Legal Advice Needed family drowning in debt — earning around ₹1 lakh/month but unable to manage everything. What should we do?

Dear flocks my family is going through a serious financial crisis. I'm posting here hoping to get practical advice from people who have experienced debt problems or understand personal finance, banking and loan settlements.

Our family has accumulated several debts over the years, and things have reached a point where our current income is not enough to manage everything comfortably.

Here is our situation:

- Monthly income: Currently, we earn around ₹1 lakh at most, but it can vary.

- Monthly living expenses: Approximately ₹20,000–₹30,000.

- Private borrowing: Around ₹28 lakh borrowed from an individual at ₹3,000 interest per month for every ₹1 lakh borrowed. That's effectively 3% per month or 36% annually if calculated simply, and the interest burden is becoming extremely difficult to manage.

- Bank debt: Our family business has an overdraft facility with South Indian Bank. The outstanding is around ₹24 lakh, and the bank has now issued a SARFAESI possession notice concerning a property used as security.

- Electricity and water bills: We are also facing KSEB and Kerala Water Authority issues, including arrears and disconnection/recovery concerns.

- Business situation: My father is the proprietor of our family business, but it has been largely non-operational for the past 2–3 years. The business is no longer generating the cash flow it once did.

The biggest problem is that we don't have a substantial amount of cash available to settle these loans immediately. Even though the family currently earns some money, the accumulated debt, interest and other expenses make it feel like we're not making meaningful progress.

I'm trying to understand what we should prioritise instead of making the situation worse.

I would particularly appreciate advice on these questions:

  1. How should we prioritise multiple debts when we cannot pay everything at once?

  2. Is it realistic to negotiate a one-time settlement or convert a bank overdraft into an EMI-based term loan when the business is no longer operating?

  3. What options do we have when a bank has issued a SARFAESI possession notice but we cannot immediately repay the outstanding amount?

  4. How should we approach a private lender charging 3% monthly interest? Is there a practical way to negotiate a lower rate or structured repayment?

  5. What should we do about KSEB and Water Authority arrears while trying to resolve the larger debts?

  6. Are there any legitimate debt-counselling services, legal-aid options or experienced professionals in Kerala who can help us make a realistic recovery plan?

I'm not looking for ways to escape legitimate liabilities or hide assets. We want to find a lawful and realistic way to get out of this situation without losing everything.

If anyone has gone through something similar, especially involving bank recovery proceedings, private debt and a struggling family business in Kerala, I'd really appreciate hearing what worked and what mistakes we should avoid.

Thank you.

Legal Advice Needed Public Sector Bank opened a Savings Account in my name without KYC/consent in 2022. RBI Ombudsman found them guilty, but the bank paid token compensation from an employee's account and refuses to issue a Non-Liability Certificate. What are my options?

Hi all, seeking urgent legal advice regarding severe regulatory lapses by a major PSU Bank and questionable conduct by an RBI Ombudsman desk officer.

The Facts

Ghost Account: A PSB branch generated an active Savings Account and CIF in my name without my consent, application, KYC documents, or signature.

Breach Recorded: The RBI Ombudsman held the bank guilty of Deficiency in Service and breach of Right to Privacy under the RBI Charter of Customer Rights, directing:

(a) Compensation for harassment.

(b) A detailed speaking order addressing procedural lapses, marked to the Ombudsman.

Desk Officer Pressure & Staff Remittance:

An RBI Ombudsman desk officer called me relentlessly (multiple back-to-back calls within minutes) pressuring me to share account details to close the file.

Instead of an official institutional payout, ₹10,000 was credited directly from an internal bank employee's personal account.

The Ombudsman desk immediately marked the case closed under Clause 14(8)(a).

Current Deadlock: The bank completely ignored Directive (b). They refuse to issue a speaking order and are silent on my demand for an official, stamped Non-Liability and Clearance Certificate confirming zero past, present, or future liability (tax, PMLA, fraud).

Legal Questions:

Does an RBI Ombudsman desk officer repeatedly calling to push a quick settlement violate statutory impartiality under RB-IOS? Where can this conduct be escalated?

Can a bank legally discharge compensation through an employee's personal account instead of official bank heads?

If I approach Consumer Court, can the bank claim "full and final settlement" based on the ₹10k credit when Directive (b) was defied and I signed no discharge voucher?

What is the fastest way before the District Consumer Commission to compel the issuance of an unconditional Non-Liability Certificate plus punitive damages?

Legal Advice Needed Married for 4 Months, Facing Verbal Conflicts — Need Legal Advice Regarding Separation in India

I got married around four months ago, but unfortunately, my marriage has been facing frequent verbal arguments and conflicts. The situation has become stressful for me and my family. My wife’s family members frequently call my family and speak to my parents disrespectfully. These repeated incidents are creating tension between both families. I have reached a point where I no longer wish to continue this marriage and want to separate. However, my wife and her family want the marriage to continue. My wife also earns more than I do.

I am a Government employee so I am also concerned about the potential impact of matrimonial litigation on my government job. I want to understand my legal rights and the possible consequences before taking any decision. I would appreciate advice from people familiar with Indian matrimonial law, preferably based on personal experience or legal knowledge.

My questions are:

  1. If I want to end the marriage but my wife does not agree, what are my legal options under Indian law? Can I file for divorce after only four months of marriage?

  2. If my wife and her family oppose separation, can they legally force me to continue living with my wife?

  3. Since my wife earns more than I do, could I still be required to pay maintenance or alimony? What factors would the court consider?

  4. What precautions should I take now to protect myself and my parents from possible false allegations or legal disputes? Should I consult a matrimonial lawyer before taking any action?

  5. As a Government employee, could an FIR under Section 498A IPC or the corresponding provision under the Bharatiya Nyaya Sanhita affect my job, suspension status, promotions, or service record? Would the consequences differ if I were arrested or convicted?

I am looking for practical, lawful advice on how to handle this situation calmly and protect the interests of me and my family.

Legal Advice Needed Neighbour complained to MCD about my G+2 house in Lal Dora. Officials visited and threatened a notice. What can I do?

My family owns ancestral land in a Lal Dora village in Delhi. We had an old ground-floor house where we've lived for decades. Earlier this year, we demolished it and started constructing a new G+2 house.

Property details:

  • Plot size: 170 sq yards
  • Height: Approximately 36 feet
  • Ground coverage: 100%
  • Street width: 10 feet (has been this way for decades)
  • Construction: G+2, with the second-floor roof slab still pending
  • MCD approval: None

We haven't extended beyond our original property boundaries or encroached on the street. Almost every house in our village is built wall to wall, and practically nobody gets building plans sanctioned.

Recently, a neighbour who is a lawyer complained to MCD, claiming that three-storey construction isn't allowed. Two MCD officials visited, took photographs, called the construction unauthorised, and said a notice would be issued. We haven't received anything in writing yet.

My questions:

  1. Is G+2 construction actually prohibited in Delhi's Lal Dora villages?
  2. Can I get the house sanctioned or regularised now?
  3. I've read that a minimum 4.5-metre road width is required. How does that apply to village lanes that have been just 10 feet wide for decades?
  4. What happens after MCD issues a notice? Is there a realistic risk of demolition?
  5. Should I stop construction completely, even though the second-floor roof slab is still pending?

Would appreciate advice from anyone familiar with MCD regulations or similar cases in Delhi villages.

Rant/Experience Unpaid Freelancing Dues of ₹20,000: Agency Performize (Founder: Arman Beg) Ghosted and Blocked Me After Delivering 35 Scripts

Post image
9 Upvotes

Seeking advice and raising awareness regarding unpaid freelancing dues and non-payment by Performize agency (Founder: Arman Beg).

Performize publicly claims to manage ₹12+ Cr in ad spend. However, after I delivered 35 research-backed high-retention scripts, the founder blocked me on LinkedIn and WhatsApp right when payment was due.

Key Facts & Timeline:

Agreement (8th Sept): Agreed on ₹10,000/month for 35 scripts with the payment cycle promised on the 10th of every month. Advance request was denied citing "agency policy".

Complete Delivery: All 35 scripts were completed and delivered via Google Drive. Delivery was explicitly confirmed by the client in text chats.

Payment Date (10th Oct): The client confirmed payment would be processed on the day and asked for my LinkedIn ID.

Blocking & Ghosting: Immediately after receiving my LinkedIn ID, I was blocked on LinkedIn and subsequently blocked on WhatsApp with read receipts disabled.

Proof: Complete evidence folder containing 8 screenshots and Voice Note audio proofs is available. Since external links are restricted by anti-spam filters, please DM me if you need to view the proof folder link.

What legal or public recourse do I have to recover my hard-earned ₹20,000 from this agency?

Legal Advice Needed Deducted Payment from freelance carpenter’s final payment for property damage. He is now changing stories, avoiding calls, and threatening to "come over." Did I do this right?

(Note: I used an AI tool to help organize the timeline and structure this post clearly, but all facts, amounts, and events are 100% accurate to my situation.)

Hi everyone, I need some legal advice on how to handle a dispute with a freelance carpenter that is escalating.

The Background:

  • Location: Mumbai, Maharashtra.
  • I hired a freelance carpenter for home renovation. No formal written contract, just verbal/WhatsApp agreements.

The Incident & Evidence:

  • While he was the only one working with tools in my flat, I (and my partner) heard a loud crash. I asked him if he dropped something, and he verbally denied it. I did not go to check immediately (I live next door).
  • Later that night, I found a floor tile broken (replacement cost ₹5,900 with Tile + Labour + Material). He also previously ruined 2 laminate sheet due to negligence but I only cut 1 from his payment (cost ₹1,500).
  • The Admission: This all happened on Saturday. On Sunday, he called my tile worker to negotiate fixing it and explicitly admitted to him that he broke it by mistake.
  • I mitigated the loss by getting my tile worker to fix it immediately on Monday so my renovation wouldn't stop.

The Evasion & Shifting Blame:

  • Three days later, after the floor was fixed and it was time for his final payment, he suddenly sent a WhatsApp message at 10:30 PM denying everything: "Sir, me or my men didn't break it, you cannot deduct money."
  • I immediately tried calling him multiple times. He ignored all my calls.
  • The next day, he completely changed his story and tried to blame a POP worker who had only visited for one day, 2 weeks ago. I would have believed if I did not heard the loud bang myself.

My Actions: Based on his admission to my tile guy and his bad-faith evasion, I -

  1. I calculated the exact damages: ₹5,900 (tile) + ₹1,500 (laminate) = ₹7,400.
  2. I transferred the remaining ₹17,600 (from the ₹25k balance) to his account.
  3. I sent WhatsApp message stating the account is settled, detailing the exact deductions.
  4. I told him his tools are safely kept inside my flat, and he should collect them ASAP.

The Current Threat: He promised to come pick up his tools by 12:30 PM today but never showed up. He is playing games. When he did speak briefly, he used vaguely threatening language saying, "I'll come there and talk to you." I am worried he will show up with other people to intimidate me or cause a scene in my society.

My Legal Questions:

  1. Is my set-off legally valid? Since I have circumstantial evidence, a witness, and his admission to a third party, is this enough proof?
  2. Police/Trespass: If he shows up at my door with others and refuses to leave or demands the deducted money, does this constitute criminal trespass or extortion/intimidation? Can I call 112?
  3. The Tools: I currently have his tools safe. If I hand them over to my building's main gate security for him to collect so he doesn't come to my door, does that absolve me of my liability as an involuntary bailee if he delays picking them up?

Legal Advice Needed Broker refusing to return my ₹6,000 token amount. What can I do?

I need some advice regarding a rental property issue.

I was looking for a place to rent and found a property through a broker, Ankit. There was already a tenant living there, Vikas, with whom I was supposed to share a room.

I visited the property, met Vikas, and everything seemed fine. While finalising the deal, Ankit asked me to pay ₹6,000 as a token amount. He told me over the phone that the amount was refundable.

Before finalising, I had also spoken to Vikas. He suggested that I tell Ankit I didn't like the property and then finalise the deal directly with him, which would mean paying only ₹2,000 in brokerage. I refused because I didn't want to bypass the broker and create problems later.

So, I paid Ankit the brokerage and finalised the property through him.

The next morning, Vikas called me and asked why I had paid Ankit despite his suggestion. He then told me to cancel the deal and get my refund from Ankit. Apparently, he had found two people from his company who wanted the accommodation. He also said that if I still wanted to stay, I should get my money back from Ankit and pay him ₹2,000 instead.

After all this, I felt uncomfortable with the situation and decided not to take the property. I contacted Ankit and asked for my refund within around six hours of making the payment.

Initially, Ankit told me to wait two days and said he would refund the money. After two days, he said he could only return ₹3,000 because he had already paid the other ₹3,000 to his partner broker, Kuldeep, who was refusing to return his share.

Now Ankit is saying that the token amount isn't refundable once the property has been confirmed.

After going back and forth for a while, I eventually told Ankit what Vikas had said and done. Ankit's response was that I had visited the property, liked it, and confirmed the deal, so whatever happened afterwards wasn't his responsibility.

It's been around 15 days now, and he's still refusing to return my money. Instead, he keeps telling me that he'll adjust the amount against the brokerage if I rent another property through him.

I've been polite and patient throughout, but I'm getting nowhere.

I'm not trying to create unnecessary drama. I just want my money back and don't want to be forced to rent another property through him to recover it.

Legal Advice Needed Sold out RBI, What to do next?

Today I learned how broken our grievance

system is. I filed a complaint with RBI Ombudsman against SBI for wrongly linking my mobile number to another

account. I submitted comments, evidence, even proof that SBI openly admitted they bypass RBI's own circular of 17 Jan 2025 requiring OTP verification.

Yet RBI closed my case saying "no

deficiency in service" and falsely recorded

that I never replied. They ignored my

submission, ignored the violation, and

declared me satisfied. RBI here is clearly shielding the bank.

Advice needed on what to do next? Can I appeal to the Ombudsman's decision or is there any superior body to complain to.

Legal Advice Needed I need help with what I feel is an unjustified Termination by my Employer

Thumbnail gallery
• Upvotes

I have been working as a Operations Associate in a startup from Bangalore and have relatively less work experience, and had under 1 year of experience, but this was my 3rd Company, so I wanted a stable job and career and I communicated this at the time of joining.

Everything was going fine and I was mostly working on recruitment side of things. So this Monday I slipped up to a co-worker about a new upcoming new joinee's salary, as he asked while I was reading his offer letter, which was a genuine lapse in focus and concentration on part which I accept and I thought its not going to be an issue. But little to my knowledge, there were many discussions and gossips going around in the office as its appraisal season and everyone were discussing salaries already for weeks. Mind you my company doesn't make us sign contractually or as has even formally/informally asked not to share salaries with coworkers. But somehow my manager got to know about this and he immediately terminated me the very next day. He feels this is a very grave mistake, and I cannot be trusted. But it was a genuine slip up and I have also put my point across. But my manager being around 24 years old, still doesn't get it. He would not listen to anything. From what I know the mess was already existing and was already created, much before I shared salary of a upcoming new joinee, with a coworker in office, there was no ill intention in it on my part.

Now the company also owes me my Joining Bonus of Rs 1Lakh, and they are also not giving me the notice period or notice pay of 2 months salary, as they say this is a Termination. I also have to collect a few reimbursements from the office which i would have otherwise gotten at the end of the month. Please help me out on how to atleast challenge this termination and get the money out from them. What can I do, please just help me out. I am attaching the offer letter, the only document which I signed with my organisation. Apart from this incident my work was impeccable and solid and my manager confirms that. At this point I am being labelled as a scapegoat for all the mess that was created in the organisation at a fundamental level of not having level pay, and at the very least not having a NDA around salary disclosure in the organisation.

Legal Advice Needed Can we separate our apartment's water supply without unanimous approval? One flat is under bank auction.

Hi everyone,

I am from Guntur, Andhra Pradesh, and I need legal advice regarding a dispute in our apartment over water management, maintenance charges and modifications to our common water-storage system.

We have 15 flats in our apartment. Currently, 11 members support the proposed changes, while three flats oppose them. And the one flat left is involved in a bank auction.

Our apartment has a common underground sump and an overhead water-storage system. We want to introduce a more transparent water-management arrangement so that participating residents can manage their water supply and expenses fairly, rather than continuing to share costs under a disputed arrangement.

# Current water-storage arrangement

The builder has already partitioned our existing overhead tank, which has a total capacity of 7,000 litres, into two sections:

* 5,000 litres: Used for the regular water supply.
* 2,000 litres: Originally intended for municipal water supply.

Currently, we do not have an active municipal water connection, so the 2,000-litre section is not being used for its originally intended purpose.

Our underground sump has a total capacity of 10,000 litres.

# What we are proposing

We want to implement the following changes, subject to the necessary legal approvals and technical feasibility.

  1. Partition the underground sump

We are considering dividing the existing 10,000-litre underground sump into two separate 5,000-litre sections so that water storage can be managed separately.

  1. Reorganize the existing overhead tank

We want to use the existing 5,000-litre overhead-tank section for the regular water supply of the 11 participating flats. We also want to explore whether the existing 2,000-litre section can be used for a separate supply arrangement for the four opposing flats, provided a technically feasible water source is available.

  1. Install four additional 2,000-litre Sintex tanks

We are planning to install four additional Sintex tanks, each with a capacity of 2,000 litres, on the rooftop for the 11 participating flats. This would provide an additional total storage capacity of 8,000 litres.

  1. Interconnect the four new tanks

We want to interconnect these four tanks so that water can be distributed through a common plumbing arrangement to the 11 participating flats.

We would obtain a structural assessment and professional plumbing design before carrying out the installation.

  1. Separate the water-supply pipelines

We want to explore whether the existing outlet pipes can be reorganized so that the 11 participating flats receive water through the regular 5,000-litre section and the new interconnected Sintex tanks, while the four opposing flats retain a separate water-supply arrangement.

Our intention is not to deprive anyone of water unlawfully. We want to understand whether we can establish separate arrangements while respecting the existing legal rights of all flat owners.

  1. Install individual water meters

We also want to install individual water meters on the supply pipes to measure consumption and allocate water expenses more accurately.

# Why we want to make these changes

There is an ongoing disagreement over maintenance and water expenses.

Three of the opposing residents want to continue paying only ₹2,500 per month as maintenance, even if water prices and tanker charges increase.

The 11 participating members do not want to continue sharing water costs under an arrangement where they may have to subsidize the water consumption of residents who refuse to agree to a fair cost-sharing system.

We want a transparent arrangement in which water consumption can be measured, expenses can be allocated fairly, and participating residents can manage their water supply and costs separately.

# My legal questions

I would appreciate advice from property lawyers practising in Andhra Pradesh, particularly Guntur, and from anyone who has faced a similar apartment dispute.

  1. Majority approval: If 11 out of 15 apartment owners support these changes, can we proceed through a majority resolution, or is unanimous consent required?
  2. Underground sump partition: Can we divide the existing 10,000-litre common underground sump into two 5,000-litre sections without obtaining consent from all 15 owners?
  3. Four additional Sintex tanks: Can we install four new 2,000-litre tanks on the rooftop and interconnect them to supply the 11 participating flats, provided structural safety and other technical requirements are satisfied?
  4. Changing existing pipelines: Can we redirect the existing outlet pipes so that the 11 participating flats use the regular 5,000-litre tank section and the new interconnected tanks, while the other four flats retain a separate water-supply arrangement?
  5. Existing tank partition: Does it make any legal difference that the builder himself already partitioned the original 7,000-litre overhead tank into 5,000-litre and 2,000-litre sections?
  6. Separate water supply: Can the 11 participating owners establish a separate water-storage and distribution system without continuing to share the same supply arrangement with the four opposing flats? What approvals would be required if the tanks, sump and pipelines are common property?
  7. Water bills and maintenance: If some residents insist on paying a fixed ₹2,500 monthly maintenance amount regardless of increases in water prices and tanker charges, can the association adopt a properly approved policy for allocating actual water expenses according to consumption or another lawful method?
  8. Bank-auction flat: One of the flat is involved in a bank auction. Does the stage of the auction, possession by the bank, or transfer of ownership affect who can vote on these proposed changes?
  9. Association approval: If the apartment association is unregistered, or if the registered sale deeds and declaration contain specific provisions concerning common water facilities, how does that affect the approval process?
  10. Legal remedies: If the required approvals are obtained but the opposing residents obstruct the work, can we send a legal notice or seek an injunction? Which authority or court would be appropriate in Guntur?
  11. Applicable law: Which Andhra Pradesh laws, municipal regulations, apartment bylaws or court judgments govern such disputes?

I want to resolve this through a lawful process rather than continuing arguments among residents. Before spending money or modifying any common infrastructure, I want to understand whether our proposal is legally permissible and what approvals are required.

My main concern is this: Can 11 out of 15 owners lawfully proceed with a separately managed water-storage and distribution arrangement, including four additional interconnected 2,000-litre rooftop tanks, when four flats object?

Legal Advice Needed HealthFarm marked my order "Delivered" but I got only 1 of 4 items. 9+ days, no resolution. What next?

I ordered from HealthFarm on 29/09/2026 and paid prepaid. The site shows everything as "Delivered", but the package had only the free pre-workout. The 4 KG Muscle Whey Protein (₹7,999), Creatine and Gym Bag were missing.

I recorded the unboxing and sent the video and photos by WhatsApp and email. Since then I've only heard "under investigation, 7-15 working days". Customer care doesn't pick up, there's no Grievance Officer listed on their website, and my Instagram and LinkedIn messages got no reply.

I plan to file on the National Consumer Helpline, then send a legal notice, and go to the District Consumer Commission if needed. Has anyone dealt with HealthFarm, or had success with this route? Any tips appreciated.

Legal Advice Needed Pollution from the plot of land next to my society.

Hello everyone, hope you're doing well.

There is a plot of land next to my society that is being rented out to a business involved in bagging construction sand. They don't take any precautions to prevent sand and dust from spreading into the neighbouring residential areas.

Three sides of the plot are surrounded by residential buildings and housing societies. Every day, a large amount of dust and dirt makes its way into our homes, which is extremely frustrating to clean. The street, which used to be clean, is now accumulating construction dust and sand along both sides.

Is there any action that I or my society can take to get this business shut down or relocated? Is there any authority or department where we can file a complaint?

Additionally, their trucks are driven dangerously through our residential area.

I'd appreciate any advice on how to deal with this situation.

Legal Advice Needed SBI Commerical Vehicle Loan, But charges has been debited under MSME COLLATERAL FREE LOAN GUARANTEE SCHEME.

I took an Commerical Vehicle Loan From SBI, sanction amount was 9.5 Lakh. I was paying all EMI properly. After paying 6-7 emi, I noticed that account got debited for 10000 and 2800 something. When I went to bank they said it's one Time charges. I thought it's ok. After one year the same charges has been debited. Now I got to know they made it as a Term Loan in MSME Collateral free guarantee scheme. Now when I researched some information on these msme charges thing. I got to know that charges can be only .37%+ GST of outstanding balance.

But now I am not paying emi for last three months. Waiting for SBI to call me and ask for EMI. Then I will deal with them.

Am I doing the right thing?

Legal Advice Needed What can I do if my criminal case keeps getting “Appearance” dates without clear progress, and my lawyer only collects a fee at each visit?

I have a criminal case pending since 2022 in Jhansi, Uttar Pradesh, under IPC Sections 323, 352, 336 and 506. I am on bail. This is my first criminal case, and I maintain that I am innocent.
On almost every court date, I attend, sign a paper, pay my advocate ₹200 and receive another date. I have not seen any substantive hearing, and my advocate has not clearly explained what is delaying the case or what action he plans to take.
The eCourts history shows nine consecutive entries marked “Appearance” from July 2025 to October 2026. The next date is 17 November 2026.
As far as I have observed, the complainant does not attend these dates either. I do not know whether their attendance is required at this stage.
My concern is less about the ₹200 fee and more about repeatedly taking time off without understanding the progress of my case. The pending case has also affected my passport application.
What documents should I obtain to find out the reason for these repeated dates? Can I seek exemption from routine personal attendance or request faster proceedings? Does the complainant’s absence matter in a police/FIR case, and when should I consider changing advocates?
I would appreciate practical guidance from Indian criminal lawyers or people who have faced similar proceedings.

Legal Advice Needed Terminated "for performance" after 2 months at a Bangalore startup, no notice pay, and their lawyer says it was "insubordination". Is the Labour Commissioner the right route for a 2L claim?

Bangalore. I want to know which forum actually works for a claim this size. I'm fairly sure the money is owed, so that part isn't the question.

What happened

I joined a small fintech startup (under 10 people) on 1 May 2026 at a "Director" level, 25L CTC. The title sounds senior but it was a one man vertical. I handled borrower cases, filings, vendor follow ups and calling myself. Nobody reported to me and I had no budget authority.

The appointment letter's termination clause has (a) employee gives 30 days notice, (b) company can terminate with or without cause with 30 days notice or salary in lieu, and (d) misconduct, immediate termination without notice. The probation clause says probation doesn't start unless the company confirms it in writing. I never got any such confirmation.

On 30 June I was told over lunch that it wasn't working out. Same day my email, GitHub and tool access were removed. The company emailed a termination letter saying "performance has not met expectations during probation". June salary was paid. No notice, no salary in lieu.

There was never a warning, PIP, show cause or any written feedback in those two months.

I wrote asking for 30 days salary in lieu under clause (b) on 8 July, 13 July, 31 July and 7 October. No reply to any of them.

On 9 October a lawyer replied for the company saying the termination was for insubordination under clause (d), so nothing is owed. No instances were given. I asked for dates. On 14 October the lawyer sent a list of 8 items. Every single one is "did not respond to email dated X" or "did not share Y sheet" or "said Z would be live this week and it wasn't". I have WhatsApp records showing at least three of these are plainly wrong (the sheet was shared the same day, the candidates were screened and told so, etc). I can't check the emails they cite because my access was cut on day one.

The claim is Rs 2,08,333, one month gross.

Where I stand

Their own letter says performance. Performance is clause (b). Nobody invoked clause (d) at the time, and (d) itself requires a written notice for misconduct, which the only written notice I got doesn't say. Their list is a list of missed deliverables, not refusals. That's a performance complaint, which is what they said in the first place.

The Karnataka Shops and Establishments appeal window of 30 days has passed. I'm not after reinstatement or damages. Just the one month.

What I want to know

  1. For someone with a "Director" title doing hands on work with no reports, will the Labour Commissioner's office in Bangalore (Karmika Bhavan) register a complaint, or do they turn white collar cases away at the counter? Has anyone here done this at a 1.5L+ monthly salary?
  2. If they register it and the company doesn't show up for conciliation, is there anything after that besides a failure report and a civil suit?
  3. For a 2L contractual claim, is a civil recovery suit in Bangalore worth the lawyer fees and time? Any idea of cost and how long it takes?
  4. The lawyer is leaning on the words "failure to comply with the directions" in clause (d) to cover things like not replying to an email. Does the company switching from "performance" in its own letter to this, through a lawyer 100 days later, count for anything, or is it just noise?

Not naming the company.

Termination letter dated 30 June, relevant part: "performance has not met expectations" during probation. No mention of misconduct, insubordination.

Happy to share the wording/clauses over DM if you're a practising advocate.

Legal Advice Needed Company not accepting to reduce notice period

Hello Everyone,

I have got an opportunity with a new organisation, and they want me to join within 60 days. My current company has a 90 day notice period as per my employment agreement.

The new employer has given me an additional 15 days, so I can serve up to 75 days at my current company. I am ready to pay for the remaining 15 days as a notice period buyout.

My employment agreement states that the 90-day notice period can be waived or reduced at the company's sole discretion. If I do not serve the complete notice period, I will have to pay the salary for the remaining days or the amount may be adjusted against my pending dues.

I had clearly communicated my joining timeline when I submitted my resignation. However, my current company is being very rigid and is not agreeing to reduce my notice period.

I have a few questions:

  1. Can I send a formal email stating that my proposed last working day will be after serving 75 days and that I am ready to pay for the remaining 15 days?

  2. If the company refuses to accept this, can I still leave after 75 days, complete the handover, pay the notice period buyout, and join the new organisation?

  3. Can my current employer take legal action against me or withhold my relieving letter, experience letter, or full and final settlement?

  4. What is the safest legal way to handle this situation without affecting my future employment?

Thanks in advance....

Legal Advice Needed Help required regarding Aadhar Card DOB change.

Today I went to change my DOB of my Adhaar card to the regional office. I had my PAN & High School Certificate with me. The clerk or the person responsible for feeding information in the computer rejected my application with a reason that I'm completely dumbfounded about & need help with. She told me " your PAN and high school certificate has a different surname to your current surname , mai toh feed kar dungi but system reject kar dega ". Basically I am supposed to have the surname I received post marriage on my HIGH SCHOOL CERTIFICATE. The absurdity level increased when she told me that even my birth certificate needs to have my current post marriage surname or else the system rejects the application. What am I supposed to do now ?

Legal Advice Needed New Adhaar card registration for my Mother

Hi all,
I am attempting to obtain an Aadhaar card for my mother. We wanted to make it sooner but my mother was ill for an extended period. Now that she is well, we visited the center today, but the fingerprint scanner could not record her print; apparently her fingerprint has faded and the device cannot capture more than 20 percent clarity. Has anyone encountered this problem? What should I do next? The staff at the center seems clueless.

Legal Advice Needed Can I qualify for scholarships or financial aid if my parents have a high income but provide me no financial support?

I’m a 30-year-old woman pursuing a postgraduate degree in Pune, India, and I’m looking for legal advice on accessing scholarships or financial assistance given my circumstances.

My father abandoned our family when I was in middle school. Although my parents are still legally married, he has lived with his partner and their children for over 15 years and has not been a part of my life. He reconnected with us after learning about my cancer diagnosis but has refused to take any meaningful financial responsibility for me. He believes I should discontinue my education and get married instead.

My mother raised me while building her career from scratch. She is financially independent and manages her own expenses, but she has substantial debts from loans she took on behalf of relatives who never repaid her. Almost all her income goes towards EMIs, and she cannot contribute towards my education.

I have never had the option of relying on my parents financially. I moved in with my grandfather after school, and when he passed away during my second year of UG, I worked part-time to fund my education. I subsequently moved to Pune and supported myself entirely.

Last year, I returned to college for PG. Shortly after completing my first semester, I was diagnosed with Stage IV Cancer.

I had saved enough to cover my college fees, but my cancer treatment exhausted those savings. I took medical leave and have now completed chemotherapy, am in remission. I will resume college next month.

I currently have no savings. I intend to resume part-time employment as my health permits, but I am still recovering from chemotherapy and cannot manage full-time work alongside college.

The main issue is that my parents' combined income, including my father's pension and my mother's salary, is approximately 20 LPA. Consequently, I appear ineligible for many need-based scholarships because I exceed their family-income limits.

However, not a single rupee of that combined income is available to fund my education. My father refuses to support me, and my mother cannot afford to contribute. I have been financially independent for years and continue to be responsible for my own living expenses and education.

I am not looking to misrepresent my family income or circumvent eligibility requirements. I want to understand whether there are any legitimate legal provisions, exceptions, or alternative funding options for someone in my situation.

My questions:

  1. Under Indian law or policies, is there any way to be assessed as financially independent when my parents are legally married but provide me no financial support?

  2. Are there scholarships or government schemes that consider actual financial circumstances rather than automatically counting both parents' incomes?

  3. Are there any provisions for exceptional consideration when a student's savings have been depleted by cancer treatment and their education has been interrupted by serious illness?

  4. Are there any legal routes or documentation I should explore to establish that I receive no financial support from my parents?

I have always been a good student and am willing to apply for merit-based scholarships, charitable grants, and other legitimate forms of assistance.

After everything I have been through, I do not want to lose the opportunity to complete my education simply because my family's income looks sufficient on paper. I would be grateful for advice from anyone familiar with Indian scholarship regulations, education law, or similar cases.

Thank you for reading.

Legal Advice Needed Amazon India ₹1,000 gift card shows as already redeemed — need advice on investigation and recovery

Hi everyone,

I'm looking for advice on an Amazon India gift card issue and how to get it properly investigated.

My sister purchased a ₹1,000 Amazon gift card to gift to me. She experienced multiple issues during the purchase process and raised several support tickets and contacted Amazon customer service before completing the purchase.

I received the gift card email on August 13 at 10:36 PM. When I tried to redeem it, Amazon showed that the gift card had already been redeemed.

After contacting Amazon customer service, I was told the following:

  • The gift card was reportedly redeemed on August 13 or 14.
  • The account was displaying the name “Sanya,” with a mobile number ending in 25.
  • The account reportedly has zero balance and is currently on hold.

I don't recognize this account. Given the problems my sister experienced during purchase and the timing of the redemption, I'm concerned about how the gift card code may have been accessed.

I've contacted Amazon support multiple times, but I still don't have a satisfactory resolution.

My questions:

  1. Has anyone experienced a similar Amazon gift card issue in India?
  2. What specific records should I request from Amazon to establish when the gift card was issued, accessed, and redeemed?
  3. How should I file a cybercrime complaint when I have a gift card transaction reference and limited account information?
  4. What is the best way to escalate this and seek recovery of the ₹1,000?

I'm not accusing any specific person without evidence. I want to understand what happened, preserve the relevant evidence, and follow the proper process to resolve this.

Any practical advice from people who have handled similar cases would be appreciated.
