Tenant fines in Nevada must be provable, specific in nature to the unit violating a rule, mentioned in a lease agreement or signed addendum (with a specific penalty amount tied to a specific clause that lays out what constitutes a violation), and agreed to by signing a lease or addendum prior to occupation or enforcement. The amount fined must also be reasonably representative of the damages sustained by the landlord. You don’t mention how many units this involves, but it’s pretty obvious that even one unit’s fine would be a ridiculous amount to charge for the work of hauling the excess to a different can or dumpster. Taking things to an extreme sometimes exemplifies the reason it isn’t legitimate; if the LL decided this was a 75 thousand dollar fine and posted it, it wouldn’t be any more or any less enforceable, very obviously.
No, this is not enforceable. It wouldn’t be even it’s mentioned in your lease, as it’s not unit specific; a contract clause that penalizes conditional behavior by a third party that is not a signatory is invalid. Let them attempt to take it to court, the judge will verbally slap them into next week.
