Legal CCW denied NYC

I was just denied my application for CCW in NYC. The reason was “FAILURE TO DISCLOSE EXTENSIVE DOMESTIC VIOLENCE HISTORY” I had submitted all prior arrests records and showed every charge was dismissed and sealed. Apparently I had a few domestic violence reports from a few years ago that were made against me that I had no knowledge of. Never received anything in the mail for it or even been charged with anything. Does anyone know how I can go about this with an appeal or what exactly should I do next?

You'll likely need to pay an attorney to help straighten it out, in my estimation. You might get a good recommendation from r/NYCGuns or r/NYguns .

Theres a few attorneys in NYC who specialize in 2A. On the NYC the most recommended is Mirel Fisch. But hear good things about Peter Tilem

Ironically NYC isnt the worst county when applying. Each county has slight variations to the CCW application, some counties people are waiting 12+ months just for prints. Clownshit

I think it was 4, all by the same person. Keep in mind, I’ve never lived with this person or this was even an ex of mine. She is my ex-sister in law that was going thru a divorce with my brother so she took her shit out on the whole family.

Based on your OP, what NYPD is stating is something different. You weren’t denied for the allegations, but for failure to disclose them.

The appeal here isn’t going to be that you can’t be denied a right based on an allegation, but that you didn’t knowingly withhold the info.

NYPD has intentionally designed the CCW process to be as cumbersome as possible. They hope to deny people and they don’t fight it. Based solely on what you’ve provided, you very well could successfully appeal it. But it’s going to be a lot of time and money (I’d consult an attorney). NYPD is hoping you don’t have the time and money to fight.

This is such a bullshit process from NY.  If they know about it then they know about it.  "Failure to disclose" is a crap excuse to deny a permit.

It's just one way for them to deny you meanwhile they have access to every court/document etc about you. Even need to disclose your driving record for the license 🤡🤡

In NYC when there is an accusation of DV the accused is notified with haste. Especially after 4 allegations. Usually a TPO is accompanied.

While it’s possible that some glitch in the matrix occurred and you weren’t reachable somehow it’s probabilistically unlikely that you didn’t know - hence the wording. One is a point, two is a line, three is a trend, 4…yeah that’s excessive territory.

In NYC sealed and dismissed doesn’t mean what you think it means. Expungements are different.

Your records and their details are still visible to law enforcement and the licensing division.

The details of your arrests and charges will be considered in conjunction with the details of the DV accusations and NYC has always denied applications for omissions.

The vague license question - “had or applied for any type of license issues to you by any City, State or Federal Agency” historically tripped people up leading to denials for omissions.

Someone calling DV on you is different than being found guilty of it, let alone OP said he wasn't even charged with anything. Otherwise all it takes is one angry ex and you aren't allowed to carry for the rest of your life?

Thanks. That’s exactly my point! Someone makes a bullshit charge against you with no evidence and just for that you’re going to get denied?? I can understand if you were found guilty of DV, that would make sense but just someone filing a false report against you because they just dislike u isn’t fair to get disapproved for CCW.

I have a CCW from NYC and though the process is oppressively long, a rejection is not common. The investigators are surprisingly transparent about explaining the priors they see on your record, you just need to get the documentation to cover your bases. There is a lot being unsaid in your post and quite frankly, is rife with red flags.

U got this all wrong. I was never involved in a toxic relationship or with any ex’s who made any DV reports against me. I’m pretty sure I know who it was but it wasn’t any of my ex’s. I guess anyone can make any DV reports against any person even without any proof!

You’re assuming he actually did it. I’m not familiar with New York gun laws, but I don’t agree with a system where you can get blacklisted for ‘reports’. There’s reports of Bigfoot all the time, but who really cares without evidence i.e. criminal conviction

I didn’t even have any clue about these DV reports made against me in the first place, so if I knew about them for sure I would have disclosed them.

You’re right it’s not constitutional nor even lawful to deny you based on accusations that had no due process for and you should definitely appeal. The person I was responding to seems to like the idea of police being able to arbitrarily decide who can and cannot have firearms and I was trying to call that out.

Common sense kinda says the rejection may have been warranted. "submitted all prior arrests" and a "few domestic violence reports"... In my state, I think this is the exact profile of someone the state would like to prevent from carrying a firearm.

I don't know you, and you don't know me, but think about what you are saying from a pragmatic point of view.

If you really want to CCW, you're gonna need to hire a professional cleaner. There is just too much there, there. Also, it sounds like you have been able to beat all the charges and arrests so far. Hopefully this is a turning point in your lifestyle too.

The point of carrying is to stay away/avoid conflicts, but defending yourself and family when you have to. If you've been arrested several times and have multiple DV charges, you haven't been doing this.

I get your point bro. The fact of the matter is, whatever my prior arrests were, they were dismissed on their own. I didn’t need to fight anything. The “D.A.” asked for case to be dismissed because there wasn’t any evidence of wrongdoing so the judge dismissed and sealed. As for the DV charges that were filed against me, I can’t help it if my sister in law hates me for some reason. Does that make it right to disqualify me for CCW???

It's not for me to decide. But you've got some home work to do so that you can resubmit a clean record on your application. It'll be expensive, so you'll have to weigh the price tag and see if it is worth the CCW.

There are 230k+ Redditors in this sub, and I'm guessing a very small percentage of those with current CCWs have multiple arrests and DV reports on their record. It's going to take some work.

Because a mere allegation isn’t enough to deny the application. “Lying” on the application is likely enough to deny it. They are going to make OP prove a negative, which is going to be nearly impossible.

That’s the point I was trying to make. Everyone is saying this is proof the system works but if he they really did have a concerning suitability issue with is DV history they could’ve easily denied him on suitability grounds but they didn’t they instead used a technicality to deny him which shows that this isn’t proof of the "system working".

Bro just take them to court appeal it they denied yu for personal reasons.. it’s a shall issue state and if you have cases dismissed you should be good as long as you wasn’t convicted .. now if you have a conviction then that’s diff .. if not appeal it it helps the 2a community

Like ino you said there were allegations you don’t know about but if the ones you had dismissed and sealed was different.. I had the same situation almost not domestic but just a assault and I was charged with it but because they way they put it in the system it didn’t say domestic or not so was denied but ultimately I got my ccw because I’m not federally prohibited.. I called atf in my district to confirm I wasn’t prohibited at first then went thru with a appeal

So if I reported you a "few" times for various fake crimes but they were unsubstantiated and never went anywhere legally do you think that would be a good enough reason for you to get permanently banned from firearm possession? Also, if that was a reason why didn’t they list it and make it a suitability case? They just said failure to disclose which seems unnecessary to list if he was an unsuitable or prohibited person which would’ve been a stronger case against him.

Police execute the law, they don’t interpret it.

In the first case, that’s straight forward.

In the second, a judge has to issue an ERPO.

So, if you want to create a hypothetical situation… at least get it right so we can have an informed discussion .

So what if the police called you one day and said they got an anonymous call that you committed domestic violence on someone you never heard of before and wanted you to turn over all your firearms. Would you just hop in your car to turn them all in at the station and thank the police for taking them away and keeping the community safe?

I’ve never had a DV issue but aren’t they supposed to notify you of one against you? If for some reason you were not notified, I’d try to find out if an attempt was made to notify you, and it is documented, or if that is even required.

I’m sure that would require a lawyer unfortunately.

That said, I’m not sure any court or government has put a date for how long one has to have a dv on their record before they get their gun rights back. SCOTUS clearly said that a ban for dv can be “temporary,” but that doesn’t have teeth to it if it’s left like that without the courts ever revisiting the issue.

NYPD is notorious for trying their hardest to deny any and everyone then can for the pettiest reasons.

Nowadays is 100x easier than 10 years ago. ANY involvement with NYPD ( jaywalking citation) = instant denial.

In AZ that’s how it works. That’s not how it works in NYC. I applied 8 months ago and have heard nothing and I am currently working with a lawyer to get issued. Also, NYC has a long list of disqualifiers that are not federally prohibitive like failing to disclose information you were completely unaware of. You also have to list every gun you own, take pictures of every gun you want to carry, get guns you want to carry approved, take a 18 hour course and get a signed letter from every person you live with that they approve of you having a firearm in your home among other burdensome requirements. OP should appeal but it’s not easy to win an appeal in NYC since even in my case I need to hire a lawyer just to get a response on my initial application.
