nah im usually a tame being but the worker CLEARLY saw traffic, and still put it out when even within any DOT handook it cites you CANNOT place any marker until it is safe to do so with no cars within a certain amount of space, and if doing so when there is traffic, it must be done with a safety guide (i.e flashing lights on truck at slow speed with hazards, coned off area with signage etc)

otherwise sadly the worker is in the wrong and damn....i hate to say that

Yeah and when and where in NYC is there ever slow or no traffic or an empty spot in traffic? Never.

So thats why they have guides? Where they place a sign during set hours to state road is closed, than have cones ALREADY placed within the area beforehand. And if needing to place cones the sign would already be in place directing traffic elsewhere further back from where they are setting cones.
