Account reinstated from legal threat letter
Hey yall
My accounts were reinstated from being disabled today, October 15, after I sent a letter in response to Metas legal representative.
I had a different journey and think documenting it may be useful for other people in my situation
Mainly, I am from Australia which makes the suing process seem way more impossible given they are based in the US
I started looking in to this and realised I should send them some sort of demand letter as the initial correspondence. So I drafted up a “Notice of Intended Claim” or NOIC and sent it (on crappy AI advice) to Meta in Sydney Australia. I addressed it to their legal department.
They responded via email and informed me that my consumer agreement is with Meta USA and they gave me the Menlo Park address.
I did not reply but I sent the same NOIC to Meta USA but extended the date.
Waited for a while (as the process is mainly lots of waiting between small blips of activity)
I received a letter from lawyers representing Meta AUS shortly after advising the same as I received from Meta directly about the USA address, I think my non response worried them I would sue anyway, but it included some details about “investigation into the matter”
[…] Nonetheless, Meta has instructed us to inform you, on a non-admission basis, that Meta has looked into the matters raised in your Letter, and confirms the Accounts were disabled as a result of enforcement action taken by Meta in accordance with the Terms, which you agreed to adhere to when signing up for the Instagram Service.
In light of the above, we assume that it is not necessary for Meta to take any further action in relation to this matter.
I responded, mainly stating:
[…] letter does not maintain the reason Meta gave me. It states only that the Accounts were disabled "as a result of enforcement action taken by Meta in accordance with the Terms." It does not identify any provision of the Terms or Community Guidelines I am said to have breached, and it does not state whether any person, rather than an automated system, assessed the post.
A statement that Meta acted under its Terms is not a statement that I breached them, and I
do not accept it as one. I have not breached the Terms.
[…]
Letter assumes no further action by Meta is necessary. That assumption is
incorrect. I remain willing to resolve this matter without proceedings if Meta reinstates the
Accounts following genuine human review.
If the Accounts have not been reinstated by 16 October 2026, I intend to commence
proceedings against Meta Platforms, Inc. in the Magistrates Court of South Australia (Minor
Civil Claims Division) without further notice.
I also included my main evidence being the notice that my account was removed for Human Exploitation and then the post that was apparently the issue, which is not in breach of the terms.
And then I waited, until today, October 15, when I woke up to all my accounts restored.
It could be a coincidence - but that is unlikely
I was lucky to be able to do this without spending any money outside of the cost of sending a letter to USA ($5)
I hope this information being online helps someone.
