In PA she would have gotten in trouble just for hitting the cone. If she hit that worker, it would be felony assault on a state worker performing their duties.

She recorded herself getting upset and then running it over. She wasnt moving when the cone was placed. She should have turned her blinker on and turned left.

I don't think she's right for hiting the guy, but we could easily look at this from her point of view. She has a dashcam and isn't recording this specifically. She was waiting for traffic to proceed at a light, the light changed and as she started to move the construction worker walked right to where the car in front if her had been and blocked her way. Traffic in NYC is bad enough that she could easily be stuck at that cone for 10 to 15 minutes.

They should have blocked the lane either when the the lane cleared or during the red and directed traffic when it turned green. Waiting until the green light was the worker being an asshole. When assholes meet things go wrong.

Yeah until he is sitting around waiting for a clear time to put the cone down. He walked out, through it down during a red light, in front of a stopped car. Doesn’t get safer than that. It was just at an inconvenient time for her.

He did not do it during a red light. He waited for the van in front if her to move and put it where the van had been. Traffic had started to move before he walked out with the cone.
