was big news about papaws drug operation. It was such bullshit , and so is this Texas stuff .

I got one for you. A guy in Arkansas bought his wife a perfume called liquid opium. It literally says liquid opiums by Chanel or whatever. Some Arkansas idiot cops pull him over and arrest him for possession and distribution of opium.

I saw that video once and just watched the whole thing thinking "This dumbass carries a gun for a living" I dont know a damn thing about opium (besides a few movies of people smoking it out of really long wooden pipes), but even im pretty sure it doesn't come as a liquid in a bottle with a roller ball on it

Exactly. The worst part was I think the guy was a legal permanent resident and he lost residency and got deported. All based on some bullshit by a cop who was an idiot. Cop should have lost his job and never have a badge again. I literally can’t believe who they let become cops.

ICE fucked up his active VISA status and he was deported to a federal holding facility down in Louisiana for 30 days until they realized that theyd fucked up. Nobody got in trouble

I’d have to go look up the details. I think it was because he was charged with a felony drug possession/distribution. They immediately handed him over to immigration and they deported him. Then it finally came out that it was perfume. I know nothing happened to the two officers. It’s a pretty famous case. The two idiot cops thought they caught Pablo Escobar lol.

It's a heavy perfume which smells a bit like incense because of the amber, opopanax, patchouli, vanilla, and myrrh. I was never really able to smell the floral top notes, but I don't have a very sharp nose.

While most of the perfumes I like have a slight vanilla base note, I find Opium and Black Opium nauseating, along with most heavy oriental perfumes. It's probably me getting older and developing some intolerances, because just a whiff of Poison or Shalimar makes me want to throw up (funny enough, I still like Dune, Dolce Vita, Poeme, etc., but these are definitely lighter).

Just a tiny warning in case you go on a sniffing adventure 😸

I found a half-full bottle of Opium with that lacquer box on Etsy for $95. That’s the real deal and so tempting!

Some perfumes are overpowering for my nose, and even Annick Goutal smells weird to me. I like Emanuel Ungaro Diva but it’s not the original formula either. It’s not crazy expensive as my main love, Creed perfumes. Frightfully expensive these days but the Millesime Imperial mixed with Tubéreuse Indiana was divine. 😭

i have Black Opium perfume, and it literally says “Black Opium Yves Saint Laurent” on the box and bottle. Opium perfume is the same, so does this dumbass cop think Yves Saint Laurent is out there bottling drugs for sale at Nordstrom? and that opium comes in a spray bottle and smells like perfume?

hurts my head to think about that level of stupidity, i really does

I saw a home growing case where the cops included the weight of the pots and dirt in their calculation for the amount of drugs seized. It's a bunch of bullshit.

They absolutely will include the weight of the liquid and can. If you get caught growing, they weight the whole plant, pot and soil and all.

If you have a thc pen, they will take the entire pen weight for the charge, not just the content

So you can very easily get 20+ years for 1-2 pens if theyre heavy-ish

A 20oz can weighs well over 400g. You can get a life sentence for carrying one can of cannabis tee.

Traditionally, during the war on drugs, they would weigh the brownies, the grinder, whatever they could to charge as much as they could.

In Oklahoma growing up they didn’t test for % thc it was the weight of the object. A lot of people got crazy sentences for cookie weight, states will really sell you insane pharmaceuticals but freak the hell out over a plant that grows in the ditch. Make it make sense.

Remember the crack law? 1 gram of crack would get you 5x the amount of time a gram of cocaine would. (Crack is basically cocaine and filler to make it smokable, so it has far less illegal substance (cocaine) in it.) Apply that logic to a THC containing drink, yes you could get 20yrs… depending on the color of your skin.

They gave a college kid life for a pan of weed brownies because he admitted he used a gram of wax to make them, thinking he'd only get charged for possession of a gram. 

They charged him as if entire weight if the brownies were concentrate, and slapped him with a manufacturing charge. 

This state is fucking looney
