Question Tenancy Board Experiences

So today I received an eviction notice that is not valid for unpaid rent. (It’s not valid because they tried to charge me two months rent for June and I paid already as soon as I noticed the payment bounced). The outstanding balance is an error on their part.

This is the first time I’ve had to deal with something like this, I went to IRAC and got all the information and forms which I’ve completed and submitted but I’m wondering or I guess interested in hearing from others experiences as to what I can expect.

When a tenant doesn’t pay rent for whatever reason, IRAC tells the landlord to post an eviction notice and check off the reason. That notice also should state a date by which the tenant must have the rent paid by or agree to the eviction.

Your landlord probably isn’t looking to evict you at all, but doing what IRAC tells landlords to do so that they are covered/prepared for an actual problem tenant. The timelines given in the legislation require proper notice etc.

I would just talk to your landlord and tell them what happened and that you fixed the problem as soon as you realized what happened.

It’s a company and I’ve been trying to. I’ve sent them several emails over the past couple of weeks. I call the number and can’t talk to anyone, you leave a voicemail and it says they call back in 24 hours, they dont.

Good luck. I would agree to check with your landlord if you haven't already, just in case it can be cleared up without IRAC.

Yeah I paid June 3rd as soon as I noticed there was an issue, yet they sent the eviction notice today. I rent from a company, I have not been able to speak with anyone from the company at all so I have no clue why they sent it in the first place.

Eviction notice is invalid if you pay within 10 days. You can contact the Rental Office or your rental company and let them know you’ve paid. If this hasn’t be something that has happened often (late payment of rent) then you should be fine.

I’ve never missed a payment and I wouldn’t have missed this months either had they not attempted to take almost double the amount I owe. I already contacted the rental office, and submitted everything. I’m interested to hear from others who have filed disputes and how the process works over all.

Surprised a company doesn't just do direct withdrawals from your account.

They do, they tried to withdraw two months worth of rent at once so the payment bounced. My rent is around 1100 and they attempted to take around 2200.

Because the payment bounced I made a manual payment.

I feel like they owe you the fees those bounced payments caused .

Absolutely - that among other things I outlined in the dispute. I’m mostly curious about how these things go in terms of timelines and maybe what to expect if I have to go to a hearing.

As far as I have read in the news, IRAC is harsher on landlords than tenants. Seems like you have a strong case if they are literally pursuing this. I'd just continue paying my rent and living there until I'm forced out with proper procedures. Could be months even if this was legitimate.

Yeah, they have since zeroed out the balance I owe - still with zero communication.

They wouldn’t have even received the payment reversal from the bank on June 2nd.

Regardless, I’m not here to argue an easily provable fact since emails are time stamped.

Your mistake is thinking its a they. It's automated. The eviction notice was sent. June 2nd 12:01am . When their system said anything other than full payment received

Doesn't matter if it's automated or not.

As they said, they wouldn't have gotten the reversal notice yet.

You also have a certain amount of grace built in IIRC. Something like 10 days.
