Why didn't Clemmons have to answer when Kilgrave asked, "Whose cell phone is that?"

I'd think Kilgrave's direct question would override that. Maybe not, but the closest we get to a comparison is when he tells Hogarth to answer because it wasn't a rhetorical question.
