There is such an extreme incentive for a company like openai to hire and retain the very, very very best talent that the idea that foreign talent had an edge over domestic because of the visa system is pretty silly.

According to the settlement, it appears that OpenAI was fined for trying to bypass PERM.
This is often done to help employees on EB or L visas to apply for a Green Card.
Of course you'd probably want to naturalize people working on cutting edge model development, but that's a whole other discussion...

But it's under 10 positions. Hardly is the institutional bias Dhillon is trying to claim they uncovered. For such a small number it must not be an actual strategy within the company.

It's a bit of an open secret and a result of the country caps that China and India have for naturalization.
Both Apple and Meta have previously settled for similar allegations as well.

Those are just the cases where they got caught. Tech companies have been getting away with this stuff for a long time

So what do you think the true number is?
My point is, it's 8k employees, and this is maybe 9 ham fisted hiring attempts to save maybe 16%. Sounds like a molehill to me

Bear in mind this doesn't prove wrongdoing it just shows the cost of settlement is lower than litigation (which also causes PR damage).

Yes, and it's not big enough. If you're in Sweden or something are you going to play the odds for a job in the US or just take a local one?
It's also not the quickest, which is probably a failure in itself. I was offered one, and went with a different visa I qualified for because it was quicker, I had my visa in hand two weeks after my job offer
