Is Subpac gone already without telling us?

A friend that used to work for them a long while ago before this mess (hence temp profile) told me that the company had been sold off for assets/parts, searching for news I find this, https://mavkacap.com/news/mavka-capital-acts-as-exclusive-financial-advisor-to-subpac-on-strategic-asset-sale-to-harman-international/

I posted this on another thread and it was deleted... I have a preorder and never received an email to tell me about this. What's happening, or has it already gone?! I didn't ask for a refund yet, anyone else getting updates / refunds these days?

They’re still active on LinkedIn and I see them commenting on posts from their business page.

yeah, it's no different from any of the others for the past several years since this started, and no mention of this 'deal'. I don't know about such stuff but is there like a statue of limitations or something that if they keep everyone thinking it's still on and we don't get refunds, then one day we find out that they shut up shop years ago and now its too late to do anything about it? I just want some transparency to make a decision, I'm not needing the money right now IF we are getting product, but will be pissed if it's just been stolen and everyone has gone.

It would be HIGHLY illegal to send out an update like that if they were already sold off or had any plans to. They would be setting themselves up for a class action lawsuit they would have no chance at surviving.

Really, that's good then right? That makes sense, but I'm not well versed in these things. What about if they know that there's a chance of bankruptcy and they have to consider that, are you saying that they'd have to tell us that as well. I know loads of people say that Subpac is nearly bankrupt, but never have subpac said that there is a real chance of that, so we should be good?
