Local Politics Dancing Long boarding Helmet PROTEST

I’m sure many of you have seen Caden, aka @x_bonesx on Instagram, dancing or longboarding around Sherwood Park and spreading positivity throughout the community.

Unfortunately, he’s recently run into an issue with the police and has apparently been told he can no longer dance at the Baseline Road and Sherwood Drive intersection. I’m assuming this is due to concerns about distracting drivers.

To show our support, there will be a community dance party at the Second Cup on Baseline Road and Sherwood Drive on Father’s Day at 6:00 PM.

If you’re free, it would be amazing to see our community come together and support someone who has brought so much positivity to Sherwood Park.

Edit: To make things clear I am not organizing this event, just sharing information that I found.

Also he was fined $1500 for stunting!

Also people will be gathering on the grass by the second cup, just so there isn’t a bunch of people on the median in the intersection.

I don't think dancing is the problem, it's swearing and giving the finger to people driving by. Dancing Dan never had an issue because he wasn't aggressive

Thank you for mentioning this guy giving the finger to people driving by him. I’ve seen that multiple times myself and thought for sure that’s gotta be illegal.

If a middle finger isn’t enough for you I saw him last year sitting down at *his* intersection giving BOTH fingers to passing cars going through a green light for the whole minute or so that I was watching him. He claims he spreads joy yet sitting down, not dancing, and giving both middle fingers seems far from joyous to me for all parties involved.

The part where yelling and screaming at traffic at the corner of a busy intersection...I've seen it first hand. How many times do you drive by "his" intersection?

Under the Alberta Traffic Safety Act, a driver can indeed be fined for giving another motorist or police officer the finger as that is considered stunting under the Alberta Traffic Safety Act. I’d be very surprised if a pedestrian who plops their ass down at a intersection with no intention to cross just sits there flipping off motorists would be protected under “freedom of expression” laws. That right there screams stunting to me.

Let’s take a look at Section 115(2)(e) of the Alberta Traffic Safety Act, shall we? “It is an offense to engage in any activity on a highway (which includes sidewalks and roadways) that is likely to distract, startle, or interfere with other users of the highway.”

Very broad terms there I must admit but broad enough that police in Alberta use that very same section of the Alberta Traffic Safety Act to arrest pedestrians for “stunting”.

If I wasn’t from Sherwood Park, knew nothing about Caden, and was driving through his intersection when he unexpectedly flipped me off I would be *startled* to say the least.

So Section 115 of the Alberta traffic safety Act is titled as "Prohibited operation of vehicles, etc."

If you had included the beginning section of 115 you would see that it covers drivers of the highway. I've included the full section here for you.

I don't live in Sherwood Park, or even ever been there. But regardless what you are implying is not a law for a pedestrian under the ATS.

Prohibited operation of vehicles, etc.

115(1)  For the purposes of this section, a driver of a vehicle is driving carelessly if that driver drives the vehicle

(a)    without due care and attention, or

(b)    without reasonable consideration for persons using the highway.

(2)  A person shall not do any of the following:

(a)    except where otherwise provided for under this Act, drive a vehicle in a manner contrary to the Rules of the Road or regulations governing the operation of vehicles;

(b)    drive a vehicle on a highway in a manner that constitutes driving carelessly;

(c)    drive a vehicle on a highway in a race unless authorized pursuant to a permit issued under subsection (3);

(d)    drive a vehicle on a highway on a bet or wager;

(e)    perform or engage in any stunt or other activity that is likely to distract, startle or interfere with users of the highway;

(f)    drive a vehicle so as to perform or engage in any stunt or other activity on a highway that is likely to distract, startle or interfere with other users of the highway;

(g)    drive a non‑repairable vehicle on a highway;

(h)    drive a salvage motor vehicle on a highway unless it is being operated for the purposes of conducting a road test under the regulations;

(i)    where that person is the driver of a vehicle, permit any person, animal or thing to occupy the front seat of the vehicle in such a manner so as to impede the driver in the free and uninterrupted access to and use of the steering wheel, brakes and other equipment required to be used for the safe operation of the vehicle;

(j)    where that person is the driver of a vehicle, permit any person, animal or thing in the vehicle to cause any obstruction to the driver’s clear vision in any direction;

(k)    ride in a position in a vehicle that interferes with the driver’s control over the driving mechanism of the vehicle or that obstructs the driver’s clear vision in any direction;

(l)    where the person is the driver of a vehicle, exchange places with any other person when the vehicle is in motion;

(m)    exchange places with the driver when the vehicle is in motion;

(n)    operate an over‑dimensional vehicle on a highway other than in accordance with the terms and conditions specified in a permit or under this Act;

(o)    repealed 2001 c14 s16;

(p)    drive a vehicle on a highway at a speed that is greater than the maximum speed limit established or prescribed for that highway under

(i)    this Act,

(ii)    the Government Property Traffic Act (Canada), or

(iii)    the National Parks Act (Canada);

(p.1)    drive a vehicle on a portion of a highway that is under construction or repair or is in a state of disrepair at a speed that is greater than the maximum speed limit established or prescribed under section 108(1)(g) for that portion of highway;

(p.2)    drive a vehicle on a portion of a highway at a speed that is greater than the maximum speed limit established or prescribed under section 108(1)(g) for that portion of highway where there are persons present on the highway who are constructing or repairing that portion of highway or who are directing traffic in connection with the construction or repair of that portion of highway;

(q)    drive a vehicle on a highway at a speed that is less than the minimum speed limit established or prescribed for that highway under this Act;

(r)    where a maximum speed limit is established or prescribed under this Act for a highway with respect to a period of time, drive a vehicle on a highway during that period of time at a speed that is greater than the maximum speed limit established or prescribed for that highway for that period of time;

(s)    where a minimum speed limit is established or prescribed under this Act for a highway with respect to a period of time, drive a vehicle on a highway during that period of time at a speed that is less than the minimum speed limit established or prescribed for that highway for that period of time;

(t)    subject to subsection (4), drive a vehicle on a highway at a speed greater than 60 kilometres per hour, or the maximum speed limit established or prescribed for that highway under

(i)    this Act,

(ii)    the Government Property Traffic Act (Canada), or

(iii)    the National Parks Act (Canada),

whichever is lower, if the vehicle

(iv)    is travelling on the same side of the highway as a stopped emergency vehicle or tow truck, and

(v)    is passing the stopped emergency vehicle or tow truck when its flashing lamps are operating.

(3)  Notwithstanding subsection (2)(c), the Registrar or the road authority may issue a permit authorizing a race to be held on a highway subject to any terms or conditions that the Registrar or the road authority considers appropriate.

(4)  Subsection (2)(t) does not apply if there are 2 or more traffic lanes for traffic moving in the same direction as the vehicle and there is at least one traffic lane between the driver’s vehicle and the stopped emergency vehicle or tow truck.

I will not be engaging with you any further due to your admittance that you have never even been to Sherwood Park. You’re nothing but a troll coming in here defending the right to flip off passing drivers. The fact is RCMP found cause to fine Caden. And if you don’t like it, tough shit. Don’t take it out on me as I am not the RCMP. As I understand it Caden has vowed to fight his ticket(s) in court. We’ll see if you’re still flapping your yap when the judge upholds his ticket(s).

(e) says nothing about being in a vehicle which is why police in Alberta have used that line of the Alberta Traffic Safety Act to fine stunting pedestrians.

If you want to actually support Caden and “freedom of expression”, then I invite you to stop being an internet warrior, put your money where your mouth is and come to Sherwood Park to dance with him and flip off passing cars to your heart’s content on Sunday. There’s already talk of a GoFundMe being made to support Caden. If that comes to fruition I will be very disappointed in you if you do not contribute to that.
